"To mortgage" emphasizes an action of the mortgagor (e.g. as distinct from the mortgagee, or a contract, or as distinct from the mortgagor and mortgagee jointly. The sentence reads literally: "In practice, a legal mortgage is often set up ...". This is vague. (Incidentally, I would leave out the word "legal" because it adds confusion as to whether the title transferred is legal or equitable title.) |
