"As a security to cover the running costs of aircraft, the Owner provides a standing deposit of an amount of xxx EUR, divided into two similar portions in currency USD and EUR, to the Vendor onto an account to be designated by the Vendor. The Owner shall replenish the Deposit to the full lump sum mentioned above monthly upon receiving the invoice from the Vendor."

Aus einem Vertragstext. "Vendor" übernimmt Managementaufgaben und den Betrieb des Flugzeugs für "Owner".

- Ich verstehe es so, dass die Rechnungen jeweils mit dem zuvor eingezahlten Betrag beglichen werden; anschließend wird der Betrag wieder entsprechend aufgestockt, bzw. fehlende Beträge müssen nachgezahlt werden.

Eine Kaution im eigentlichen Sinne ist das doch nicht, oder?

Es handelt sich um eine Art der Absicherung der laufenden Betriebskosten in Form eines Guthabens oder einer Einlage auf ein [...] zu benennendes Konto.

Also nicht die Kaution, denn diese würde sich ja auf das Flugzeug selbst (oder irgendeinen anderen teuren Gegenstand) beziehen und nach Rückgabe wieder ausbezahlt werden.

Es handelt sich also lediglich um eine Risikominimierung für die laufenden Betriebskosten.

Ob jetzt Guthaben oder Einlage verwendet wird ist reine Geschmackssache.
