Writ of summons. Two accusations made: firstly dénonciation calomnieuse and secondly usage de fausse attestation. Usage de faux is "forgery", but that ain't this.

"Ces derniers sont recevables et bien fondés à agir en dénonciation calomnieuse et usage de fausse attestation sur le fondement des articles 226-10 et 441-7 du code pénal."

"Ces plaintes sont constitutives de l'infraction de dénonciation calomnieuse. Il sera également retenu l'infraction de l'usage de fausse attestation s'agissant de l'attestation de Madame AAA, auditrice, produite à l'appui de ces plaintes."

"Il est demandé au Tribunal d'entrer en voie en condamnation à l'encontre de Monsieur CCC, Monsieur DDD et la société EEE, pour sollicitation et usage d'une fausse attestation à Mme AAA, infraction prévue et réprimée par l'article 441-7 du Code Pénal."

NB the grammar of the previous sentence leaves something to be desired: I'm pretty sure the meaning is "... sollication d'une fausse attestation à Mme AAA, et son usage, infraction ...".

The text then quotes the relevant parts from the Code Pénal:

"« Indépendamment des cas prévus au présent chapitre, est puni d'un an d'emprisonnement et de 15 000 euros d'amende le fait :
1° D'établir une attestation ou un certificat faisant état de faits matériellement inexacts ;
2° De falsifier une attestation ou un certificat originairement sincère ;
3° De faire usage d'une attestation ou d'un certificat inexact ou falsifié.
Les peines sont portées à trois ans d'emprisonnement et à 45 000 euros d'amende lorsque l'infraction est commise soit en vue de porter préjudice au Trésor public ou au patrimoine d'autrui, soit en vue d'obtenir un titre de séjour ou le bénéfice d'une protection contre l'éloignement. »

L'article 121-2 du code pénal dispose :
Les personnes morales, à l'exclusion de l'Etat, sont responsables pénalement, selon les distinctions des articles 121-4 à 121-7, des infractions commises, pour leur compte, par leurs organes ou représentants.
Toutefois, les collectivités territoriales et leurs groupements ne sont responsables pénalement que des infractions commises dans l'exercice d'activités susceptibles de faire l'objet de conventions de délégation de service public.
La responsabilité pénale des personnes morales n]exclut pas celle des personnes physiques auteurs ou complices des mêmes faits, sous réserve des dispositions du quatrième alinéa de l'article 121-3.
Les peines criminelles ou correctionnelles encourues par les personnes morales sont prévues par les articles 131-37 à 131-39-2 du Code Pénal."

Asker: Thanks. As a matter of interest, what is in fact the difference between "testimony" and "declaration"? I find a definition of the former as "spoken or written statements that something is true, especially those given in a law court" (dictionary.cambridge.org)

If this translation happens to be for an American audience, "false swearing" is the term used here for "fausse attestation" (I was also a police officer for 25 years and charged many an offender with this crime)!
