Economic code Explanation: При прийнятті кодексу, слово "комерційний" прибрали, що є цілком логічним з огляду на наступне. Нинішній ГК України можна було б сміливо назвати Комерційним кодексом України (комерційні кодекси існують зокрема у Франції, Німеччині, Люксембурзі, Сирії, Марокко, Тунісі та в Макао), якщо він складався б лише з норм приватно-правового характеру. Проте ГК України регулюються і відносини адміністративного права, зокрема щодо політики конкуренції. Саме через це ГК України назвати комерційним не можна. Поняття Economic Law включає до себе зокрема і поняття Commercial Law, тобто Економічне право є ширшим за поняття Комерційного права. Отже використовувати поняття Commercial Code відносно ГК України є некоректним, оскільки в нас не Комерційний кодекс, як в деяких перелічених вище державах, а саме Господарський кодекс, який включає до себе як рівні двосторонні відносини двох рівноправних субєктів права (комерційні відносини), так і нагляд з боку держави за виконанням законодавства, зокрема в сфері економічної конкуренції (адміністративні відносини). I do not agree with “economic code” as a translation. Unlike what my colleague suggests in her answer, “Commercial” doesn’t only mean that it regulates relationships between two commercial entities. It also governs everything that relates to production of economic wealth, exchange of goods and services between entities, governments and countries, and guidelines and limitations for regulatory authority of different govern entities. |

Commercial courts are the courts of first instance when a legal entity or state institutions are involved.
