My question is: does the second occurrence of "que" refer back to "tandis que"?
This appears in a legal statement of facts and conclusions.

Tandis que les revendications semblent ne pas être conforme à l'article 3, car lesdites revendications à l'origine sont basées pour une composition qui est structurellement définie et non fonctionnellement car il n'y a aucune base dans la demande originelle ***que*** la composition doit contenir 50 mg de sel.

My try:
While the claims seem to be inconsistent with Article 3, because said original claims are based on a composition that is structurally defined, not functionally, because there is no basis in the original application, the composition must contain 50 mg of salt.

I'm french mother tongue and french proofreaderin.

First you have to write "conformes" instead of "conforme".
Then, to my mind, it's not good written. It's better so: "Il n'y a aucune base dans la demande originelle qui justifie que la composition contienne 50 mg de sel."
Or the must: "Il n'y a aucune base dans la demande originelle qui justifie une contenance de 50 mg de sel dans la composition".
