application for permission to issue an additional claim > pre-Lord Woolf: for leave to amend or add pedido de autorização prévia de promoção de um complemento da reclamação Explanation: Again, pre-1998 civil justice reforms in E&W, this would have been called something like: appication for leave to amend pleadings by 1. changing the statement or 2. amending the writ etc. with the effect of adding a new claim. The new wording is supposed to reflect the bifurcation or 'two-way split'. Statement of case: the 'new' (US-Am.-cribbed) E&W term for a statement of claim or of defence -------------------------------------------------- Note added at 7 heures (2020-08-14 12:38:00 GMT) -------------------------------------------------- Akser's discussion entry: additional claim may mean generally a compensation claim if unemployment benefit is the context, but - in E&W litigation - can mean amend a writ pending / running - or a writ that has expired after one year without being served on the defendant - by adding 'an extra head of claim' - titolo di pretensão. Maybe others can take this ball and 'run with it' in Portuguese - all I do is extrapolate from Spanish / gallego. Reference: http://www.justice.gov.uk/courts/procedure-rules/civil/rules... |

application for permission to issue an additional claim formulário/requerimento para autorização de dedução de pedido de indemnização complementar Explanation: Secondly, it must be borne in mind that, according to settled case-law, the rules laid down in Article 73 of the Staff Regulations and the rules of ordinary law are complementary, with the result that it is possible to make an additional claim for compensation when the institution is liable and that payments made on the basis of Article 73 of the Staff Regulations are not sufficient to ensure full compensation for the damage suffered ([Leussink], paragraph 13, and [Lucaccioni], paragraph 22). |
