Ho indicato “that is able to raise” come traduzione per l’espressione in oggetto, ma non lo suggerirei per la frase in questione qui. Ci spiego.

Prima di tutto, intendo “in grado di elevare” qui come riferito non a “singolo contraente” ma a “comportamento”.

Guardando un po’ le note che si trovano a https://www.brocardi.it/codice-civile/libro-quarto/titolo-ii... è chiaro che lo scopo qui è di imporre a entrambe le parti un obbligo di andare aldilà del semplice minimo contrattuale e cercare — in modo più o meno attivo — il bene dell’altra parte.

Posto questo, direi che la frase intera potrebbe essere tradotta pressappoco nel seguente modo:

Non penso che “elevare” qui vada tradotto in modo letterale. In inglese i “duties” non vengono mai “raised” o “elevated”, e i concetti di su e giù risulterebbero strani. Forse “emphasized”, “promoted” oppure “strengthened”.

Poi, penso che “realizzare gli interessi” non andrebbe tradotto come “fulfill the interests”, perché nell’inglese americano o britannico gli “interests” non vengono “fulfilled” ma piuttosto “protected” o, a volte, “advanced”. Per esempio, ricerche sul sito del SEC tramite Google danno i seguenti risultati:

Poi, tradurre “cooperare” è un po’ un casino perché di solito il verbo “to cooperate” richiede qualcosa in più, ad es. “cooperate with the other partner”, “cooperate in carrying out ___”. Dunque, ho scritto “provide cooperation”.

E quanto a “posizioni”, non capisco cosa esattamente si intende. Se “posizioni giuridiche”, allora forse “legal claims”, ma se “posizioni economiche” allora “financial status”.

Insomma, penso che l’approccio migliore sia di capire prima l’intera frase e tradurla in modo naturale. Fatto questo, risulta che in questo contesto “that is able to transform into” è più naturale di “that is able to raise”.
