this sounds like a penalty clause - but to have a clear picture you need to know what kind of situation will activate this penalty clause - who would make what kind of error/fault in doing what exactly?
IOW who are the parties to this contract and what exactly are they supposed to be providing - and which one is the party suffering "pertes de chiffres d’affaires, de revenus de données, et / ou les manques à gagner" and which one is the one that could be the culprit?
Betting organisations, as far as I know, are not in the business of selling data in the sens of "selling you access to the Internet" (charging for transferring other people's data) but could be selling their own data about bets. One way or another, translating a contract, especially a penalty clause, just on assumptions is not the best idea ...
OTOH writeaway, Rachel Fell, or Gallagy will maybe take a quick look in the nearest general dictionary and find a reliable answer - exactly the right term to put in a penalty clause that could be later making the difference between losing or winning an eventual litigation ... |
