Su sociedad participó en una licitación pública para la elaboración de expedientes para el Programa de Mejoramiento de la Ilustre Municipalidad de YYYYYY. Los trabajos consistían en realizar estudios, recabar información y efectuar diseños de urbanización, mientras que las futuras obras de construcción, no podían ser realizadas por los autores de los estudios, pues estaba prohibido en los reglamentos de las instituciones fiscales, por lo que no integrarían un todo afecto a impuestos junto con la construcción.

Para participar en la licitación, se les exigió por parte del municipio que incluyeran en la oferta el monto de los impuestos que se recargarían. A pesar que estimaba que los servicios prestados no se encontraban gravados con IVA, de todas formas para no quedarse fuera de las bases y perder la licitación, supusieron un porcentaje similar al IVA, que fue recargado, pero conceptualmente se refirió al impuesto profesional por asesorías, lo que además quedó consignado en los contratos.
