Specific offence of failing to prevent bribery on behalf of the company This is a new corporate offence. It is committed if a company fails to prevent persons (employees or Associated Persons) from using bribery with the intention of obtaining or retaining a business advantage for the company. For this offence it is irrelevant whether or not the company approves, or is aware of, the bribery committed. It is, however, a full defence to this corporate offence if the company can show that, despite a particular case of bribery, it nevertheless has 'adequate procedures' in place to prevent bribery. http://www.promanex.com/media/363262/anti-bribery_policy.pdf Ik vind het gebruik van "on behalf of" in deze zin met bijbehorende uitleg ietwat verwarrend. Introduces new corporate offence of failing to prevent bribery by associated persons: • “Associated persons” means potential vicarious liability for bribes committed by any business partners providing services wherever in the world (which could be employees, agents, suppliers, joint venture & consortia partners) • Corporate offence is strict liability – the bribe may have been paid without the knowledge, authorisation or involvement of anyone else in the organisation • Only defence is for organisations to have put “adequate procedures” in place, (including implementing employee/HR policies and other anti-bribery procedures in accordance with guidance published by the Ministry of Justice) • Guidance allows organisations to choose their own procedures based on six key principles: proportionality / top-level commitment / risk assessment / due diligence / communication & training / monitoring & review http://www.olswang.com/pdfs/bribery_comlit.pdf De Britse Bribery Act 2010 en de relevantie voor Nederlandse bedrijven http://www.loyensloeff.com/nl-NL/News/Publications/Flashes/P... |

economisch delict Explanation: Not entirely sure, but as far as I know this normally qualifies as an economisch delict, at least in the Netherlands. I don't have time to look further into this right now but I'm sure I'll be corrected if I'm wrong :-) -------------------------------------------------- Note added at 2 dagen6 uren (2015-06-24 17:59:59 GMT) -------------------------------------------------- Bij nader inzien zou ik als 'algemene vertaling' willen voorstellen: corporate offence >> delict / strafbaar feit (gepleegd) door een rechtspersoon. -------------------------------------------------- Note added at 3 days3 hrs (2015-06-25 14:43:27 GMT) -------------------------------------------------- Misschien in deze specifieke context: (...) geldt inmiddels/voortaan als een delict (of: strafbaar feit) dat toerekenbaar is aan de rechtspersoon in kwestie. |

Reference: some refs Reference information: FELOnline: economisch delict = economic offence Wet op de Economische Delicten <WED> = Economic Offences Act -------------------------------------------------- Note added at 1 hr (2015-06-22 13:29:14 GMT) -------------------------------------------------- This would seem to support Kitty's answer: see: "In the Netherlands, criminal liability of corporations was first introduced in the Economic Offences Act (Wet economische delicten), but in 1976 it was adopted as a general rule in the Penal Code." https://www.google.co.uk/url?sa=t&rct=j&q=&esrc=s&source=web... |
