That of course is the concept Nicolas was talking about in his answer. But rather than "propriété," we need to specify real property (immobilier). Following Unidroit's lead above, "X shall remain personal property, irrespective of its use or manner of attachment to realty" can become "X demeurera un bien meuble, quelque soit son utilisation, et qu'il soit ou non fixé à un immeuble."

realty is something that belongs to someone, either a piece of land or a building. What the sentence says is that the equipment (whatever it is) cannot be attached permanently to any land or building. If it is attached, the "manner of attachment" has to be reversible.

neutral  Tony M: 'propriété' is perhaps not the most felicitous rendering of 'realty' — more likely a 'bien immobilier' (or possibly even something with 'foncier'). I would also expect something more like 'la manière de sa fixation' rather than 'type...'

disagree  Daryo: your first reference is irrelevant - the key point is whether this "Equipment" is physically attached or not / detachable or not [while definitely being "functionally attached" - part of the realty] - technical details are irrelevant.
