This phrase appears in a Spanish legal document, but I assume it is Latin. The whole document is written in that wonderful other language called "unintelligible legalsese"...

The context is a dispute over property, possession, and boundaries. Party B has de facto possession of land that belongs to Party A. When Party A tried to put a fence around its land, Party B complained because it alleges possession.

The two occurrences of the phrase (for those who understand Spanish) are:

En segundo lugar, y en todo caso, lo cierto es que no pueden olvidarse los requisitos subjetivos de la acción interdictal y, en particular, el denominado “animus spoliendi”.

...en los supuestos de consentimiento del poseedor, de posesión meramente tolerada y, finalmente, la falta de alguno de los elementos integrantes del despojo, ya sea el objetivo, el subjetivo (“animus spoliendi”) o el nexo causal.

This last occurrence comes at the end of a sentence which is 350 words long. I am having huge problems decoding it, so for the moment i'm afraid I can't provide much more context.

The "acción de despojo" is an action that a person violently dispossed of personal property can bring to recover it. "de despojo" is the Spanish translation of "spoliendi", and in English can be translated into "(intent) to dispossess, to strip, to despoil"
