The UK equivalent would be guardian or court-appoint deputy, as a person appointed to take care of a ward, i.e. care and protection and administer said ward's financial affairs and assets. We have had several of these long-standing power of attorneys in my family with my sister appointed as guardian or deputy, normally decided by a County Court. |

Oath taken by court-appointed limited guardian Explanation: In contrasto con 'complete guardianship' (interdizione) The Italian figure of limited guardian (“Amministratore di sostegno”, introduced by law n. 6/2004) has recently achieved new application through abundant case law which concedes the possibility, for the limited guardian, to take health care decisions regarding incapacitated adults, in accordance with their previously-advanced directive. However, Italian judges do not agree about the letter of the law, i.e. about legitimating such use of the limited guardian. For this reason, we now have a considerable number of judges’ decisions allowing this possibility, and a similar number which deny it. Thus, it is important to examine the position of doctors when faced with both kinds of judges’ decisions. Among the duties of the “amministratore di sostegno” (from now: “limited guardian”1), as indicated by art. 404 and following articles, civil code, as modified by law 9th January, 2004, n° 62, there certainly are health-care decisions, as agreed by almost all Italian legal doctrine3 as well as case law. Right from the first appointments of limited guardians, Italian judges have recognized the possibility, for the same, to surrogate the ward regarding not only their assets but also their personal care. When it is necessary to give informed consent for medical procedures, the problem is not whether the limited guardian can or cannot take such decisions but, more specifically, whether they can oppose the ward’s desires. In this matter, Italian case law is divided: some judges think that the limited guardian cannot totally surrogate the ward’s health-care decisions, especially when there is a divergence between the ward and the limited guardian (for this purpose it should be necessary to appoint a “complete” guardianship (interdizione) Ricerco link del prezioso documento nel quale troverai spiegato tutto. Essa ha come conseguenza l’ablazione totale della capacità di agire della persona interdetta. Un tutore, nominato dal tribunale, lo sostituirà nel compimento di tutti gli atti, sia di ordinaria che di straordinaria amministrazione. Pertanto, gli atti eventualmente compiuti dall'interdetto dopo la pubblicazione della sentenza di interdizione possono essere annullati. L'inabilitazione (art. 415 c.c. - link) è, invece, prevista a tutela del maggiore d'età infermo di mente, il cui stato non è però talmente grave da dar luogo all'interdizione. Mira a proteggere anche coloro che, per prodigalità o per uso abituale di sostanze alcooliche o di stupefacenti, espongono se stessi o la loro famiglia a gravi pregiudizi economici. Un curatore, nominato dal tribunale, avrà il compito di assistere l'inabilitato negli atti di straordinaria amministrazione, mentre quelli definiti di ordinaria amministrazione continueranno ad essere validamente posti in essere dal solo inabilitato. Gli atti di straordinaria amministrazione eventualmente compiuti dall'inabilitato dopo la pubblicazione della sentenza di inabilitazione o dopo la nomina del curatore provvisorio possono essere annullati. L'amministrazione di sostegno (art. 404 c. c. - link) è un istituto entrato di recente nel nostro ordinamento (la legge che la prevede è la n. 6 del 2004) e risponde all’esigenza, che veniva invocata ormai da decenni, di trovare uno strumento di tutela delle persone deboli meno invasivo dell’interdizione e dell’inabilitazione.
