This should be "FUERE" since it's talking about information (in singular) |

See explanation Explanation: The Spanish text is poorly written, and it seems to me that the phrase in question adds nothing to the meaning: "up until the return date" says exactly the same as "during the validity of the contract", so I suggest a reformulation something like this: "Within 5 days after the date of termination of this contract, THE SELLER is obliged to return all Confidential Information she may have in her possession, the understanding being that during the validity of this contract and even after its termination, she may not use, make public, or divulge said Confidential Information to third parties."
