Secured loans can be established on a recourse or a non-recourse basis. This is an important distinction if the borrower defaults on their debt and the security seized does not meet the liability in full – i.e. there is a shortfall.

Recourse loans provide the bank with the legal right ***to pursue other assets*** owned by the borrower and/or seek legal redress for the borrower’s income to be used to settle the shortfall amount.

Non-recourse loans do not provide the bank with the legal right ***to pursue the borrower’s other assets***, and therefore they must write off the shortfall as it is not recoverable.
