Giriş müsaadesi için yapılan görüşme sırasında, göçmen olmayan vizeyi almaya uygun olduğunu vize konsolosuna kanıtlayana dek, her yabancı göçmen kabul edilir.
Bu turist veya öğrenci vizesine hak kazanabilmek için, başvuru sahibinin INA’in, sırayla 101(a)15(B) veya (F) maddelerindeki şartlara uygun olması gerekir. Uygun bulunmadığı takdirde, INA’in 214(b) maddesi gereğince, vize başvurusu redle sonuçlanır.
Translation - English “What is article 214(b)?”
Article 214 (b) is a section of the Immigration and Nationality Act – INA of the United States of America.
During the interview for entrance permission, until the nonimmigrant proves that he/she is eligible to receive the visa to the visa consul, every foreigner is considered an immigrant.
To be eligible for a tourist or student visa, the applicant must meet the conditions stated in the 101(a), (15)(B) or (F) articles of INA respectively. If these conditions are not met, the visa application is rejected in accordance with article 214(b) of INA. The most common reason for this kind of a rejection is the obligation for a candidate tourist (visitor) or student to have a permanent residence outside of US that he/she will not want to leave. The applicants prove the existence of this type of a residence by showing that they have ties outside of the US that will require them to leave the US after their short-term stay. The law makes the applicant liable to prove this.
