كان شهود العدل في الماضي أشخاص من عامة الناس يشترط فيهم للإشهاد بين الناس شروط العدالة التي حددتها الشريعة الإسلامية وهي كثيرها أهمها السمع والبصر والتقوى والسيرة الحميدة ومعرفة الفقه وتحرير العقود وإتقان اللغة العربية وفن الخط الخ. أما اليوم فإن شهود العدل في المغرب هم من ممارسي المهن الحرة لهم مكاتب في المدن والقرى المغربية ومعتمدون لدى المحاكم الابتدائية فيها. يقوم شهود العدل (أو العُدول كما يسمون اليوم في المغرب) بتدوين العقود المتعلقة بالأحوال الشخصية (ويقابل مصطلح "الأحوال الشخصية" مصطلح "المناكحات" في الشريعة الإسلامية)، ويدونونها في سجل خاص بهم اسمه "مذكرة الحفظ" أو "كُنَّاش (= دفتر) الجيب". ويسمى تدوين العقود في "مذكرة الحفظ" "تلقي الشهادة" بمعنى أن العدلين يتلقيان الشهادة من أصحابها (العروسين في هذه الحالة) ويدونان خلاصتها في "مذكرة الحفظ". بعد ذلك يصيغان الخلاصة في عقد زواج نهائي (غالبا ما يحمل عقد الزواج واحدا من الأسماء التالية: عقد زواج، رسم نكاح، زوجية، صداق ...). ثم يقدم العقد إلى قاضي التوثيق في المحكمة التي يعمل العدلان ضمن نطاقها للمصادقة عليه. وتسمى مصادقة القاضي على الوثيقة "خطابا" أي أن قاضي التوثيق "يخاطب على الوثيقة بخطابه ويختم عليها بخاتمه". بعد ذلك تكتسب الوثيقة الحجية المنصوص عليها شرعا. وخطاب قاضي التوثيق الموضوع على الوثيقة التي بين أيدينا هو: "الحمد لله. أُعْلِمُ بِثُبوتِه" أي أن قاضي التوثيق يعلم القاصي والداني بثبوت هذا العقد لديه الثبوت الشرعي الذي يكسب الوثيقة الحجية الشرعية أو قوة الإثبات. بعد ذلك يسجل العقد في سجلات المحكمة المختصة وهي المحكمة ذاتها التي يعمل العدلان ضمن نطاقها.
يتضح مما سبق أن وظيفة "العدل" في القضاء المغربي تقابل إلى حد بعيد وظيفة الكاتب بالعدل في القضاء الأوربي وإن كان هنالك فروق ليست مهمة بحيث نختصر هنا ونشير إلى أن الترجمة الأفضل "للعدل" في الإنكليزية هي: notary، وفي الفرنسية: notaire، وفي الهولندية: notaris
