Direct Patent Infringement Explanation: In point (4) you have "la revendication 9 dépendant de la revendication 1 ou 5 : à l'identique ou par la théorie des moyens équivalents, puisque les rebords du bidule de XXX ne sont pas non plus ancrés dans le profilé " - the "théorie des moyens équivalents" is the "Doctrine of Equivalents" (DOE) (see national paralegal reference for more details). So, here "à l'identique" appears to be refering to a direct infringement of the patent claims. -------------------------------------------------- Note added at 49 minutes (2014-07-16 10:35:14 GMT) -------------------------------------------------- Sorry the example should be: "It is clear that of xxx's module is a direct patent infringement as per/of the preamble of the present claim... "PATENT INFRINGEMENT CLAIMS A patent infringement claim is an assertion by the patent holder that an alleged infringer's product or process practices the patent holder's patented invention without authorization. Types of Infringement There are two types of infringement: Direct infringement.
