Powers of the President of the Appeals Arbitration Division.
The Brussels Court of Appeal appears to suggest that the authority granted to the President of the Appeals Arbitration Division (“President of the Division”) of the CAS under Articles S6.2, R20.b, R29, R49, R50, R53 and R54 of the CAS procedural code (CAS Code) is incompatible with arbitration.
On the contrary, it is very common in arbitration that *institutional officials* that are not a member of the panel take certain decisions relating to the arbitration proceedings. In ICC, the Chairman of the Court and Secretary-General of the ICC, who are not part of the arbitration panel, enjoy powers that are broader than those granted to the President of the Division. Before highlighting those powers, WADA would first like to clarify certain aspects of the powers of the President of the Division.
