in exhaustion ofの意味がうまく理解できません。他の方法で救済できなかった場合に、損害賠償金（上限あり）の支払いが唯一の救済措置になるという意味なのでしょうか？それとも、他の救済方法は認められず、損害賠償金の支払いのみが唯一の救済措置という意味なのでしょうか？後者の意味で、それでも救済の本質的な目的は果たせますよ、という規定のようにも見えるのですが、全く自信がありません。どなたかご説明いただけないでしょうか？
