I do like the below translation examples as both of them are transmitting the correct meaning of the text:

it sounds more like being part of some list of possible situations - a rather unusual way of couching legal documents, but why not?

In which part is this? In the "definitions" section? Or in one of the "main clauses"?

One Does Not Serve: In the event either X or Y fails to qualify as Co-Personal Representative or having qualified, fails to serve to the completion of my estate, then I appoint the other of them to serve as my sole Personal Representative, she to have all of the rights, powers and duties as otherwise granted to my Co- Personal Representatives.
