Explanation:
A written request to a higher court to modify or reverse the judgment of a trial court or intermediate level appellate court. Normally, an appellate court accepts as true all the facts that the trial judge or jury found to be true, and decides only whether the judge made mistakes in understanding and applying the law. If the appellate court decides that a mistake was made that changed the outcome, it will direct the lower court to conduct a new trial, but often the mistakes are deemed "harmless" and the judgment is left alone. Some mistakes are corrected by the appellate court -- such as a miscalculation of money damages -- without sending the case back to the trial court. An appeal begins when the loser at trial -- or in an intermediate level appellate court -- files a notice of appeal, which must be done within strict time limits (often 30 days from the date of judgment). The loser (called the appellant) and the winner (called the appellee) submit written arguments (called briefs) and often make oral arguments explaining why the lower court's decision should be upheld or overturned.

Eh, sad mi napraviste posao, Ljiljana, a ja htedoh da izbegnem...

Agramovo resenje (tj. resenje iz recnika) je potpuno u redu. Legal remedy jeste \"pravni lek\" i njegov prevod je apsolutno tacan, ali ne predstavlja jedinu mogucnost.

Resenje koje sam navela je takodje validno i dobro (proveriti pod \"legal recourse\" u recniku Jovanovic/Todorovic).
U firmi za koju sam nekada radila, trazili su da ovako prevodimo \"pouku o pravnom leku\" i ovo resenje je takodje tacno, u to nema nikakve sumnje.

Sto se Blacka tice, evo sta kaze (to jest, vidi se da \"remedy\" i \"recourse\" mogu da znace isto):

recourse - 1. The act of seeking help or advice. 2. Enforcement of, or a method for enforcing, a right. 3.The right of a holder of a negotiable instrument to demand payment from the drawer or indorser if the instrument is dishonored... 4. The right to repayment of a loan from the borrower\'s personal assets, not just from the collateral that secured the loan.

Jus signifies here the legal authority to do or to demand something; and remedium may be defined to be the right of action, or the means given by law, for the recovery of assertion of a right. A man who has a right to vote at an election for Members of Parliament may maintain an action against the returning officer for maliciously refusing to admit his vote, though his right was never determined in Parliament, and though the persons for whom he offered to vote were elected; if men will multiply injuries, actions must be multiplied too, for every man that is injured ought to have his recompense.

Complaint = prigovor, zalba (nekoj drugoj instanci, razlicitoj od Suda)
Appeal se u pravnoj terminologiji razlikuje od Complaint - veoma.
Bas kao sto se i sudska zalba razlikuje od prigovora.

Ako se javite na oglas za radno mjesto i ne budete primljeni, u odbijenici vam se daje pouka o pravnom lijeku u kojij stoji da u roku od 15 dana imate pravo da ulozite zalbu protiv donesene odluke (obicno Komisiji za zalbe) i ta ZALBA nije APPEAL - ni u kom slucaju.
Vec je COMPLAINT. You may lodge a complaint against...
Ako vam se odbije COMPLAINT, onda imate pravo da idete na Sud i da ulozite APPEAL.

I COMPLAINT, bas kao i APPEAL su: LEGAL REMEDY (pravni lijek).

Black\'s Law Dictionary i James\' Introduction to English Law objasnjavaju jako dobro razlike izmedju ovoga.

Po zakonu se covjek moze zaliti na svaku donesenu odluku, cak i na odluku kucnog savjeta da se djecje igraliste unutar stambenog kompleksa jednim dijelom betonira kako bi se dobio visak parking prostora - zaliti se moze Opstinskoj komisiji za prostorno uredjenje. Ali to nije APPEAL.

Na vasem, pravni lijek je zalba, a na nasim ima mnogo sire znacenje, obuhvateci sva pravna sredstva kojima se nanesena nepravda moze ispraviti. Zatim mislim da je bolje ovako.
