verbal phrase Explanation: Glosowane orzeczenie powiązane jest (między innymi) z problematyką tzw. przestępstw wieloodmianowych. Zdaniem Sądu Apelacyjnego: 1) zawartość normatywna art. 11 § 1 k.k. sprowadza się do nakazu uznawania za jedno przestępstwo jednego (tożsamego), relewantnego prawnokarnie czynu; o tym zaś, czy i kiedy mamy do czynienia z jednym czynem w rozumieniu art. 11 § 1 k.k., rozstrzyga przede wszystkim znamię czasownikowe, którego użyto do opisania zachowania zabronionego pod groźbą kary; The issue of (among others) multi-variant offence has been taken upon in the glossed judgement. According to the Court of Appeal: 1) legislative content of art. 11 § 1 k.k. comes down to warrant consideration of one (identical) penally relevant action as one crime; while primarily the verb feature that has been used to describe the criminal offence decides if and when we deal with a single offence according to art. 11 § 1 k.k https://wnus.edu.pl/ais/file/article/download/8839.pdf cccccc The offender’s intent is also important when interpreting the other feature of the act laid down in Article 256.1 of the Criminal Code, i.e. the verbal phrase “incite hatred.” Zamiar sprawcy jest istotny także przy wykładni drugiego znamienia czasownikowego czynu określonego w art. 256 § 1 k.k., tj. „nawoływania do nienawiści”. https://www.gov.pl/attachment/54e73be9-4dd7-441e-828c-029d09... -------------------------------------------------- Note added at 1 hr (2020-05-21 11:18:53 GMT) -------------------------------------------------- "verb feature" też jest możliwym tłumaczeniem. subjective word // subjective interpretation of Explanation: Having searched through quite a few Polish legal texts with this term, I see that they most often talk about the interpretation of particular words in legal texts. My initial understanding was "operative words" or "operative phrases." See the definition of "operative words" in the following link: https://www.translegal.com/dictionary/en/operative-word/noun However, I found a similar expression used in a text in the Official Journal of the European Union: In Polish: "3) Czy znamię strony podmiotowej „świadomie i umyślnie” w rozumieniu art. 7 ust. 4 rozporządzenia nr 423/2007 wymaga po pierwsze wiedzy o powodowanym, bądź zamierzonym obejściu zakazu udostępnienia zasobów gospodarczych i ponadto również bardziej rozbudowanego elementu woli, przynajmniej w tym sensie, że sprawca godzi się na obejście zakazu?" In English: "Does the subjective condition ‘knowingly and intentionally’ in Article 7(4) of Council Regulation (EC) No 423/2007 require on the one hand actual knowledge that the effect or objective of the activities is circumvention of the prohibition on making available economic resources and in addition a more extensive volitional component, at least in the sense that the offender approves of the possibility that circumvention of the prohibition might occur?" Links: https://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:C:... https://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:C:... One example of a Polish text mentioning your term is below: "2.2.4.1. They talk about the subjective word "znieważa" (offends/insults). This would definitely be a word that's open to interpretation, and it certainly can be subjective. In a website focusing on criminal law, one of the seemingly knowledgeable commentators posted the following (which I found interesting): "Chciałbym przy okazji, także poruszyć problem związany z problematyką obiektywnego przypisania skutku, a mianowicie roli znamienia czasownikowego w zakresie przypisania skutku. Kwestia sprawdza się do pytania, czy można zarzucić sprawcy popełnienie czynu zabronionego, jeżeli wprawdzie jego zachowanie przekracza normę sankcjonowaną, działanie jest bezprawne i pozostaje w kauzalnym związku ze skutkiem, ale zachowanie sprawcy nie mieści się w zakresie znaczeniowym znamienia czasownikowego?" This convinces me even more that they are talking about the subjectivity of the words (i.e. not necessarily being able to ascribe objective acts to subjective words). A word like "offend" can hardly be given objective criteria in a criminal case. One has to look at the broad spectrum of possibilities to see how it could apply, i.e. the subjective meaning of the word. There is no exact equivalent in English for this term, but I would adapt it according to the situation, e.g., "subjective phrase," "subjective words," "subjective word," "subjective interpretation of," etc. My attempt at the translation of your sentence would be as follows: Therefore, if the offender's behaviour resulted in him having committed several acts falling within the list of alternative, subjective interpretations of the word "fencing" in relation to the same criminal act, then his behaviour may be deemed a single criminal offence. -------------------------------------------------- Note added at 8 hrs (2020-05-21 18:38:11 GMT) -------------------------------------------------- I forgot to add the link to the "website focusing on criminal law": https://www.dogmatykarnisty.pl/2013/01/dwie-uchwaly-duzo-wat... |

verb expression Explanation: a verb expression Luźna propozycja -------------------------------------------------- Note added at 2 days 6 hrs (2020-05-23 16:41:37 GMT) -------------------------------------------------- Opcja 2: verb or verb phrase w ten sposób obejmujemy jeden czasownik lub więcej wyrazów (w tym czasownik); a one-word verb or a verb phrase (a verb with one or more helping words) -------------------------------------------------- Note added at 2 days 9 hrs (2020-05-23 18:53:15 GMT) -------------------------------------------------- Naczelny Sąd Administracyjny w wyroku z dnia 28 czerwca 2005 r. |
