Ich würde gefühlsmäßig vorschlagen, das mit "Risiken" zu umschreiben, äquivalent zum "Ausfallrisiko" (dessen Folge ggf. das "default event" ist). Auch im Englischen kommt "custody failure" oder "legal failure" nicht wirklich häufig vor.
