CIU (collective investment undertaking) Explanation: In EU law, OGAW = UCITS, but OGA = CIU. UCITS (Undertaking for Collective Investment in Transferable Securities) is an official designation for an authorised investment fund. The German equivalent is OGAW (Organismus für gemeinsame Anlagen in Wertpapieren). The key legislation here is the UCITS Directive, i.e. Directive 2009/65/EC http://eur-lex.europa.eu/legal-content/EN-DE/TXT/?uri=CELEX:... Other EU legislation, however, refers in a more general sense to collective investment undertakings / Organismen für gemeinsame Anlagen. This is the case, for instance, with the important new Markets in Financial Instruments Directive, known as MiFID II. Collective investment undertaking is a broader term - it is possible to have a collective investment undertaking that is not a UCITS, as indicated in e.g. Article 25(4)(a)(i) of MiFID II: http://eur-lex.europa.eu/legal-content/EN-DE/TXT/?qid=150921... So if the German refers to OGA, the precise English term is CIU - collective invesment undertaking. Although you can see why so many people use UCI instead - it's the same words in a different order. The article you cited uses the abbreviation UCIS. This term is used by the British authorities. It stands for unregulated collective investment scheme, and is therefore definitely not a translation of OGA. https://www.fca.org.uk/consumers/unregulated-collective-inve... |
