I am editing a Spanish court document and I can't seem to figure out if the translation used is correct. The translator translated JUICIO MONITORIO as SMALL CLAIMS PROCEDURE but I don't think that's correct.

According to the website: mundojuridico.info, a juicio monitorio is:
El juicio monitorio es un procedimiento judicial para reclamar el pago de deudas dinerarias de cualquier importe siempre que reunan una serie de requisitos.

Para que la deuda se pueda reclamar mediante el juicio monitorio, debe de reunir una serie de requisitos: debe ser una deuda dineraria, líquida, determinada, vencida y exigible.

agree  Robert Carter: I agree with Chris about "small-claims proceeding" or at the very least this term needs hyphenating to "small-debt proceedings", because it took me a moment to click to what this term meant.

El juicio monitorio es un procedimiento judicial para reclamar el pago de deudas dinerarias de cualquier importe siempre que reunan una serie de requisitos.

Para que la deuda se pueda reclamar mediante el juicio monitorio, debe de reunir una serie de requisitos: debe ser una deuda dineraria, líquida, determinada, vencida y exigible.

Deuda DINERARIA, significa que el derecho de crédito exigido debe expresarse en dinero en sentido estricto, es decir, en moneda de curso legal, nacional o extranjera, por lo que quedan excluidas del proceso monitorio la obligaciones de hacer, así como las obligaciones de dar cosas determinadas.

Deuda VENCIDA, es aquella cuyo plazo de pago ha transcurrido, es decir, ha vencido. No cabe por tanto mediante un juicio monitorio reclamar deudas de futuro, que no han vencido todavía.
