Zwar habe ich eine passende Definition für diese Bedeutungsschattierung des Wortes gefunden ((jur.) a se admite de către instanță existența unei stări de fapt pe baza probelor.), doch fällt es mir nach wie vor schwer eine geeignete und einheitliche Übersetzung für diesen Kontext zu finden:

"Mai retine instanta de fond ca „ nu se poate retine culpa organelor vamale in derularea indelungata pe parcursul mai multor ani 2004-2007 a contractelor de leasing incheiate cu firma germana, pe de o parte deoarece reclamanta a completat declaratie vamala in conf.cu art.3 lit.s, din Lg.141/1997 rap. la art.4 pct.21 din Lg. 86/2006, iar pe de alta parte nu pot fi retinute apararile reclamantei in sensul că a cerut opinia organului vamal in acest sens, răspunsul fiind favorabil intrucat opinia organului vamal concretizata intr-o corespondenta, nu reprezintă act administrativ cu efecte juridice, iar reclamanta a completat declaratie vamala pe proprie răspundere"."

Achtung: Im Kontext "Nu pot fi reţinute apărările reclamantei" würde ich nicht mit "können nicht zur Kenntnis genommen werden" übersetzen. Die Richter nehmen alles zur Kenntnis was vor ihnen behauptet wird (es sei denn, sie schlummern, während der Verhandlung). Dass sie aber bestimmte Dinge "nicht festhalten/nicht protokollieren/nicht berücksichtigen" ist etwas anderes. Also würde ich die Verneinung "nu pot fi reţinute" eher mit "können nicht berücksichtigt werden" übersetzen. Gruß, Chr.
