So far, neither in the asker's question nor in the legal references you provided do we encounter the expression بمثابة حضوري used by way of arcane jargon. Once the typo issue has been resolved (thanks to you and Ramadan), the meaning becomes plain, and I would recommend a plain translating of the expression, just the way it sounds.
Thank you again for clarifying. I understand clearly now your thought process behind the literal meaning of بمثابة حضوري . After reading through the explanation again in the وسوعة قانون المسطرة المدنية المغربية I can see that the phrase بمثابة حضوري is not really a defining term, but rather a description of what has happened. So, simply translating those words is correct I think. Also when this appears in the asker's question, it is also as a descriptive phrase. Do you agree?
. . . but I am relying (perhaps too heavily) on the ordinary meaning that we all know of the word بمثابة. Typically, when we say about something that it is بمثابة كذا أو كذا, we mean that it is not so in the ordinary sense but is deemed so in effect. For instance, if I say about a person that he was بمثابة أب, I would be understood to mean that he was not really my father, but, for all practical purposes, he was so. Therefore, بمثابة حضوري would mean "effectively in person." This is, of course, an extrapolation.
Your comments are very useful. However, not being a legal expert myself, I am finding it hard to follow all the different aspects of this. I am not sure what the right answer is.
. . . as well as the definition provided in the California Superior Court English-Arabic Glossary are, of course, correct, but the definition provided in both sources are clearly not the meaning of the term used in the sentence posted by Mr. Hassan Lotfy. The meaning in both dictionaries are closer to "in absentia," which is the opposite of "in person." The meaning of بمثابة حضوري is when the party is absent but the judgment is deemed effectively in person based on specific criteria established by the court. The Arabic text you provided earlier specifies the situation in which a judgment, though render without the presence of the party, is deemed virtually or effectively in person. Item 4 specifies the criterion for this classification, namely, when the judgment is subject to appeal. There may be other criteria in other jurisdictions. The point is that a judgment can be (1) in person, (2) effectively in person, or (3) in absentia. An in absentia judgment can be a default judgment or can be in absentia due to other circumstances.
I found this in Barron's Legal Guides Law Dictionary: DEFAULT JUDGMENT: A judgment entered against a defendant due to his failure to respond to the plaintiff's action or to appear at the trial; "one taken against a defendant who, having been duly summoned in an action, fails to enter an appearance in time;" a judgment which is given without the defendant being heard.
I believe this represents the Arabic meaning well.

I still find Ramadan Ibrahim's suggestion of a typo quite plausible (and clever), but a confirmation from the agency/client would be helpful. Often, translation agencies have no idea about the content of the documents they send out for translation, so that may be a lost cause. If the agency has an Arabic-speaking specialist, you may be able to explain the dilemma to the specialist, who would in turn clear the matter with the client, who, I presume, is the holder of the document. This may all be wishful thinking on my part, but, who knows, it might be worth a try.
