Hello,

I am translating legal documents regarding an appeal of a court order in which it is stated that the accused has already been tried for the same crimes in his native country.

I am struggling with 'sobrevenida', it appears various times in the document:

Ello por una razón fundamental: al no entrar a considerar ni valorar los razonamientos de nuestro escrito, varias veces ya citado, de 21.06.2010, se ha olividado o ignorado que están en juego y son base de nuestra petición, hechos jurídicos de tal trascendencia que afectan nada menos que a derechos fundamentales del imputado como son su libertad y el derecho a un proceso justo con todas las garantías; asimismo afectan al derecho-deber del Estado Español de juzgar o someter a proceso penal a XXXX porque tal derecho-deber, se ha extinguido sobrevenida y definitivamente, por hechos y actos jurídicos muy posteriores a las fechas de los hitos procesales que se indican por el Ministerio Fiscal y acogen el auto.....

En definitiva, hay extinción sobrevenida de la juridicción española para enjuiciar a XXXX por los hechos por los que es reclamado (al haber sido ya juzgado por todos ellos ante la juridicción natural y preferente para ello: Kuwait)....

La prescripción (plenamente alegable y elemento tracendental en toda la materia jurídica extradicional) también, por decirlo así, sobrevenida, a la vista de la doctrina nacida, desarrollada y fijada por los más altos Tribunales de nuestra Nación, con posterioridad a la solicitud de extradición del XXXX; así la doctrina nacida, y después consolidada, de la conocida como “sentencia de los Albertos” y las proprias sentencias del Tribunal Supremo que han considerado extinguida por prescripción la responsibilidad penal de otros imputados por los mismos hechos por los que se reclama de extradición a XXXX.
