In the state level “primera instancia” refers to being tried for the first time “trial court.” “Segunda instancia” = Appellate Court/Court of Appeals and in Civil and Traffic Court it’s called a “Trial de Novo” (meaning to retry or have an entire new trial.) In some US states Traffic Court still belongs to the Criminal Division.

Although “first instance,” is correct, I’ve seen it before. From
Mexican Law to American Law, “primera instancia” translates into “Trial Court.”

  -> Because it sounds more like a false cognate even though it might not be. However in English law “trial court” is the more appropriate choice. This is why I disagree.

disagree  Robert Carter: So many things wrong with your translation, regardless of what the "órgano" actually is. To start with, "remítase" doesn't mean "refer to", it means "send to"; "anotaciones" are not "attestations", etc.
