It is evident that XYZ was in charge of the main aspects of the Chilean case. He referred to the Chilean lawyers as his “local counsel.” They often referred to him as the “cabeza,” or head, of the team. From the time the case was filed in OOO until at least quite recently, and perhaps even until today, XYZ has supervised the Chilean legal team, set deadlines, was involved in setting the lawyers’ salaries, reviewed their court filings, directed the legal strategy, and coordinated the work between the lawyers in Chile and the scientists, experts, lawyers, litigation funders, politicians, and media consultants throughout the world.

Sometimes, when managing a case in a distant or foreign jurisdiction, client’s chosen counsel will engage a local lawyer to assist in making sure that the matter proceeds in accordance with local practice and rules. This is generally done with direct client involvement, permission and agreement.

Local Counsel can also mean a lawyer hired, on an ad hoc basis, to handle an appearance or hearing, to eliminate the need for the lead lawyer to travel, so-called “appearance counsel.”
