Le vendeur déclare vendre le bien libre de toute contrainte ou hypothèque et déclare que ses droits sont légalement inscrits.

Par contre si le bien est hypothéqué le vendeur déclarera quel est le montant de l'hypothèque et s'il s'agit d'un prêt, il devra annexer un document émanant de la banque qui précisera que, moyennant paiement d'une somme que la banque déterminera dans sa lettre, le bien sera libéré de l'hypothèque.

Asker: мне кажется, в таком случае не было бы написано "в залоге У продавца". эта фраза относится к предыдущей, то есть к тому, что условие не является обременением

Asker: извините, но данный порядок слов в русской фразе не означает, что продавец мог отдать квартиру под залог, а скорее, что квартира будет удерживаться продавцом в качестве залога до выполнения определённых условий.
