French term or phrase: caractère décennal
Complaint and summons about a badly repaired shower room in private flat.

"Au vu des conséquences des fuites de cette douche sur le plancher sur lequel celle-ci est installée, des risques d'atteinte à la solidité de ce plancher à l'intérieur du délai d’épreuve, et du risque pour la sécurité des occupants, le désordre en cause revêt un caractère décennal.

À titre subsidiaire néanmoins, les demandeurs envisageront, au niveau des responsabilités, l'hypothèse dans laquelle le Tribunal écarterait le caractère décennal du désordre."

I know about ten-year (or "decennial") liability for construction work. The question is how to put this.

My first thought is to put something like "the disorder in question is in the ten-year category of disorders" and ... "... may decline to accept that the disorder is in the ten-year category". But it really occurs to me that, for an English reader, with no familiarity with responsabilité décennale, it might be necessary to put "ten-year" in quotes. Or perhaps even bring up the whole expression:

- "the disorder in question is in the "ten-year liability" category of disorders"
- "... may decline to accept that the disorder is in the "ten-year liability" category".

I think this makes the situation clearer for EN readers, without explaining at unjustifiable length the whole legal context.

Anyone got a better suggestion?

Asker: Thanks. Yes, so I suppose you would put for the second phrase something like "if the Court holds that the disorder is not covered by the 10-year guarantee"?

agree  Eliza Hall: Yes. "Caractère décennal" = defects likely to cause damage within 10 years, thus covered by the guarantee. https://www.scp-avocat-metz.fr/2017/09/08/mise-jeu-de-garant...
