En conclusión, una cosa es ser gemelo accidentalmente y otra es serlo como consecuencia de la decisión de alguien. La pérdida de autonomía en toda clase de clonación es doble: por un lado, se conculca el derecho del producido a ser procreado a través del acto sexual humano, única forma adecuada a la dignidad del hombre y a tener un padre y una madre; por otra, se conculca la independencia biológica tanto en el generante como en el generado. Para el primero se atropella el derecho a no ser copiado, para el otro el derecho a la originalidad, a no convertirse en un ser copiado; en ambos casos la dignidad del hombre es usurpada por el libre arbitrio del investigador o por una actitud narcisista que no respeta los límites de autodisposición del propio cuerpo. Hay, pues, que defender con fuerza la ilicitud de la clonación humana e impedirla pues supone la avanzadilla de otras investigaciones que rompen la barrera de la identidad biológica, sobre la que se basa la diferencia de los humanos y su misma personalidad. Pero al mismo tiempo sin no queremos engañarnos hay que reconocer que esto no será fácil llevarlo a cabo sin limitar la extensión de las TRA que con su lógica actual nos empuja a aceptarla como una TRA más entre ellas. | Translation - English
In conclusion, it is one thing to be an accidental twin, and quite another to be one as a result of somebody else’s decision. The loss of autonomy in all types of cloning is two-fold: on the one hand it is a violation of the right of the offspring to be created through the human sexual act, the only one that is appropriate to human dignity, and of the right to a father and a mother; on the other hand, it also violates the biological independence of both parent and offspring. For the former, the right not to be copied is trampled on, and for the latter, the right to originality, to avoid becoming a mere copy of another; in both cases man’s dignity is arbitrarily usurped by the scientist or by a narcissistic whim which shows no respect for the limits of physical self-regulation. And so we must strongly reject the legitimacy of human cloning and prevent it, since it would act as a forerunner for other areas of research which overstep the mark in biological identity, upon which the differences between individuals and their personality itself are based. At the same time we must be realistic enough to recognize that this will not be an easy task and will involve limiting the extent of ARTs which, with their natural logic, are pushing forward the acceptance of cloning as just another reproductive technique.
