English to Dutch translations [PRO] Bus/Financial - Human Resources / Corporate policy
English term or phrase:in whatever terms
Terms of business for sales All orders in whatever terms, are accepted subject to the following terms and conditions, which will apply unless varied in writing by an authorized agent of XXXX.
How do I translate "in whatever terms"? It seems a bit superfluous as the terms that are applicable follow in the terms of business....
Actually, there is no need for (1) below as it is contained in (2).
(1) all other terms and conditions (previous or otherwise) are excluded (2) any order whatsoever is accepted solely under the current terms & conditions (3) which will apply unless changed in writing by an authorised agent
The above can thus be reduced to:
(1) All orders are accepted solely under the current terms & conditions, (2) which will apply unless changed in writing by an authorised agent.
Interestingly enough, these terms & conditions from a German company do it this way:
"1 - GENERAL PRINCIPLES:
The current General Terms and Conditions of Sale (hereafter referred to as 'GTCS') shall prevail over any document from the Client, whatever other terms may be incluced in it: all orders placed with RISS imply unconditional acceptance of RISS's price and current GTCS." (http://colt-tools.com/en/content/imprint.html )
(http://colt-tools.com/de/content/imprint.html )
… which is pretty much our "ongeacht de gebruikte bewoordingen".
In any event, no matter how Willemina chooses to solve this in Dutch, I think the general idea is now clear.
Yes, the gist of this section is these types of contracts seems to be that, basically:
(1) all other terms and conditions (previous or otherwise) are excluded (2) any order whatsoever is accepted solely under the current terms & conditions (3) which will apply unless changed in writing by an authorised agent
It's unfortunate that the author chose to use the phrase "all orders in whatever terms", as this is ambiguous. However, it indeed does seem to mean "ieder opdracht, ongeacht de (eerdere) voorwaarden".
The author would have saved us all a lot of trouble if he/she had simply said:
"all orders, under whatever terms" (which is obviously a lot clearer).
- Overeenkomst: iedere overeenkomst die tussen Leverancier en Afnemer tot stand komt, elke wijziging of aanvulling daarop, alsmede alle (rechts)handelingen ter voorbereiding en ter uitvoering van die overeenkomst;

"ALGEMENE VOORWAARDEN 1. 1.2 Voor zover de Voorwaarden ook zijn opgemaakt in een andere taal dan de Nederlandse, is de Nederlandse tekst bij verschillen steeds beslissend." it help you to know that this may be derived from American English? I have found some other Americana in the text. It's a bit of a badly written mixed bag...
= "The defendant only has to unequivocally communicate to the court within the time limit and in the written or under certain conditions in the electronic form, in whatever terms, that he wants to object to the claim in full or in part."
Sounds to me like the author may mean "in whatever form", rather than that it refers to any terms/conditions. If it did refer to terms/conditions, I don't think they would have used the construction "in whatever terms", but rather something along the lines of "under whatever terms" or "on whatever terms".
see e.g.:
"(2)Any reference in any enactment or document (in whatever terms)—
(a)to charitable purposes, or (b)to institutions having purposes that are charitable under the law relating to charities in England and Wales,
"Iedere opdracht, in welke vorm dan ook …" (makes more sense and is found in standard T&Cs)
Explanation: or the literal translation: "iedere opdracht, ongeacht de gebruikte bewoordingen" (literal translation)
See also my various discussion entries above.
Example sentence(s):
