I am doing an ES (MX) - EN (US) translation of an Ad Cautelam response giving point by point replies to a claim related to the lapse of a registered trademark. I need help in rendering "no ser propio de"

1. El hecho correlative es cierto.
2. El hecho que se contesta es falso.....
3. El hecho que se contesta ni se afirma ni se niega por no ser propio de mi representada

My attempt

3. The coincident fact being answered is neither affirmed nor denied as it does not relate to/affect/concern (?) my client.

I do not have access to the claim to see the actual point being answered. In this situation, would appreciate any advice or a neutral term.
