audiencia preliminar / vista preliminar 17:35 Jul 20, 2020
The definition helps. From it, we can tell it’s a civil case (“injunction”). I can't help you out with that, but I can tell you that the terms I list in the subject heading have specific meanings in the criminal arena.
In Puerto Rico, a vista preliminar is the same thing as a U.S. preliminary hearing, aka, probable-cause hearing, which, as generic as it may sound, it serves for a lower criminal court to determine if there is probable cause at the judicial level in order to bind the case over for trial.
In many Latin-American countries where there have been reforms to their criminal procedure codes, the term audiencia preliminar is more like a pretrial conferece, i.e., to prepare a case for trial.
If your translation is for Spain or Guatemala, both terms would be generic and present no problems, unless those countries have a specific term that is used the same way return date hearing is. If it is for any other country, it would be better to avoid said terms. |
