In the case where you are talking about care provided under the AWBZ in relation to the others then the others have precedence over the provisions of the AWBZ.

Actually under the provisions of the AWBZ all other avenues of care provision must be exhausted before the care provided pursuant to the AWBZ is provided. It is after all the Exceptional Medical Expenses Act. So medical care provided under the ZorgverzekeringWet and similar must used first.

but in the phrase "precendential statutory provisions" "precendential" suggests that these provisions themselves are precendential, doesn't it? This is not the case, the context decides which provisions are precedential, one time the AWBZ , another time more elementary provisions ??

I think the English reader will think that these provisons are more important ??

I've used precedential as it means they take precedence over the care provided in the AWBZ. The idea is that you use these statutory provisions first... if that is not enough then you can ask for care to be provided under the AWBZ. Hence why I said precedential.

Kate, if you want to go down Kitty's road, then I doubt whether "precedential" is the right word, because doesn't "precedential" suggest that these provisions were more important?

Wouldn't "elementary, basic" be more appropriate?

I am thinking about using the term "precedential statutory provisions' for 'wettelijk voorliggende voorzieningen' as they take precedence over provisions that are provided by the AWBZ. This is in line with the line of thought proposed by Kitty.
For the second 'is het voorliggend om..." I am going to use 'self-evident'.
This may need two glossary entries or at least a combined double entry.

maar DEZE zorg wordt nu nog door familie, vrienden ... mantelzorg

Je hebt een AWBZ-indicatie waarom zou je dan nog gebruik maken van mantelzorg? Het is dan toch veel logischer om de zorg door andere zorgverleners (betaalde) uit te laten voeren of in te laten kopen

I read it mostly as available services (bestaande voorzieningen).
Ik begrijp je voorbeeld beter als de omringende zinnen erbij betrokken worden: "Als dit onvoldoende oplossing biedt, dan kan een AWBZ indicatie gesteld worden, waarin de gebruikelijke zorgtaken tijdelijk worden overgenomen. Indien er al (**dwz reeds**) een indicatie voor AWBZ-zorg is en deze zorg door de partner, ouder, volwassen kind en/of andere huisgenoot zelf wordt (**dwz werd**) geleverd, dan is het voorliggend om de zorg door (andere) zorgverleners uit te laten voeren/in te kopen. de vraag is dan wellicht of "wettelijk voorliggende voorzieningen" gelezen moet worden als de "wettelijk bestaande/beschikbare voorzieningen" of als "de voorzieningen die wettelijk voorliggend zijn"

I think (with Textpertise) the second "voorliggend" means "voor de hand liggend": obvious

the first "voorliggend" appears in combination with "wettelijk": wettelijk voorliggende voorzieningen

If there are no technical snags and snares, I would say "voorliggend" means, in combination with "wettelijk", "beschikbare, bestaande"

The root meaning is that it exists before you. In the case of "wettelijk voorliggende voorzieningen", I would agree with Edward's suggestion. However, in the case of "dan is het voorliggend", I would see the sense of it as more that it is the obvious choice - the one which is right before your nose to do ...
