ASUNTO: Acuerdo de Pesca UE-Marruecos: Dictamen del Servicio Jurídico del Consejo de la UE, de fecha 7 de noviembre de 2018, relativo al proyecto de Acuerdo de Pesca modificado y proyecto de nuevo Protocolo de Pesca con Marruecos, sobre la presunta compatibilidad con la jurisprudencia del Tribunal de Justicia de la Unión Europea (TJUE) y subsiguiente Decisión del Consejo Europeo.

En su propio nombre y derecho, conforme a lo dispuesto en el artículo 258 del Tratado de Funcionamiento de la Unión Europea (TFUE), y en base a los hechos y argumentos que se exponen a continuación, formula la siguiente,
DENUNCIA ANTE LA COMISIÓN DE LA UE
PRIMERO. – Petición de que se inicie procedimiento de infracción contra España por incumplimiento de la jurisprudencia del Tribunal de Justicia de la Unión Europea (TJUE) en lo relativo al Acuerdo de Pesca UE-Marruecos, en virtud de lo dispuesto en el artículo 258 del Tratado de Funcionamiento de la Unión Europea (TFUE).
SEGUNDO. – Que, si la Comisión constata la infracción aquí denunciada, demande a España ante el TJUE por el incumplimiento de su jurisprudencia sobre el Acuerdo de Pesca UE-Marruecos por parte de España.
TERCERO. - Que se dé traslado de la presente Petición y eventual denuncia al Parlamento Europeo para conocimiento y efectos oportunos, en su caso.
HECHOS
En varios fallos consecutivos desde diciembre de 2015 [ ], el Tribunal de Justicia de la Unión Europea (TJUE) ha concluido inequívocamente que los acuerdos bilaterales UE-Marruecos, incluido el Acuerdo de Pesca, no pueden aplicarse al Sáhara Occidental, en coherencia con el Dictamen (Opinión consultiva) del Tribunal Internacional de Justicia de La Haya de 16 de octubre de 1975, las resoluciones pertinentes de la Asamblea General y el Consejo de Seguridad de la ONU, y la Organización para la Unidad Africana (OUA) / Unión Africana (UA). [ ]
Como consecuencia de la sentencia del TJUE de 27 de febrero de 2018, en el asunto C-266/16 (Western Sahara Campaign UK) [ ], el 8 de octubre de 2018 la Comisión presentó propuestas al Consejo para decisiones sobre la firma y la celebración de un nuevo Acuerdo de Pesca, incluido un Canje de Notas y un nuevo Protocolo con Marruecos (en adelante, respectivamente, proyecto de Acuerdo, proyecto de Canje de Notas y proyecto de Protocolo). Estas propuestas fueron acompañadas por un documento de trabajo del personal de la Comisión (Staff Working Document, SWD) que contenía un informe en el que se evaluaban los presuntos beneficios potenciales para la población del Sáhara Occidental, así como la consulta a esa población, según el texto de dicho documento. [ ]
Durante la presentación y discusión de estas propuestas en los correspondientes Grupos de Trabajo sobre Pesca, en octubre de 2018, las delegaciones de varios EE MM (al menos, Alemania, Irlanda, Dinamarca y Suecia) pidieron al Servicio Jurídico que evaluara por escrito si estas propuestas eran conformes con la jurisprudencia del Tribunal de Justicia. En respuesta a esa solicitud, el 7 de noviembre de 2018 el Servicio Jurídico aportó el correspondiente dictamen (opinión jurídica). [ ]
En el Acuerdo de Pesca UE-Marruecos, cuyo Protocolo expiraba el 14 de julio de 2018, el Consejo, la Comisión y el Gobierno de Marruecos habían establecido que dicho Acuerdo y Protocolo se aplicaban también a las aguas adyacentes al Sáhara Occidental. Sin embargo, en su sentencia de 27 de febrero de 2018, en el asunto C-266/16 (Western Sahara Campaign UK), el Tribunal de Justicia dictaminó que el Acuerdo y el Protocolo NO incluían esas aguas.
En particular, siguiendo lo establecido en su Sentencia de 21 de diciembre de 2016, en el asunto C-104/16P (Consejo vs Frente Polisario), el TJUE concluyó que el territorio del Sáhara Occidental no está incluido en el concepto de "territorio de Marruecos". Así mismo, el Tribunal determinó que las aguas sobre las cuales un Estado ribereño tiene derecho a ejercer soberanía o jurisdicción se limitan exclusivamente a las aguas adyacentes a su territorio y que forman parte de su mar territorial o de su zona económica exclusiva; y que, en consecuencia, no se puede considerar que las aguas adyacentes al territorio del Sáhara Occidental formen parte de la zona de pesca marroquí mencionada en el Acuerdo. Y finalmente, el TJUE concluyó que cualquier notificación de coordenadas geográficas por parte de Marruecos a la UE no puede, de ninguna manera, ampliar el alcance de esos actos para incluir dichas aguas.
Tras esa sentencia, el 16 de abril de 2018 el Consejo adoptó una decisión, junto con las directrices de negociación asociadas, autorizando a la Comisión a entablar negociaciones con Marruecos para modificar el Acuerdo de Pesca y concluir un nuevo Protocolo al respecto.
La modificación del Acuerdo de Pesca se consideró necesaria, en particular, para ampliar el alcance del mismo (y de un nuevo Protocolo) al objeto de incluir las aguas adyacentes al Sáhara Occidental. Y la decisión que autorizaba la apertura de negociaciones y las directrices de negociación asociadas reemplazaron a una decisión y unas directrices de negociación asociadas anteriores, “precisamente para tener en cuenta la sentencia de 27 de febrero de 2018”, según el Servicio Jurídico.
En este punto, conviene traer de nuevo a colación la sentencia del Tribunal de Justicia de la UE de 21 de diciembre de 2016, en el asunto C-104/16 P (Consejo vs Frente Polisario). En esa sentencia, el TJUE dictaminó que el Acuerdo de Asociación no se aplica al territorio del Sáhara Occidental; que el principio de autodeterminación, así como la regla según la cual un tratado es vinculante para cada parte con respecto a todo su territorio a menos que aparezca una intención diferente del tratado o se establezca de otra manera, y el principio del efecto relativo de los tratados impiden que una interpretación de un acuerdo de la UE con Marruecos incluya al Sáhara Occidental cuando el acuerdo no mencione explícitamente que ese territorio está incluido.
En particular, y en primer lugar, el TJUE estableció en dicha sentencia que el principio de autodeterminación implica un estatus distinto y separado de los territorios no autónomos (párrs. 89-93). En segundo lugar, estableció que, si se supone que un acuerdo se aplica más allá del "espacio geográfico sobre el cual el Estado ejerce la plenitud de los poderes otorgados a las entidades soberanas por el derecho internacional", ese acuerdo debe preverlo expresamente, lo que no era el caso en el acuerdo en cuestión (párrs. 94 a 99). Y, en tercer lugar, el TJUE declaró que "el pueblo del Sáhara Occidental debe ser considerado como un ‘tercero’ en el sentido del principio del efecto relativo de los tratados", con la consecuencia de que la implementación de un acuerdo, en caso de que el territorio del Sáhara Occidental entre en el ámbito de ese acuerdo, "debe recibir el consentimiento de dicho tercero" (párrs. 100-108).
Teniendo presente esa jurisprudencia del TJUE se examinan a continuación, tres cuestiones principales objeto de consideración por el Servicio Jurídico: 1) la inclusión de las aguas adyacentes al Sáhara Occidental; 2) la consulta al pueblo del Sáhara Occidental y el consentimiento del mismo; y 3) las reivindicaciones marroquíes de soberanía sobre el territorio del Sáhara Occidental.
I. Consideraciones respecto a la inclusión de las aguas adyacentes al Sáhara Occidental
Según reconoce el propio Servicio Jurídico, “está claro que el nuevo proyecto de Acuerdo y Protocolo se aplicaría a las aguas adyacentes al Sáhara Occidental, como exigían las correspondientes directrices de negociación”: El artículo 2 del proyecto de Acuerdo afirma que éste "establece un marco para la [...] gobernanza de las actividades pesqueras realizadas por los buques pesqueros de la Unión, estableciendo en particular: a) las condiciones en que los buques de la Unión pueden participar en actividades de pesca en la zona de pesca".
Y dicha ‘zona de pesca’ se define en el artículo 1 (h) del proyecto de Acuerdo de esta manera: "las aguas del Océano Atlántico Central Oriental entre los paralelos 35º 47 '18" norte y 20º 46' 13" norte, incluidas las aguas adyacentes del Sáhara Occidental, que abarca todas las áreas de gestión.” Y añade: “Esta definición no afectará a ninguna negociación sobre la delimitación de las áreas marinas de los Estados costeros que bordean la zona de pesca, o los derechos de terceros países en general".
Después, todas las referencias del proyecto de Acuerdo se remiten ya a dicha ‘zona de pesca’:
Así, el artículo 4 dice: "Las autoridades de Marruecos se comprometen a autorizar a los buques de la Unión a realizar actividades de pesca en la zona de pesca de conformidad con el presente Acuerdo".
El Artículo 6 (1) exige que los buques de la UE "cumplan con las leyes y reglamentos marroquíes que rigen las actividades en la zona [de pesca], a menos que se disponga lo contrario"; y el artículo 6 (2) exige que los buques de la UE "deben cooperar con las autoridades de Marruecos, responsable del seguimiento, control y vigilancia".
Esa injerencia en las aguas adyacentes al Sáhara Occidental -un territorio no autónomo invadido y ocupado militarmente- se pretende justificar ‘legalmente’ mediante las pertinentes declaraciones verbales ad hoc en el proyecto de Canje de Notas (párr. 2), que forma parte integrante del Acuerdo:
"El Acuerdo de Pesca se celebra sin perjuicio de las posiciones respectivas de las Partes:
- para la Unión Europea, las referencias en el Acuerdo de Pesca a las leyes y reglamentos marroquíes se entenderán sin perjuicio de su posición con respecto al estado del territorio no autónomo del Sáhara Occidental, cuyas aguas adyacentes forman parte de la zona de pesca definida en el artículo 1 (h) del Acuerdo de Pesca, y de su derecho a la libre determinación;
- para el Reino de Marruecos, la región del Sahara es una parte integral del territorio nacional sobre el que ejerce la soberanía plena [¡!] de la misma manera que para el resto del territorio nacional. Marruecos considera que cualquier solución a esta disputa regional debe basarse en su iniciativa de autonomía". [¡! añadido] [ ]
Se constata así, una vez más, que la posición del Reino de Marruecos contraviene frontalmente la legalidad internacional, [ ] sin que ello represente, al parecer, problema alguno para la UE.
El artículo 2 del proyecto de Protocolo se refiere a la misma zona de pesca definida en el proyecto de Acuerdo:
"El propósito de este Protocolo es implementar las disposiciones del Acuerdo de Pesca, estableciendo en particular las condiciones para el acceso de los buques de la Unión a la zona de pesca definida en el Artículo 1 (h) del mismo (…).”
Y el propio Servicio Jurídico lo deja bien claro:
“Dado que el proyecto de Acuerdo define la zona de pesca como un área geográfica que incluye claramente las aguas adyacentes al Sáhara Occidental y agrega explícitamente que estas últimas aguas están incluidas en el mismo, el Servicio Jurídico no ve ninguna posibilidad de interpretar el alcance del proyecto de Acuerdo como no incluyendo esas aguas.” [Algo meridianamente obvio].
Y puesto que el Servicio Jurídico entiende que la evaluación que se le solicita es si estas aguas están incluidas de manera compatible con la jurisprudencia del TJUE y lo que considera que exigen la jurisprudencia y el derecho internacional para extender un acuerdo con Marruecos al territorio del Sáhara Occidental, manifiesta que:
“las sentencias del Tribunal [de Justicia de la UE] no especifican cómo se debe obtener el consentimiento del pueblo del Sáhara Occidental. No obstante, sobre la base de la doctrina jurídica internacional y la opinión del Abogado General en el asunto C-104/16 P, se puede concluir que dicho consentimiento no puede ser asumido sin previa consulta al pueblo del Sáhara Occidental o a sus representantes”. [ ] [Énfasis añadido]. Y el Servicio Jurídico añade que “los requisitos para un nuevo Acuerdo y Protocolo de Pesca con Marruecos para cubrir las aguas adyacentes al Sáhara Occidental son los mismos.”
Pese a lo manifestado en el párrafo anterior, el Servicio Jurídico hace a continuación un intento heroico para lograr algo así como la cuadratura del círculo, cuando ‘explica’ cómo ha ‘resuelto’ [eludido] la exigencia legal de la consulta al pueblo saharaui o a su representante legítimo y la obtención de su consentimiento:
II. Consideraciones respecto a la consulta y el consentimiento del pueblo del Sáhara Occidental. [ ]
En su dictamen, el Servicio jurídico expone que la principal condición esencial requerida es la consulta ‘adecuada’ al pueblo del Sáhara Occidental como medio para ‘determinar’ el consentimiento de este pueblo. Pero como el propio Servicio Jurídico señalaba en un párrafo anterior, “sobre la base de la doctrina jurídica internacional y la opinión del Abogado General en el asunto C-104/16 P, se puede concluir que dicho consentimiento no puede ser asumido sin previa consulta al pueblo del Sáhara Occidental o a sus representantes”. [Énfasis añadido].
Lo que no dice el Servicio Jurídico en su reiterativa y contradictoria argumentación es que el medio para determinar el consentimiento del pueblo saharaui no es otro que la obtención de dicho consentimiento por parte del representante legítimo del pueblo saharaui [ ], el Frente POLISARIO [ ], puesto que hasta ahora no se ha permitido al pueblo del Sáhara Occidental celebrar el referéndum de autodeterminación, como han establecido múltiples resoluciones de la ONU, la CEE/UE y la OUA/UA. [ ] Ni la UE ni las autoridades del Reino de Marruecos tienen competencia para eludir, con eufemismos y argumentos falaces, ese requisito del Derecho Internacional.
Adicionalmente, y al margen (¡!) del incumplimiento de ese importante requisito del Derecho Internacional, conviene poner de manifiesto la utilización de una terminología engañosa o eufemística en el razonamiento del Servicio Jurídico, aquí y en las líneas que siguen: Es obvio que haciendo la consulta ‘adecuada’, a unos consultados específicos (que no al pueblo del Sáhara Occidental), se obtendrá la respuesta deseada, conforme a la finalidad perseguida por el consultante, una deficiencia, o simplemente manipulación, que tanto se achaca a las encuestas de opinión (que nada tienen que ver con la obtención del consentimiento).
Y, asimismo, hay que subrayar que no se trata de ‘determinar’ el consentimiento de ese pueblo, sino de obtenerlo. Y el propio Servicio Jurídico deja bien claro que el Frente POLISARIO, su representante legítimo, no dio su consentimiento.
Dicho esto, está de sobra toda la argumentación con la que el Servicio Jurídico pretende justificar el acceso y la utilización no consentida de las aguas adyacentes al Sáhara Occidental: que se tomaron “todas las medidas razonables y viables” (al margen de la legalidad internacional y conforme a la voluntad de la potencia ocupante y de la Comisión / SEAE) “en el contexto actual” (la ilegal ocupación manu militari de gran parte del territorio no autónomo del Sáhara Occidental).
Al respecto, el memorando explicativo de la decisión propuesta al Consejo para firmar el proyecto de Acuerdo explica que:
“[...] la Comisión y el Servicio Europeo de Acción Exterior (SEAE) organizaron consultas con las poblaciones relevantes en el Sáhara Occidental para garantizar que pudieran expresar sus puntos de vista sobre la extensión de la colaboración a las aguas adyacentes al Sáhara Occidental y que se beneficiaran de los impactos socioeconómicos del Acuerdo de Pesca de manera proporcionada; [...]. El informe concluye que los impactos socioeconómicos del Acuerdo de Pesca beneficiarán en gran medida a las poblaciones afectadas y que tendrá un impacto positivo en el desarrollo sostenible de los recursos naturales. Del mismo modo, los actores socioeconómicos y políticos que participaron en las consultas estaban claramente a favor de concluir el Acuerdo de Pesca, a pesar de que el Frente Polisario y algunas otras partes se negaron a participar en el proceso de consulta, por principio. Por lo tanto, se puede concluir que la Comisión, junto con el SEAE, tomó todas las medidas razonables y viables en el contexto actual para involucrar adecuadamente a las poblaciones afectadas". [Énfasis añadido]. [ ]
El ‘contexto actual’, al que se refiere el Servicio Jurídico, es el del colonialismo o la recolonización, la pretendida anexión y la violación sistemática e impune de la legalidad internacional. ¿Por qué se quiere mantener a toda costa el ilegal statu quo, como si no hubiera otras posibilidades? ¿Acaso no modificó el propio TJUE el ‘contexto actual’ del anterior Acuerdo de Pesca, estableciendo claramente que no se aplicaba y que no podía aplicarse a las aguas adyacentes del Sáhara Occidental? ¿No es esa, acaso, la razón por la que la UE ha tenido que acudir a un nuevo Acuerdo, Protocolo y Canje de Notas, que modifican ‘el contexto actual’? No hay por qué mantener un ‘contexto actual’ desfasado, obsoleto, injusto e ilegal que, en último término puede conducir a reanudar la guerra en el territorio. [ ]
¿Por qué se empeña la UE en mantener ‘el contexto actual’? ¿No se modificó ese contexto cuando la mayor parte de los Estados miembros reconocieron a la República de Kosovo o cuando -modificando ‘el contexto actual’- se reconoció como presidente interino o encargado a la persona de un Estado tercero? ¿No suponen esos reconocimientos una modificación del ‘contexto actual’? ¿Acaso no tiene capacidad o autonomía la UE y/o sus EE MM para hacerlo? ¿O es que en Bruselas también manda Marruecos? [ ] ¿Es así, con este ejemplo, como se pretende frenar la anexión ilegal de Cisjordania? ¿No ha significado también el Brexit una modificación del ‘contexto actual’? Y no precisamente de corto alcance o de consecuencias irrelevantes. ¿Acaso la entrada de España (y de otros países) en le CEE/UE o la transición de España desde la dictadura a la democracia no significó también una modificación del ‘contexto actual’? Las leyes, los decretos, las Decisiones del Consejo de la UE, ¿no modifican en muchos casos ‘el contexto actual’?
¿Es que los Estados civilizados de la UE no pueden explorar otros contextos más acordes con los tiempos en que caen de su pedestal las estatuas de negreros, esclavistas y colonialistas? ¿Tan ciegos y sordos están? ¿Qué más datos y hechos hay que aportar para que vean, oigan y escuchen el clamor de los habitantes de la última colonia de África y de las gentes de todo el Mundo que apoyan esa causa justa y legítima? ¿Es necesario poner encima de la mesa más muertos, más tropelías, más argucias, más eufemismos, más injusticias? ¿Cuántos más, cuáles más? [ ]
Al final, lo que se pone de manifiesto es que lo que ha interesado a la UE ha sido mantener inamovible ‘el contexto actual’ y conseguir a toda costa su objetivo: acceder como fuere a las aguas de un territorio no autónomo pendiente de descolonización en las condiciones previamente acordadas con un socio estratégico que incumple impunemente la legalidad internacional, se ríe del respeto a los derechos humanos (¡cláusula base de todos los acuerdos de la UE!) y no tiene soberanía sobre tales aguas. Y para ese fin, el Servicio Jurídico aduce que se han guardado las formas, acomodándose al literal de las sentencias del TJUE.
No parece, sin embargo, que esa afirmación del Servicio Jurídico coincida, al menos, con el espíritu de la jurisprudencia del TUJE, pues el ‘nuevo’ Acuerdo no hace sino reproducir ‘el contexto’ del anterior, el statu quo ventajoso para Marruecos y para los intereses mercantiles de la UE; el mismo perro con otro collar Y para eso, estarían de sobra las sentencias dictadas por el Alto Tribunal de la UE.
En contra de lo que afirma el Servicio Jurídico, había y hay varias posibilidades “razonables y viables” de superar o modificar ‘el contexto actual’, es decir, el ilegal statu quo impuesto por la fuerza de las armas. Pero el Servicio Jurídico no se ha tomado la molestia de estudiarlas ni de proponerlas (seguramente, no eran esas las instrucciones recibidas).
Por ejemplo, y entre otras posibles alternativas a explorar: en lugar de ningunear al TJUE -la suprema autoridad judicial de la UE-, pedir a éste su dictamen sobre la manera de ‘determinar’ el consentimiento del pueblo del Sáhara Occidental -algo que ya quedó establecido en múltiples resoluciones de la ONU- y/o sobre la pretendida compatibilidad del nuevo Acuerdo con la jurisprudencia del TJUE; establecer relaciones diplomáticas con el legítimo representante del pueblo saharaui, el Frente POLISARIO (FP) y pedirle entonces su consentimiento; o establecer con el FP algún tipo de acuerdo relacionado o compatible con un determinado (diferente) Acuerdo de Pesca UE-Marruecos; reconocer a la República Árabe Saharaui Democrática (RASD) -como han hecho más de ochenta países- y llegar a un acuerdo con sus autoridades.
Al respecto, el entonces presidente de Sudáfrica (2004), Thabo Mbeki -con muchas menos competencias y medios que la UE-, tuvo el coraje y la coherencia moral y política de dirigir al rey de Marruecos, Mohamed VI, una carta explicándole las razones por las que consideró obligado que la República de Sudáfrica reconociera a la República Árabe Saharaui Democrática (RASD) -como deseaba el anterior presidente de Sudáfrica, Nelson Mandela-, en vista de los obstáculos que el monarca alauita ponía a la legítima autodeterminación del pueblo saharaui. He aquí algunos extractos de la carta, que merece ser leída en su totalidad:

El Gobierno de Marruecos (…) inequívocamente pretende denegar al pueblo del Sáhara Occidental su derecho a la autodeterminación, en contra de lo establecido tanto en la legalidad internacional fundamental e inviolable como en los anteriores compromisos solemnes suscritos por el Gobierno de Marruecos.
Marruecos no acepta el Plan de Arreglo con el que había estado de acuerdo durante muchos años, y tampoco acepta ahora elementos esenciales del Plan de Paz.
Esto constituye un intento evidente de negar el propio derecho de autodeterminación, al que la ONU misma está obligada por su Carta a defender y propugnar, y cuyo ejercicio por el pueblo del Sáhara Occidental lleva intentando durante casi dos décadas.
Seguimos lamentando, el hecho de que, debido a la no resuelta cuestión del Sáhara Occidental, Marruecos no pueda desempeñar el papel que le corresponde en la renovación de nuestro Continente como miembro activo y de pleno derecho de la OUA y la UA
Nosotros creímos sinceramente que, también en la cuestión del Sáhara Occidental, dejando de lado la historia de la colonización en esa parte de África, Marruecos permanecería fiel a su tradición de lealtad al principio de autodeterminación para todos los pueblos.
Ahora queda bien claro que Marruecos no tiene la menor intención de respetar el derecho del pueblo saharaui a decidir su destino.
Por el contrario, Marruecos ha decidido unilateralmente, sin consultar en absoluto al pueblo del Sáhara Occidental ni respetar las resoluciones de la ONU y la UA, que todo el mundo está obligado a aceptar una solución “consistente en una autonomía dentro del marco de la soberanía de Marruecos”.
El absurdo callejón sin salida ocasionado por las posiciones propugnadas por el Gobierno de Marruecos ha llevado a una situación en la que cualquier nuevo aplazamiento por nuestra parte en reconocer a la RASD se convertiría inevitablemente en el abandono de nuestro apoyo al derecho del pueblo del Sáhara Occidental a la autodeterminación.
Para nosotros, no reconocer a la RASD en esta tesitura significa convertirnos en cómplices de la denegación al pueblo del Sáhara Occidental de su derecho a la autodeterminación.
Además de lo anterior, continuaremos apoyando los esfuerzos de la ONU y la UA tendentes a hacer posible que el pueblo del Sáhara Occidental ejerza su derecho a la autodeterminación, utilizando para ello todos los medios disponibles y legítimos con que contamos.
Entre tanto, otorgaremos al Frente Polisario todos los derechos y privilegios que corresponden a todos los Estados miembros de la UA, en el marco del cumplimiento de nuestras obligaciones con la UA y los pueblos de África. (…)
Y el catedrático de Derecho Constitucional Carlos Ruiz Miguel ha dedicado un extenso trabajo a explicar las razones y ventajas de un Sáhara Occidental independiente [ ]; ventajas que también ha expuesto, más breve y muy recientemente, el general de División Jesús Argumosa Pila, ex jefe de la Escuela de Altos Estudios de la Defensa del CESEDEN (Centro Superior de Estudios de la Defensa Nacional, el principal centro docente militar conjunto de las Fuerzas Armadas españolas):
“Con respecto al Sahara Occidental, la aparición de un Estado democrático independiente y sólido produce importantes ventajas en la seguridad del entorno geopolítico del norte de África y África Occidental, ya que constituye un ‘muro de contención’ contra el yihadismo islámico, facilita el equilibrio estratégico de las potencias de la región, así como incrementa la estabilidad de nuestro espacio próximo de seguridad, que constituye un objetivo estratégico nacional.” [ ]
Tanto la carta del ex presidente Thabo Mbeki como los otros dos textos indicados tienen plena vigencia y deberían servir de reflexión a las autoridades de la UE en general y de España y Francia en particular.
Y en caso de que las autoridades de Marruecos, tras esa posible modificación del ‘contexto actual’, obstaculizase [ ] la implementación del acuerdo con el Frente POLISARIO / RASD, impidiendo o dificultando la pesca en las aguas adyacentes al Sáhara Occidental, la UE podría -entre otras posibles medidas de prevención o retorsión- hacerse respetar -y hacer respetar también el derecho europeo y la legalidad internacional- enviando a la zona unidades navales y/o aéreas, de defensa y protección, de vigilancia y seguridad contra la piratería, como se ha hecho en otros casos no tan lejanos (Cuerno de África, Golfo de Guinea, guerra del fletán, islote de Perejil,...), para defender la actividad pesquera y la legalidad internacional, y para proteger los legítimos derechos del pueblo del Sáhara Occidental y, en este caso, también el derecho de la UE. Pero, en cualquier caso, no es de mi incumbencia indicar o sugerir a la UE lo que tiene que hacer. Aquí simplemente trato de refutar determinadas argumentaciones y falacias del Servicio Jurídico carentes de rigor. Probablemente habrá otras posibilidades, adicionales a las aquí señaladas, que podrían ser objeto de estudio y consideración. La UE no tiene por qué mantenerse aferrada a un determinado ‘contexto’ inamovible, injusto, ilegal y contrario a la jurisprudencia del TJUE. [ ]
Obsérvese además que, según el Servicio Jurídico, se practica la consulta a “las poblaciones relevantes” (¿?), no al pueblo del Sáhara Occidental o a su representante legítimo, el Frente POLISARIO, como exige la legalidad internacional. Para la jurisprudencia internacional (ONU, OUA/UA, TJUE, Tribunal Supremo de Sudáfrica) es irrelevante que haya o no presuntos ‘beneficios’ o ‘ventajas’; lo relevante y exigido es el consentimiento, que, en este caso, no se ha obtenido.
En lo que respecta a los presuntos ‘beneficios’ -justificación también jurídicamente irrelevante-, tal como lo expone el Servicio Jurídico, parece obvio que los gastos o inversiones de las potencias coloniales [ ] (en este caso, las autoridades o el Estado de ocupación), de alguna manera, siempre van a ‘beneficiar’ a algunos segmentos de la población del territorio, en particular a los propios colonos marroquíes, las fuerzas de ocupación y a quienes se sometan y/o colaboren con el ocupante. Pero eso no entraña, en absoluto, que el interesado, el verdadero interesado, el representante legítimo del pueblo saharaui, el Frente POLISARIO, haya dado su consentimiento, ni que se haya consultado al pueblo saharaui. El presunto “beneficio” no anula, en absoluto, el requisito esencial del consentimiento del titular del derecho a dar o denegar tal consentimiento. En Derecho, el fin no justifica los medios, como han pretendido justificar el Servicio Jurídico, la Comisión y/o el SEAE.
Y la terminología empleada por el Servicio Jurídico contiene un sinfín de eufemismos escapistas y, reiteramos, elude el requisito esencial del consentimiento del Frente POLISARIO; eufemismos tales como ‘actores socioeconómicos y políticos’, ‘algunas otras partes’, ‘todas las medidas razonables y viables’, ‘contexto actual’, ‘involucrar adecuadamente’, ‘poblaciones afectadas’. Nada que ver con el consentimiento del pueblo del Sáhara Occidental. Las verdaderas “poblaciones afectadas” no son las que decidan las autoridades de Marruecos, la Comisión de la UE y/o el SEAE, sino el conjunto del pueblo saharaui, desprovisto hoy y aquí de su legítimo e inalienable derecho a la autodeterminación, del derecho permanente sobre sus recursos naturales e incluso desposeído y expulsado de gran parte de su propio territorio. [ ]
Además, el informe incluido en el Documento de Trabajo de los servicios de la Comisión, entre otras cosas, concluye que:
"Con respecto a las consultas, la primera parte, que consiste en consultas realizadas por las autoridades marroquíes, reveló un amplio consenso en apoyo de la nueva colaboración de pesca sostenible, incluida su extensión a las aguas adyacentes al territorio del Sahara Occidental. Cabe señalar que este apoyo fue expresado por unanimidad por los representantes electos de los Consejos Regionales de El Aaiún-Sakia El Hamra y Dajla-Oued Eddahab, todos de origen saharaui, según las autoridades marroquíes, y en muy gran medida por las Cámaras de Pesca Marítima y la Comisión de Asuntos Exteriores, Fronteras, Defensa Nacional y Territorios marroquíes ocupados [¡!] de la Cámara de Consejeros del Parlamento marroquí. [Énfasis añadido]. [ ]
Evidente. ¡Solo faltaría que los propios marroquíes y sus organismos oficiales estuvieran en contra de incluir las aguas del Sáhara Occidental, cuando es el propio régimen marroquí el proponente del Acuerdo de Pesca y el ocupante ilegal del Sáhara Occidental!
Además, y aunque sea desviarnos de la cuestión central (la verdadera jurisprudencia del TJUE y el consentimiento del pueblo saharaui), señalemos de paso que se trata, en cualquier caso, y como mucho, de unos ‘representantes electos de origen saharaui’, sin representatividad alguna en Derecho Internacional y provenientes de unas elecciones ilegítimas, irregulares y forzadas -tras más de cuarenta y cinco años de ocupación militar- por la legislación impuesta por el ocupante en una parte del Territorio No Autónomo. Y dejando de lado -que ya es mucho dejar- el hecho de que el pueblo saharaui solo tiene un representante legítimo y auténtico, el Frente POLISARIO, [ ] sigue sin cumplirse el requisito primordial: el consentimiento del pueblo saharaui, a través de ese su representante legítimo reconocido por Naciones Unidas; de la misma manera que la RASD ha sido reconocida por más de ochenta países y es Miembro fundador de la Unión Africana, organización continental de la que solo Marruecos ha estado ausente.
En cuanto a la pretendida ‘representatividad’ de organismos e instituciones marroquíes o ‘controladas’ por el ocupante marroquí para dar su Visto Bueno al acceso a las aguas adyacentes al Sáhara Occidental, es absolutamente nula a efectos del requisito del consentimiento del pueblo saharaui (no de las autoridades marroquíes). [ ]
“En cuanto a los resultados de las consultas llevadas a cabo por el SEAE [Servicio Europeo de Acción Exterior] y la Comisión, se ha podido constatar un apoyo muy fuerte para la extensión del ACPS [Acuerdo de Colaboración en el campo de la Pesca Sostenible] UE-Marruecos a las aguas adyacentes al Sáhara Occidental, aunque varios actores hayan hecho observaciones y recomendaciones sobre ciertos aspectos de la implementación del Acuerdo de pesca con el fin de maximizar los beneficios para la población local. [Énfasis añadido]. [ ]
Una vez más, en cuanto a esas ‘consultas’ sui generis (y jurídicamente irrelevantes) llevadas a cabo por el SEAE, hay que volver a repetir que la cuestión relevante no son los presuntos ‘beneficios’ potenciales, sino el consentimiento de quien está legitimado para darlo o denegarlo; y tampoco la población relevante es ‘la población local’ (en gran parte, las fuerzas de ocupación y los colonos marroquíes transferidos ilegalmente al territorio no autónomo, en violación de la Convención de Ginebra), [ ] sino el pueblo del Sáhara Occidental. En cuanto a la expresión “se ha podido constatar”, quien de verdad constató la voluntad de libertad, independencia y apoyo al Frente POLISARIO fue la Misión de la ONU que visitó el territorio en mayo de 1975, cuando todavía era oficialmente provincia española, la Provincia 53. [ ] Es inaudito que la Comisión, el SEAE y el Servicio Jurídico oculten ese hecho fundamentak, recogido en los textos pertinentes de la ONU, y que pretendan imponer su particular ‘constatación’ -sin base legal alguna- por encima de la constatación histórica, genuina y legal de la ONU. [ ] La Misión Visitadora de la ONU constató in situ la voluntad de autodeterminación e independencia del pueblo saharaui, voluntad que ha demostrado en numerosas ocasiones: en su lucha contra el colonialismo español, en el grito de Zemla en 1970, en la creación del Frente POLISARIO, en la proclamación de la RASD y de la Constitución del Estado Saharaui, en el levantamiento del Campamento de la Dignidad (Gdeim Izik), en su lucha permanente contra el invasor marroquí, en los números juicios-farsa promovidos por el ocupante, en el padecimiento de desapariciones, detenciones arbitrarias, torturas, condenas a cadena perpetua,…
En cambio, de lo que sí habría que… felicitar a la Comisión y al SEAE es de haber conseguido -suponemos- entrar en los Territorios Ocupados del Sáhara Occidental para realizar tales ‘consultas’, dado que las autoridades marroquíes de ocupación impiden el acceso a los TT. OO. y expulsan sin contemplaciones -a veces, sin ni siquiera dejarles bajar del avión- a cuantos eurodiputados, diputados nacionales, juristas, abogados, observadores internacionales, periodistas, miembros de ONGs, estudiantes, artistas, simples ciudadanos intentan acceder al Sáhara Occidental para conocer la realidad in situ, en vista del férreo bloqueo informativo y mediático impuesto por las autoridades de ocupación y las directrices impartidas por el lobby promarroquí de “encapsular el tema del Sáhara”. Marruecos llegó incluso a expulsar, impunemente, a 73 miembros de ONU / MINURSO; y al propio secretario general de la ONU, Ban Ki-moon, se le prohibió el acceso a los Territorios Ocupados y, aún más, las autoridades marroquíes organizaron una incalificable campaña de desprestigio personal e institucional por haber mencionado la palabra “ocupación” en su visita a los Campamentos de refugiados saharauis en Tinduf (Argelia). [ ] Sin duda, esa libertad de acceso a determinados funcionarios comunitarios del SEAE es el resultado de la buena connivencia existente con las autoridades de ocupación. Una constatación más de la política autoritaria, antidemocrática, discriminatoria y reaccionaria de que hacen gala las autoridades marroquíes y que silencian las autoridades de la UE. [ ]
“Las partes interesadas consultadas no plantearon ninguna pregunta específica sobre derechos humanos en relación con la colaboración pesquera y no se encontraron motivos de discriminación por motivos étnicos. Los interlocutores celebraron la existencia en el ACPS y en el protocolo de una cláusula general de derechos humanos y de disposiciones específicas sobre no discriminación y derechos laborales, de conformidad con las normas de la OIT. Por su parte, el Frente Polisario y varios otros actores sensibles a su causa se negaron a participar en el proceso de consulta sin presentar ningún argumento contra el nuevo ACPS [‘Acuerdo de Colaboración de Pesca Sostenible’]. [Énfasis añadido].
Esto ya es pura ciencia-ficción: ¡Los saharauis encantados con la ocupación militar de su territorio, el saqueo de sus recursos naturales y celebrando el respeto de los derechos humanos por parte de Marruecos! Y la Comisión y el SEAE tan felices. Ya ha sido aclarado más arriba lo relativo a “las partes interesadas consultadas”. En lo que respecta a los DDHH, el pueblo saharaui no solo “pregunta” sobre la permanente y sistemática violación de los derechos humanos en los territorios ocupados del Sáhara Occidental -empezando por el derecho principal: la denegación, por el establishment de Marruecos, de su inalienable derecho a la autodeterminación e independencia- [ ], sino que viene denunciando continuamente esa flagrante violación en todos los foros y ante la comunidad internacional y llevando a cabo continuas manifestaciones de protesta y reivindicación de sus derechos. Y cuando se manifiestan incluso por meras cuestiones laborales (“de conformidad con las normas de la OIT”), son brutalmente reprimidos y hasta condenados a cadena perpetua (Gdeim Izik). Parece mentira que la Comisión y el Servicio Jurídico omitan descaradamente esas constantes denuncias y esa sistemática y brutal represión. Hay infinidad de documentos al respecto. [ ]
Sirvan de testimonio, como mero botón de muestra, y como ejemplo para para los gobernantes españoles y de la UE, la reciente declaración de Colin O'Brien ante el Consejo de Derechos Humanos de Naciones Unidas, en Ginebra, manifestando que “la explotación ilegal de los recursos naturales del Sáhara Occidental por parte de Marruecos y algunos de sus socios consolida la ocupación y prolonga el sufrimiento del pueblo saharaui”. Y en su respuesta a la falacia y falsas e infundadas declaraciones del representante de Marruecos, O’Brien agregó: "Namibia, como país que ha pasado por la misma experiencia, está decidido a estar en el lado correcto de la Historia en esta cuestión, y no permitirá el sufrimiento de pueblos ocupados como Palestina y el Sáhara Occidental", puesto que sus derechos fundamentales e inalienables a la libre determinación y la independencia están consagrados en los principios del derecho internacional. El diplomático namibio también explicó que su país no está entre las partes que pactaron privar y violar los derechos del pueblo saharaui y explotar ilegalmente sus recursos naturales. Y dirigiéndose al embajador de Marruecos dijo que la continuación de las violaciones de los derechos humanos, incluida la explotación ilegal de los recursos del Sáhara Occidental, además de apoyar la continua ocupación ilegal del territorio, impide cualquier plan de paz debido a los intereses económicos de la ocupación marroquí y sus socios. [ ] [Énfasis añadido].
Sobre la violación de los derechos humanos en el Sáhara Occidental ocupado por Marruecos también testificó recientemente Aminetu Haidar (Premio Nobel Alternativo 2019, por su abnegada dedicación a la defensa de los derechos del Pueblo Saharaui) en Ginebra, en la 43ª sesión del Consejo de Derechos Humanos de la ONU, mencionando algunos de los métodos del régimen marroquí contra ciudadanos saharauis: “tortura, tratos crueles y degradantes, detenciones arbitrarias, acusaciones falsas, expulsión del trabajo, deportación forzada a las ciudades de Marruecos, difamación por la prensa marroquí,..”, y denunciando que mientras esas violaciones se producen ,“el acceso de los observadores internacionales al territorio ocupado es imposible”. Y lo dijo precisamente el 28 de febrero, el mismo día que Marruecos impidió la entrada en El Aaiún a una comisión de parlamentarios catalanes y tres días después de la expulsión de una observadora del Consejo General de la Abogacía Española. [ ]
Hablar de derechos humanos en el Sáhara Occidental ocupado por Marruecos no es solo una simple ironía, sino una enorme insensatez, un delirio, una falta absoluta de cordura. No solo brilla por su ausencia el respeto de los DDHH, sino que se violan con total impunidad. No sabemos qué es peor, si malvivir en los Campamentos de Refugiados en Tinduf, en un desierto invivible, en medio de la nada, carentes de recursos y con un calor sofocante, o resistir en esa prisión a cielo abierto en que Marruecos ha convertido los TT OO, donde las fuerzas de ocupación perpetran sistemáticamente todo tipo de tropelías contra los indefensos saharauis. [ ]
Parece mentira que el Acuerdo de Pesca UE-Marruecos esté condicionado, aparentemente, por una cláusula de respeto de los DDHH. Queda muy bonito en el papel, pero es simple papel mojado, se incumple por completo. Y ese incumplimiento debiera ser razón suficiente para que la UE dejara en suspenso la aplicación del Acuerdo. ¿Para qué sirve, si no, esa cláusula?
Alternativamente, la UE tiene en su mano una importante herramienta para presionar a Marruecos y obligar a sus autoridades a tratar a los presos políticos saharauis como seres humanos, en lugar de como perros sarnosos a extinguir. La cuestión es que la UE no quiere enterarse de todo esto o, peor aún, mira hacia otro lado, como hace también la prensa del establishment, la prensa europea, civilizada, independiente, global y políticamente correcta, para la que las injusticias perpetradas impune y permanentemente no son ‘noticia’ que diviertan a los europeos civilizados.
El caso más patético es el del Grupo de Presos de Gdeim Izik, juzgados en varios juicios-farsa, sin pruebas y bajo tortura, con graves ‘irregularidades’ procesales, y condenados a 30 años de prisión, unos, y otros a cadena perpetua, sometidos a todo tipo de vejaciones y maltrato, al aislamiento prolongado, a más de mil kilómetros de sus familiares, depauperados, enfermos y degradados, al albur de sus carceleros.
Los 19 presos políticos saharauis del grupo Gdeim Izik son un ejemplo del desprecio absoluto de Marruecos por los Mecanismos de Derechos Humanos de las Naciones Unidas (el Comité Contra la Tortura, CAT, por sus siglas en inglés) y la falta de independencia del CNDH (Consejo Nacional de Derechos Humanos de Marruecos) como supuesto mecanismo de prevención contra la tortura. Los casos de Saadoni, Naama Asfari, Abdallah Abbahah, Neama Abdi Sid Ahmed, Sidahmed Lemjeyd, Houcein Zawi o Ali Saadoni, por señalar algunos de ellos, son paradigmáticos y muy preocupantes. [ ].
Pero son solo la punta del iceberg del ensañamiento, revanchismo y persecución de que es objeto el pueblo saharaui, sometido a una suerte de exterminio sádico, lento e invisible para quien no lo quiere ver, pero que resiste heroicamente al invasor y mantiene la bandera de su dignidad y sus derechos inalienables por encima de la adversidad, la tortura y las tropelías a que se ve injustamente sometido.
Son esos presos -y no una cláusula de papel- quienes debieran acaparar la atención de la UE civilizada -de altos valores y principios-, a quienes debiera prestar toda su atención en este ‘contexto actual’, porque ellos son el reflejo, precisamente, de la connivencia de la UE con el ocupante marroquí, plasmada en el Acuerdo de Pesca. La UE financia a Marruecos sobre la base -teórica, de papel- del respeto de los DDHH. Pero esa financiación -como demuestra el propio Informe del Tribunal de Cuentas Europeo- no cumple su función ni de lejos.
El Consejo Nacional de Derechos Humanos marroquí (CNDH), presentado como interlocutor de la UE en asuntos de DDHH y por el que la UE ha pagado y paga, y al que Marruecos ha pretendido presentar como ‘Mecanismo de Vigilancia contra la Tortura’ -un remedo caricaturesco del Ombudsman o Defensor del Pueblo en Europa- ni es independiente ni imparcial. Sirve exclusivamente de tapadera para recibir financiación de la UE. No investiga las violaciones perpetradas, las torturas infligidas a los presos políticos saharauis, sus quejas por maltrato y desatención médica, por denegación de todo derecho.
Algunos presos que han osado denunciar, como han podido, esos hechos ante el Comité Contra la Tortura de la ONU (CAT), han sido objeto de nuevas represalias por ello, por ejercer sus derechos reconocidos por el Derecho Internacional Humanitario, sometidos a nuevos castigos, al aislamiento prolongado, a no ser visitados por sus familiares, a no recibir atención médica ni jurídica, a…
Y en los casos en que el CAT ha decretado la adopción de medidas urgentes de atención a esos presos, sus carceleros, las autoridades y el CNDH marroquíes han hecho caso omiso. Y a pesar de ello y de la bendita cláusula de papel en el Acuerdo de Pesca y en su Protocolo, la financiación de la UE continúa fluyendo, como si no pasara nada, mientras que a los abogados no se les permite entrevistarse con los presos a quienes pretenden proteger, como ha denunciado la abogada Maître Olfa Ouled. [ ]
¿Qué sabe de todo esto la UE? ¿Qué quiere saber? ¿Hasta cuándo va a seguir con los ojos cerrados? Cuando menos, podía hacer uso de la cláusula de derechos humanos -de la que tanto alardea el Servicio Jurídico- incrustada mal que bien en el Acuerdo de Pesca UE-Marruecos. Seguramente, el TJUE tendrá algo que decir al respecto, igual que se ocupa de los abusos bancarios. [ ]
“Finalmente, debe señalarse -continúa diciendo el Servicio Jurídico- que el Acuerdo de Asociación de Pesca UE-Marruecos no prejuzga la posición de la UE frente a la situación política del Sáhara Occidental y el proceso liderado por la ONU. La UE apoya los esfuerzos de las Naciones Unidas para encontrar una solución política justa, duradera y mutuamente aceptable que permita la autodeterminación del Sáhara Occidental en el contexto de acuerdos compatibles con los propósitos y principios de la Carta de las Naciones Unidas".[ ] [Énfasis añadido].
No es ya que el Acuerdo no “prejuzgue”, sino que, por el contrario, en connivencia con el régimen marroquí, contribuye a continuar sojuzgando y sometiendo al pueblo del Sáhara Occidental a las pretensiones anexionistas de Marruecos, a cuyo Gobierno este Acuerdo le sirve para justificar aún más su pretendida soberanía territorial sobre el territorio no autónomo del Sáhara Occidental pendiente de descolonización [ ] , como muy bien saben los funcionarios franceses que dirigen y controlan el Servicio Jurídico, que lo dejan bien claro en el párrafo 2 del Canje de Notas, el cual forma parte integrante del Acuerdo de Pesca. Y lo que es aún mucho más grave, alentando de nuevo la guerra en la región. [ ] Porque de eso estamos hablando, de las implicaciones y consecuencias de un dictamen jurídico fraudulento y prevaricador. A sus autores no los meten en la cárcel, ni los torturan, ni los expulsan de su tierra, ni los bombardean con napalm y fósforo blanco. No, se van de rositas y se corre un tupido velo.
Con su actitud y su comportamiento, la UE da alas al expansionismo marroquí, en lugar de exigir a Marruecos el cumplimiento de la legalidad internacional y hacer lo propio también la UE misma. No es así como se contribuye a la paz en la región, sino todo lo contrario.
La UE podría y puede excluir el Sáhara Occidental de su Acuerdo de Pesca con Marruecos, como han hecho Estados Unidos, Noruega o Islandia en sus acuerdos comerciales con el Reino de Marruecos. [ ] La sistemáticamente sorda, ciega y muda actitud de la UE en relación con la permanente violación de los DDHH en el Sáhara Occidental ocupado clama al cielo. No es esa, precisamente, ni mucho menos, la forma de apoyar “los esfuerzos de las Naciones Unidas para encontrar una solución política justa, duradera y mutuamente aceptable que permita la autodeterminación del Sáhara Occidental”, sino más bien todo lo contrario, una clara intromisión favorable al verdugo y ocupante, en perjuicio de la víctima y ocupado, el pueblo saharaui.
Y debe quedar claro que lo que se oculta bajo la expresión “situación política del Sáhara Occidental” no es otra cosa que el fait accompli, el hecho consumado de una agresión bélica, la invasión y ocupación militar por parte del Reino de Marruecos. Sobran eufemismos, tergiversaciones y silencios convenientemente manipulados. [ ] Este comportamiento de la UE, ninguneando conscientemente la jurisprudencia del TJUE y actuando en connivencia con quien incumple impunemente la legalidad internacional, en lugar de exigir el respeto de ésta, deja muy mal los propios principios proclamados en el Tratado de la Unión y presuntamente asumidos por todos los Estados miembros, a los cuales corresponde legalmente aplicar la jurisprudencia del TJUE, debiendo atenerse a las consecuencias si así no lo hicieren, como en el caso aquí expuesto del Sáhara Occidental. [ ]
Está claro también que, al concluir un Acuerdo Pesquero con Marruecos abarcando las aguas adyacentes al Sáhara Occidental, la UE está haciendo un flaco favor a los (dudosos) esfuerzos de la ONU por hallar una solución al conflicto, pues precisamente ese Acuerdo le sirve y lo utiliza Marruecos para ‘demostrar’ su soberanía sobre el territorio ocupado y proclamarlo así urbi et orbi, precisamente cuando el secretario general de la ONU, António Guterres, ha llamado a erradicar el colonialismo “de una vez por todas”. [ ]
De manera que la argumentación del Servicio Jurídico es falaz, cínica, engañosa, presuntamente un acto de prevaricación y desacato. [ ] Como también es dudosa e interesada la utilización de la expresión “(…) aceptable que permita la autodeterminación del Sáhara Occidental en el contexto de acuerdos compatibles con los propósitos y principios de la Carta de las Naciones Unidas”. ¿Qué es eso de “en el contexto de acuerdos compatibles”? Al parecer, el Servicio Jurídico, eludiendo toda apoyatura jurisprudencial, se considera con competencia y capacidad suficiente como para endilgar nada menos que a la Carta de la ONU los intereses subyacentes a quienes comercian con la vida del pueblo saharaui, sus legítimos derechos y la violación de la legalidad internacional. Sin duda, será de nuevo el TJUE quien podrá aclarar esta situación, no un simple ciudadano que clama por lo evidente.
El Servicio Jurídico considera que, según “los documentos presentados al Consejo, se tomaron todas las medidas razonables y viables para determinar el consentimiento del pueblo del Sáhara Occidental al proyecto de Acuerdo y Protocolo a través de la consulta al representante de ese pueblo” (¡sic!). Esto es una burda falsedad (¡“al representante de ese pueblo”!) y una patente contradicción con lo expuesto más arriba por el propio Servicio Jurídico, confesando que ha tenido que “determinar” (pero no “obtener”, y menos de su representante legítimo) el consentimiento de determinadas entidades y organismos marroquíes; en absoluto del pueblo saharaui: Ni una sola organización saharaui ha participado en esa farsa de ‘consulta’; ni siquiera la principal organización marroquí de defensa de los derechos humanos, la AMDH; por algo será. Al respecto, ya hemos señalado más arriba posibles medidas a adoptar, razonables y viables (como lo han sido para más de 80 países), que no han sido consideradas por la Comisión / SEAE. Otra cosa es que no les ‘interese’ considerarlas; y que sean muy otras las instrucciones recibidas.
Recordemos que Marruecos -siempre tan … respetuoso con la legalidad- suspendió el diálogo político formal con la UE después de que el Tribunal de Justicia de la Unión Europea dictaminara que el Sáhara Occidental no formaba parte de sus acuerdos de pesca y agricultura con la UE; y que, a pesar de ello, en reciprocidad …, “la Comisión le siguió prestando apoyo presupuestario [dinero contante y sonante] durante el plazo suspensivo, que duró hasta 2019”, como señala textualmente el demoledor Informe del Tribunal de Cuentas Europeo de 2019.[ ]
Desconocemos esos documentos que el Servicio Jurídico dice haber presentado al Consejo para afirmar que “se tomaron todas las medidas razonables y viables (…)”. Lo que sí es de conocimiento público es la ‘advertencia’ (léase amenazas) de las autoridades marroquíes ante el fallo del TJUE que denegaba la aplicabilidad del Acuerdo de Pesca al territorio distinto y separado del Sáhara Occidental y la inmediata ‘disponibilidad’ de la Alta Representante de la UE para Asuntos Exteriores, Federica Mogherini, para ‘arreglar’ el asunto (“ya encontraremos una solución técnica”) conforme a los deseos expansionistas y anexionistas de Marruecos, ninguneando la jurisprudencia del TJUE y la legalidad internacional. [ ]
Si Estados Unidos, Noruega e Islandia han excluido el Sáhara Occidental de sus respectivos acuerdos con Marruecos [ ], ¿no puede hacer lo mismo la UE, en lugar de ir a remolque de las pretensiones expansionistas marroquíes y saltarse la jurisprudencia del TJUE y la legalidad internacional? ¿No tiene suficiente autonomía para hacerlo? ¿No es soberana en sus decisiones?
Dicho de otro modo, si es inviable legalmente para la UE obtener el consentimiento del pueblo saharaui, a través de su representante legítimo, el Frente POLISARIO, déjense fuera del Acuerdo de Pesca las aguas adyacentes al Sáhara Occidental (de las que se obtiene más del 90 por ciento de las capturas), en lugar de pretender un encaje de bolillos o una cuadratura del círculo imposible, fraudulenta e incoherente. El fin (acceder a las aguas saharauis) no puede justificar los medios (la vulneración de la jurisprudencia del TJUE y la legalidad internacional). [ ] Una vez más, no se trata de “determinar” el consentimiento del pueblo de Sáhara Occidental, sino de obtenerlo. Y no se ha obtenido. El Frente POLISARIO ha advertido pública y reiteradamente de que no aceptará ninguna solución que no garantice el derecho del pueblo saharaui a la autodeterminación y la independencia, y de que rechaza la inclusión del Sáhara Occidental en la renegociación del Acuerdo de Pesca UE-Marruecos.
No es cierto, repetimos, que se hayan tomado “todas las medidas razonables y viables en el contexto actual”, como ya se señaló más arriba. En primer lugar, “el contexto actual” es el de la ocupación militar ilegal marroquí, considerada así y condenada por las resoluciones pertinentes de Naciones Unidas. Y la UE no tendría por qué meterse en ese “contexto”, asumirlo y hacerse cómplice del mismo. Y, en segundo lugar, entre las medidas ‘razonables y viables’ está el establecimiento de relaciones de alto nivel con las legítimas autoridades saharauis, si es que no el reconocimiento de la República Árabe Saharaui Democrática (RASD), que cuenta con más de cuatro décadas de existencia exitosa, instituciones consolidadas, es miembro fundador de la Unión Africana (UA) y ha sido reconocida por más de ochenta países. [ ]
En lugar de ello, la UE le hace el boicot al pueblo del Sáhara Occidental y a sus autoridades legítimas y se achanta ante las pretensiones anexionistas marroquíes [ ], incluso cuando a sus propios eurodiputados se les impide el acceso al Sáhara Occidental ocupado y Marruecos los expulsa sin contemplaciones, como hace con otros muchos representantes electos europeos, juristas, periodistas, observadores y defensores de derechos humanos, sin que las instituciones de la UE se inmuten. [ ]
La evaluación del Servicio Jurídico es que “el apoyo expresado para el proyecto de Acuerdo y Protocolo parece reflejar que estos traerían beneficios para las personas interesadas y garantizarían una explotación sostenible de los recursos naturales.” [Énfasis añadido].
Una vez más: no se trata de los presuntos “beneficios”, sino del “consentimiento”; y tampoco se trata de “las personas interesadas” o de las “poblaciones afectadas”, sino de los intereses y derechos del pueblo saharaui, representado legal y legítimamente por el Frente POLISARIO.
Quienes han manifestado su apoyo -según el documento del Servicio Jurídico- al proyecto de Acuerdo y Protocolo son las organizaciones y entidades marroquíes (¡incluso el Ministerio marroquí de Agricultura y Pesca Marítima!) o bajo control de las autoridades de ocupación, no las genuinamente saharauis. [ ] ¿También era necesario ‘consultar’, incluso, al citado Ministerio marroquí, que es parte proponente del Acuerdo de Pesca, siguiendo el mandato de Palacio? Esto es una muestra más de cinismo, de fraude jurídico y de las argucias empleadas para cocinar el Acuerdo de Pesca.
Y ya puestos a ‘consultar’, digamos que no se ha ‘consultado’ -aunque también sería jurídicamente irrelevante, pero que sirve para resaltar la parcialidad del Servicio jurídico o las instrucciones recibidas por éste- a organizaciones internacionales -algunas con estatus de miembro observador del ECOSOC de la ONU- o a los cientos de asociaciones españolas solidarias con el pueblo saharaui, [ ] agrupadas y representadas por la Coordinadora Estatal de Asociaciones Solidarias con el Sáhara, CEAS-Sáhara, dado que España es de iure la Potencia administradora [ ] , un Estado social y de Derecho (imperio de la ley) con obligaciones históricas, jurídicas y éticas pendientes para con el pueblo saharaui y la comunidad internacional. [ ]
III. Respecto a las reivindicaciones marroquíes de soberanía sobre el Sáhara Occidental, el Servicio Jurídico dice:
Para cumplir con la jurisprudencia del Tribunal de Justicia, [ ] también es esencial que la forma en que las aguas adyacentes al Sáhara Occidental estén incluidas en un acuerdo con Marruecos no equivalga al reconocimiento de la soberanía marroquí sobre el Sáhara Occidental.
A este respecto, la zona de pesca se define en el proyecto de Acuerdo sin ninguna referencia a la soberanía o jurisdicción marroquí, a diferencia de las disposiciones del anterior Acuerdo de Pesca, que se aplicaban al "territorio de Marruecos y a las aguas bajo jurisdicción marroquí" y a "zona de pesca marroquí", definidas como "las aguas que caen dentro de la soberanía o jurisdicción del Reino de Marruecos".
Además, el proyecto de Canje de Notas confirmó explícitamente que el proyecto de Acuerdo se entiende sin perjuicio de las posiciones respectivas de las Partes sobre el Sáhara Occidental y que, para la Unión, las referencias en el Acuerdo de Pesca a las leyes y reglamentos marroquíes se entenderán sin perjuicio de su posición sobre el estatus del territorio no autónomo del Sáhara Occidental y su derecho a la libre determinación.
Por lo tanto, el proyecto de Acuerdo, incluido el Intercambio de Notas, no constituye en modo alguno un reconocimiento por parte de la UE de cualquier reivindicación marroquí de soberanía sobre el Sáhara Occidental y sus aguas adyacentes. Simplemente refleja que Marruecos controla de facto el acceso a esas aguas y que la pesca allí no puede realizarse sin el acuerdo de las autoridades marroquíes de ocupación. [Énfasis añadido]
Es decir, si en el anterior Acuerdo de Pesca se violaba flagrantemente la legalidad internacional y se atribuían, indebidamente, a la jurisdicción o soberanía marroquí las aguas del Sáhara Occidental, ahora, en el nuevo Acuerdo, ¡”simplemente”! la UE acepta de facto la ocupación militar de una potencia extranjera y negocia con ésta el saqueo ilegal e ilegítimo de un territorio colonial ajeno, negando también de facto el derecho de autodeterminación, sometiéndose a “las autoridades marroquíes de ocupación, que controlan el acceso a esas aguas”.
A la UE, en connivencia con las autoridades marroquíes de ocupación, le interesa exclusivamente, y a cualquier precio, “el acceso a esas aguas”, desentendiéndose de cualquier otra consideración, como la legalidad internacional, la ilegal ocupación militar marroquí o la denegación del derecho fundamental e inalienable del pueblo del Sáhara Occidental a la autodeterminación y el derecho permanente sobre sus recursos naturales. [ ] Y para conseguir ese objetivo considera suficiente no hacer “ninguna referencia a la soberanía o jurisdicción marroquí”, como si tapándose los ojos dejara de existir esa realidad colonial ilegal y sus gravísimas e intolerables consecuencias en múltiples ámbitos; entre otros, el empobrecimiento e inenarrable sufrimiento del pueblo saharaui, el saqueo de sus recursos naturales, la violación estructural de los derechos humanos inherente a la ocupación, las desapariciones, torturas y encarcelamientos, los juicios-farsa a presos políticos, las condenas a cadena perpetua, la pérdida de generaciones enteras, el exilio y la diáspora. [ ]
¿A quién se pretende engañar? Es obvio que esta descarada forma de proceder de la UE no hace sino afianzar las pretensiones anexionistas marroquíes por la vía del fait accompli, tal y como desea el Gobierno ocupante, complicando más la situación y dificultando aún más el largo, tortuoso y manipulado proceso de búsqueda de solución auspiciado por Naciones Unidas, ya de por sí suficientemente torpedeado por Francia[ ].
Como muy bien señalaba recientemente, Katja Kipping, copresidenta del partido alemán Die Linke y diputada en el Bundestag, "sin el apoyo de Europa, Marruecos no podrá seguir violando los DD HH en el Sáhara Occidental". [ ] Pero eso no ha sido materia de interés ni de consideración por el Servicio Jurídico. Hay una realidad injusta e ilegal, pero como a la UE no le interesa tomarla en consideración (porque hay otros intereses ‘más importantes’), ‘simplemente’ da un tortuoso rodeo y “accede a esas aguas” de todas maneras, en cualquier caso, por otra vía, con un mero apaño terminológico; a satisfacción de Marruecos, “socio estratégico” de la UE, que puede así saquear o beneficiarse -como también lo hace la propia UE- de la riqueza pesquera de las aguas saharauis con total tranquilidad e impunidad, sin mancharse las manos, sin cargos de conciencia y con la cabeza de sus gobernantes bien alta, como si se tratara del dogma de la inmaculada concepción, sin romperse ni mancharse. Una posición cínica que arrasa la credibilidad de las instituciones de la UE, sus proclamados valores y principios, y la honorabilidad de los gobernantes de los Estados miembros. [ ] Como señalaba recientemente la escritora y periodista Géraldine Schwarz, “si los países europeos quieren tener influencia normativa en el mundo y reafirmar los valores de una sociedad abierta y democrática frente a modelos autoritarios, las antiguas potencias coloniales deben asumir sus responsabilidades históricas”. [ ]
Para tratar de ser ‘convincente’, el Servicio Jurídico necesita reiterarlo una y otra vez, para hacer así creíble y tranquilizador el mensaje de su relato a los EE MM más escépticos y para que, finalmente, el Consejo adopte la decisión adecuada: acceder por encima de todo a las aguas adyacentes al Sáhara Occidental y apropiarse, sin el consentimiento de sus legítimos propietarios, de sus riquezas marinas, pretendidamente sin contradecir la jurisprudencia del TJUE, el espíritu de la misma, ni la legalidad internacional.
Estas son sus justificaciones:

In his own name and right, in accordance with Article 258 of the Treaty on the Functioning of the European Union (TFEU), and on the basis of the facts and arguments set out below, he formulates the following,
COMPLAINT TO THE EU COMMISSION
FIRST.-Request that infringement proceedings be initiated against Spain for failure to comply with the jurisprudence of the Court of Justice of the European Union (ECJ) with regard to the EU-Morocco Fisheries Agreement, pursuant to Article 258 of the Treaty on the Functioning of the European Union (TFEU).
SECOND.-If the Commission finds that the infringement complained of here has been committed, it should sue Spain before the ECJ for failure by Spain to comply with its jurisprudence on the EU-Morocco Fisheries Agreement.
THIRD.-That this petition and any possible complaint be forwarded to the European Parliament for information and appropriate action, if appropriate.
FACTS
In several consecutive rulings since December 2015, the Court of Justice of the European Union (ECJ) has unequivocally concluded that the EU-Morocco bilateral agreements, including the fisheries agreement, cannot be applied to Western Sahara, in line with the Opinion (Advisory Opinion) of the International Court of Justice in The Hague of 16 October 1975, the relevant UN General Assembly and Security Council resolutions and the Organisation for African Unity (OAU)/African Union (AU).
Following the judgment of the ECJ of 27 February 2018 in case C-266/16 (Western Sahara Campaign UK), on 8 October 2018 the Commission submitted proposals to the Council for decisions on the signing and conclusion of a new fisheries agreement, including an exchange of notes and a new protocol with Morocco (hereinafter, respectively, draft agreement, draft exchange of notes and draft protocol).These proposals were accompanied by a Staff Working Document (SWD) containing a report assessing the alleged potential benefits for the population of Western Sahara, as well as the consultation of that population, according to the text of that document.
During the presentation and discussion of these proposals in the relevant Fisheries Working Groups in October 2018, the delegations of several Member States (at least Germany, Ireland, Denmark and Sweden) asked the Legal Service to assess in writing whether these proposals were in conformity with the jurisprudence of the Court of Justice. In response to this request, the Legal Service provided an opinion (legal opinion) on 7 November 2018.
In the EU-Morocco Fisheries Agreement, the Protocol to which expired on 14 July 2018, the Council, the Commission and the Government of Morocco had provided that the Agreement and the Protocol would also apply to waters adjacent to Western Sahara. However, in its judgment of 27 February 2018, in case C-266/16 (Western Sahara Campaign UK), the Court of Justice ruled that the Agreement and the Protocol did NOT cover these waters.
In particular, following its judgment of 21 December 2016 in case C-104/16P (Council v. Polisario Front), the ECJ concluded that the territory of Western Sahara is not included in the concept of "territory of Morocco". The Court also ruled that the waters over which a coastal State is entitled to exercise sovereignty or jurisdiction are limited exclusively to the waters adjacent to its territory and forming part of its territorial sea or exclusive economic zone; and that, consequently, the waters adjacent to the territory of Western Sahara cannot be regarded as forming part of the Moroccan fishing zone referred to in the agreement. And finally, the ECJ concluded that any notification of geographical coordinates by Morocco to the EU can in no way extend the scope of those acts to include those waters.
Following this judgment, on 16 April 2018 the Council adopted a decision, together with the associated negotiating directives, authorising the Commission to open negotiations with Morocco with a view to amending the fisheries agreement and concluding a new protocol thereto.
The amendment of the Fisheries Agreement was considered necessary, in particular, to extend the scope of the Agreement (and of a new Protocol) to include the waters adjacent to Western Sahara. And the decision authorising the opening of negotiations and the associated negotiating directives replaced an earlier decision and associated negotiating directives, "precisely to take account of the judgment of 27 February 2018", according to the Legal Service.
At this point, it is worth bringing up again the judgment of the Court of Justice of the EU of 21 December 2016, in case C-104/16 P (Council v. Polisario Front). In that ruling, the ECJ ruled that the association agreement does not apply to the territory of Western Sahara; that the principle of self-determination, as well as the rule that a treaty is binding on each party with respect to its entire territory unless a different intention of the treaty appears or is otherwise established, and the principle of relative effect of treaties prevent an interpretation of an EU agreement with Morocco from including Western Sahara when the agreement does not explicitly mention that that territory is included.
In particular, and in the first place, the ECJ established in that ruling that the principle of self-determination implies a different and separate status from the Non-Self-Governing Territories, paragraphs 89-93. Secondly, it established that, if an agreement is supposed to apply beyond the "geographical space over which the State exercises the full powers granted to sovereign entities by international law", that agreement must expressly provide for it, which was not the case in the agreement in question (paragraphs 94 a to 99). And, thirdly, the ECJ declared that "the people of Western Sahara must be regarded as a 'third party' within the meaning of the principle of the relative effect of treaties", with the consequence that the implementation of an agreement, should the territory of Western Sahara fall within the scope of that agreement, "must receive the consent of that third party" (paragraphs 100-108).
Bearing in mind this jurisprudence of the ECJ, three main issues are examined below for consideration by the Legal Service: 1) the inclusion of the waters adjacent to Western Sahara; 2) consultation with and consent of the people of Western Sahara; and 3) Moroccan claims to sovereignty over the territory of Western Sahara.
I.-Considerations regarding the inclusion of waters adjacent to Western Sahara
As the Legal Service itself acknowledges, "it is clear that the new draft Agreement and Protocol would apply to the waters adjacent to Western Sahara, as required by the relevant negotiating directives": Article 2 of the draft Agreement states that it "establishes a framework for the [...] governance of fishing activities by Union fishing vessels, setting out in particular (a) the conditions under which Union vessels may take part in fishing activities in the fishing zone".
And that “fishing zone” is defined in Article 1(h) of the draft Agreement as follows: "the waters of the Eastern Central Atlantic Ocean between the parallels 35º 47 '18" North and 20º 46' 13" North, including the adjacent waters of Western Sahara, which covers all management areas". Furthermore: “This definition will not affect any negotiations on the delimitation of the marine areas of coastal states bordering the fishing zone, or the rights of third countries in general."
All references in the draft agreement then already refer to this 'fishing zone':
Article 4 thus reads: "The Moroccan authorities undertake to authorise Union vessels to engage in fishing activities in the fishing zone in accordance with this agreement."
Article 6 (1) requires EU vessels to "comply with Moroccan laws and regulations governing activities in the [fishing] zone, unless otherwise provided"; and Article 6(2) requires EU vessels to "cooperate with the Moroccan authorities responsible for monitoring, control and surveillance."
Such interference in the waters adjacent to Western Sahara - a non-self-governing territory under military occupation - is intended to be 'legally' justified by the relevant ad hoc oral statements in the draft exchange of letters (paragraph 2), which forms an integral part of the agreement:
"The Fisheries Agreement is concluded without prejudice to the respective positions of the parties:
- for the European Union, the references in the Fisheries Agreement to Moroccan laws and regulations are without prejudice to its position with regard to the state of the Non-Self-Governing Territory of Western Sahara, the adjacent waters of which form part of the fishing zone defined in Article 1(h) of the Fisheries Agreement, and to its right to self-determination;
- for the Kingdom of Morocco, the Sahara region is an integral part of the national territory over which it exercises full sovereignty [!] in the same way as for the rest of the national territory. Morocco considers that any solution to this regional dispute must be based on its autonomy initiative". [¡!, added]
This shows once again that the position of the Kingdom of Morocco is in direct violation of international law, without this apparently representing any problem for the EU.
Article 2 of the draft protocol refers to the same fishing zone as defined in the draft agreement:
"The purpose of this protocol is to implement the provisions of the Fisheries Agreement, and in particular to lay down the conditions of access by Union vessels to the fishing zone defined in Article 1(h) thereof (...)."
And the Legal Service itself puts it very clearly:
"Since the draft agreement defines the fishing zone as a geographical area which clearly includes the waters adjacent to Western Sahara and explicitly adds that the latter waters are included therein, the Legal Service sees no possibility of interpreting the scope of the draft Agreement as not including those waters". [Something that is quite obvious].
And since the Legal Service understands that the assessment it is being asked to make is whether these waters are included in a manner that is compatible with the jurisprudence of the ECJ and what it considers to be required by jurisprudence and international law in order to extend an agreement with Morocco to the territory of Western Sahara, it states that:
"The judgments of the [EU] Court do not specify how the consent of the people of Western Sahara should be obtained. However, on the basis of the international legal doctrine and the opinion of the Advocate General in Case C-104/16 P, it can be concluded that such consent cannot be assumed without prior consultation of the people of Western Sahara or their representatives. " [Emphasis added]. And the Legal Service adds that "the requirements for a new Fisheries Agreement and protocol with Morocco to cover the waters adjacent to Western Sahara are the same.”
Despite what was said in the previous paragraph, the Legal Service then makes a heroic attempt to achieve something like squaring the circle, when it 'explains' how it has 'solved' [circumvented] the legal requirement of consulting the Saharawi people or their legitimate representative and obtaining their consent:
II. Considerations regarding consultation and consent of the people of Western Sahara.
In its opinion, the Legal Service states that the main essential condition required is adequate consultation with the people of Western Sahara as a means of determining their consent. But as the Legal Service itself pointed out in a previous paragraph, 'on the basis of international legal doctrine and the opinion of the Advocate General in Case C-104/16 P, it can be concluded that such consent cannot be assumed without prior consultation of the people of Western Sahara or their representatives. " (Emphasis added).
What the Legal Service does not say in its repetitive and contradictory argumentation is that the means to determine the consent of the Saharawi people is none other than the obtaining of such consent by the legitimate representative of the Saharawi people, the Polisario Front, since until now the people of Western Sahara have not been allowed to hold the referendum on self-determination, as established by multiple resolutions of the UN, the EEC/EU and the OAU/AU. Neither the EU nor the authorities of the Kingdom of Morocco have the competence to circumvent, with euphemisms and fallacious arguments, this requirement of international law.
In addition, and regardless (!) of the failure to comply with this important requirement of International Law, it is worth highlighting the use of misleading or euphemistic terminology in the reasoning of the Legal Service, here and in the following lines: It is obvious that by consulting 'properly' specific respondents (not the people of Western Sahara), the desired response will be obtained, in accordance with the purpose pursued by the respondent, a deficiency, or simply manipulation, which is so often blamed on opinion polls (which have nothing to do with obtaining consent).
It should also be stressed that it is not a matter of 'determining' the consent of that people, but of obtaining it. And the Legal Service itself makes it clear that the Polisario Front, its legitimate representative, did not give its consent.
Having said that, it goes without saying that the Legal Service seeks to justify the non-consensual access to and use of the waters adjacent to Western Sahara: that "all reasonable and practicable measures" were taken (outside international law and in accordance with the will of the occupying power and the Commission / EEAS) "in the present context" (the illegal occupation by armed forces of a large part of the Non-Autonomous Territory of Western Sahara).
In this respect, the explanatory memorandum to the decision proposed to the Council to sign the draft Agreement explains that:
"[...] the Commission and the European External Action Service (EEAS) organised consultations with the relevant populations in Western Sahara to ensure that they could express their views on the extension of the partnership to the waters adjacent to Western Sahara and that they would benefit from the socio-economic impacts of the Fisheries Agreement in a proportionate manner; [...]The report concludes that the socio-economic impacts of the Fisheries Agreement will greatly benefit the populations concerned and that it will have a positive impact on the sustainable development of natural resources. Similarly, the socio-economic and political actors involved in the consultations were clearly in favour of concluding the Fisheries Agreement, despite the refusal of the Polisario Front and some other parties to participate in the consultation process, as a matter of principle. It can therefore be concluded that the Commission, together with the EEAS, took all reasonable and feasible steps in the present context to adequately involve the affected populations". [Emphasis added].
The 'current context', to which the Legal Service refers, is that of colonialism or recolonisation, alleged annexation and the systematic and unpunished violation of international law. Why shall the illegal status quo be maintained at all costs, as if there were no other possibilities? Did not the ECJ itself modify the "current context' of the previous fisheries agreement, clearly stating that it did not apply and could not be applied to the waters adjacent to Western Sahara? Is this not the reason why the EU has had to resort to a new Agreement, Protocol and Exchange of notes, which change 'the present context'? There is no reason to maintain an outdated, obsolete, unjust and illegal 'current context' that may ultimately lead to the resumption of war in the territory.
Why is the EU committed to maintaining 'the status quo'? Was this context not changed when most Member States recognised the Republic of Kosovo or when - modifying 'the current context' - the person of a third state was recognised as interim president or in charge? Do these recognitions not represent a change in the 'current context'? Does the EU and/or its Member States not have the capacity or autonomy to do so? Or is Morocco also in charge in Brussels? Is this the way, with this example, to stop the illegal annexation of the West Bank? And has not Brexit also meant a change in the 'current context'? And not exactly short-sighted or with irrelevant consequences: did Spain's (and other countries') entry into the EEC/EU or Spain's transition from dictatorship to democracy not also mean a change in the 'current context'? Don't laws, decrees and decisions of the EU Council in many cases modify the 'current context'?
Can't the civilised states of the EU explore other contexts more in keeping with the times when statues of slave traders, slavers and colonialists fall from their pedestal? Are they so blind and deaf? What more facts and figures need to be provided so that they can see, hear and listen to the cry of the inhabitants of Africa's last colony and the people all over the world who support this just and legitimate cause? Is it necessary to put on the table more deaths, more abuse, more tricks, more euphemisms, more injustices? How many more, which more?
In the end, what is clear is that what has interested the EU is to maintain 'the current context' unchanged and to achieve its objective at all costs: to gain access at any cost to the waters of a non-self-governing territory pending decolonisation under the conditions previously agreed with a strategic partner that breaches international law with impunity, laughs at respect for human rights (the basis of all EU agreements!) and has no sovereignty over these waters. And to that end, the Legal Service argues that the forms have been kept to the letter of the judgments of the ECJ.
Nevertheless, this statement by the Legal Service does not seem to coincide, at least, with the spirit of the TUJE's jurisprudence, since the 'new' Agreement merely reproduces 'the context' of the previous one, the status quo that is advantageous for Morocco and for the EU's commercial interests; the same dog with a different collar. And for this purpose, the rulings of the EU's High Court would be superfluous.
Contrary to what the Legal Service claims, there were and are several "reasonable and feasible" possibilities to overcome or modify 'the current context', i.e. the illegal status quo imposed by the force of arms. But the Legal Service has not taken the trouble to study them or to propose them (surely those were not the instructions received).
For example, and among other possible alternatives to explore: instead of denying the EU's supreme judicial authority, ask the Court for its opinion on how to 'determine' the consent of the people of Western Sahara -something that has already been established in many UN resolutions- and/or on the alleged compatibility of the new agreement with the Court's case law; or to establish diplomatic relations with the legitimate representative of the Saharawi people, the Polisario Front (PF), and then ask for its consent; or to establish with the PF some kind of agreement related or compatible with a certain (different) EU-Moroccan Fisheries Agreement; or to recognise the Saharawi Arab Democratic Republic (SADR) -as more than eighty countries have done- and to reach an agreement with its authorities.
In this connection, the then president of South Africa (2004), Thabo Mbeki-with much fewer powers and means than the EU-had the courage and moral and political consistency to address a letter to the king of Morocco, Mohammed VI, explaining the reasons why he considered it necessary for the Republic of South Africa to recognise the Saharawi Arab Democratic Republic (SADR)-as the previous president of South Africa, Nelson Mandela -in view of the obstacles the Alawite monarch was placing in the way of the Saharawi people's legitimate self-determination. Here are some extracts from the letter, which deserves to be read in its entirety:

The Government of Morocco (...) unequivocally intends to deny the people of Western Sahara their right to self-determination, contrary to both fundamental and inviolable international law and previous solemn commitments made by the Government of Morocco.
Morocco does not accept the Settlement Plan it had agreed to for many years, nor does it now accept essential elements of the Peace Plan.
This is an obvious attempt to deny the very right to self-determination, which the UN itself is bound by its Charter to defend and advocate, and which the people of Western Sahara have been trying to exercise for nearly two decades.
We continue to regret the fact that, because of the unresolved question of Western Sahara, Morocco cannot play its part in the renewal of our continent as an active and full member of the OAU and the AU.
We sincerely believed that, on the question of Western Sahara too, leaving aside the history of colonisation in that part of Africa, Morocco would remain faithful to its tradition of loyalty to the principle of self-determination for all peoples.
It is now quite clear that Morocco has no intention of respecting the right of the Saharawi people to decide their own destiny.
On the contrary, Morocco has decided unilaterally, without any consultation with the people of Western Sahara or respect for UN and AU resolutions, that everyone is obliged to accept a solution "consisting of an autonomy within the framework of Morocco's sovereignty."
The absurd impasse caused by the positions advocated by the Moroccan government has led to a situation in which any further postponement on our part in recognising SADR would inevitably turn into the abandonment of our support for the right of the people of Western Sahara to self-determination.
For us, not recognising SADR in this situation means becoming accomplices in denying the people of Western Sahara their right to self-determination.
In addition to the above, we will continue to support the efforts of the UN and the AU to enable the people of Western Sahara to exercise their right to self-determination, using all available and legitimate means at our disposal.
In the meantime, we will grant the Polisario Front all the rights and privileges due to all AU Member States, in the framework of the fulfilment of our obligations towards the AU and the peoples of Africa. (…)
And the Professor of Constitutional Law Carlos Ruiz Miguel has devoted an extensive work to explain the reasons for and advantages of an independent Western Sahara; advantages that have also been explained, more briefly and very recently, by Major General Jesús Argumosa Pila, former head of the Escuela de Altos Estudios de la Defensa of the CESEDEN (Centro Superior de Estudios de la Defensa Nacional, the main military teaching centre of the Spanish armed forces):
"With respect to the Western Sahara, the emergence of an independent and solid democratic state produces significant security advantages in the geopolitical environment of North and West Africa, as it constitutes a 'retaining wall' against Islamic Jihadism, facilitates the strategic balance of the region's powers, and increases the stability of our neighbouring security area, which is a national strategic objective."
Both the letter from former President Thabo Mbeki and the other two texts indicated are fully valid and should serve as a reflection for the authorities of the EU in general and of Spain and France in particular.
And should the Moroccan authorities, following this possible modification of the "current context", hinder the implementation of the agreement with the Polisario Front/SADR, preventing or hindering fishing in the waters adjacent to Western Sahara, the EU could -among other possible preventive or retaliatory measures- ensure respect -and also respect European law and international legality- by sending naval and/or airborne units, defence and protection units, and surveillance and security units against piracy to the area, as has been done in other not so distant cases (Horn of Africa, Gulf of Guinea, Turbot war, Perejil Island, etc.). ), to defend fishing activity and international law, and to protect the legitimate rights of the people of Western Sahara and, in this case, EU law as well. But, in any case, it is not my place to indicate or suggest to the EU what it should do. Here I am simply trying to refute certain arguments and fallacies of the Legal Service that lack rigour. There will probably be other possibilities, in addition to those indicated here, which could be studied and considered. The EU does not have to hold on to a certain 'context' that is immovable, unjust, illegal and contrary to the jurisprudence of the ECJ.
It should also be noted that according to the Legal Service, consultation is carried out with "the relevant populations" (?), not with the people of Western Sahara or their legitimate representative, the Polisario Front, as required by international law. For international jurisprudence (UN, OAU/AU, ECJ, Supreme Court of South Africa) it is irrelevant whether or not there are alleged 'benefits' or 'advantages'; what is relevant and required is consent, which, in this case, has not been obtained.
With respect to the alleged "benefits"-also legally irrelevant-as stated by the Legal Service, it seems obvious that the expenses or investments of the colonial powers (in this case, the authorities or the occupying state), in some way, will always "benefit" some segments of the population of the territory, in particular the Moroccan settlers themselves, the occupying forces and those who submit to and/or collaborate with the occupier. But that does not in any way imply that the person concerned, the real person, the legitimate representative of the Saharawi people, the Polisario Front, has given its consent, nor that the Saharawi people has been consulted. The alleged "benefit" in no way invalidates the essential requirement of the consent of the holder of the right to give or withhold such consent. In Law, the end does not justify the means, as the Legal Service, the Commission and/or the EEAS have sought to justify.
And the terminology used by the Legal Service contains a host of escapist euphemisms and, we reiterate, eludes the essential requirement of Polisario Front consent; euphemisms such as 'socio-economic and political actors', 'some other parties', 'all reasonable and feasible measures', 'current context', 'appropriate involvement', 'affected populations'. Nothing to do with the consent of the people of Western Sahara. The real "affected populations" are not those decided by the Moroccan authorities, the EU Commission and/or the EEAS, but the whole of the Saharawi people, deprived here and today of their legitimate and inalienable right to self-determination, of the permanent right to their natural resources and even dispossessed and expelled from a large part of their own territory.
Furthermore, the report included in the Commission staff working paper, inter alia, concludes that:
"With regard to the consultations, the first part, consisting of consultations conducted by the Moroccan authorities, revealed a broad consensus in support of the new sustainable fisheries partnership, including its extension to the waters adjacent to the territory of Western Sahara.It should be noted that this support was expressed unanimously by the elected representatives of the Regional Councils of El Ayoun-Sakia El Hamra and Dakhla-Oued Eddahab, all of Saharawi origin according to the Moroccan authorities, and to a very large extent by the Chambers of Maritime Fishing and the Committee of Foreign Affairs, Borders, National Defence and Occupied Moroccan Territories [!] of the Chamber of Councillors of the Moroccan Parliament.” [Emphasis added].
Evident. All that remains is for the Moroccans themselves and their official bodies to be against including the waters of Western Sahara, when it is the Moroccan regime itself that is proposing the fisheries agreement and the illegal occupier of Western Sahara!
Furthermore, although this may divert us from the central question (the true jurisprudence of the ECJ and the consent of the Saharawi people), let us point out in passing that what we are dealing with, in any event, and at most, are "elected representatives of Saharawi origin", who are not representative in any way in international law and who have come from illegitimate, irregular and forced elections-after more than forty-five years of military occupation-by legislation imposed by the occupier on a part of the Non-Autonomous Territory. And leaving aside-which is already a lot to leave out-the fact that the Saharawi people have only one legitimate and genuine representative, the Polisario Front, the primary requirement remains unfulfilled: the consent of the Saharawi people, through their legitimate representative recognised by the United Nations; in the same way that the SADR has been recognised by over eighty countries and is a founding member of the African Union, a continental organisation from which only Morocco has been absent.
As for the alleged 'representativeness' of Moroccan bodies and institutions or those 'controlled' by the Moroccan occupier to give their consent to access to the waters adjacent to Western Sahara, it is absolutely null and void for the purposes of the requirement of the consent of the Saharawi people (not of the Moroccan authorities).
"As for the results of the consultations carried out by the EEAS [European External Action Service] and the Commission, there was very strong support for the extension of the EU-Morocco Fisheries Partnership Agreement (FPA) to the waters adjacent to Western Sahara, although several actors made observations and recommendations on certain aspects of the implementation of the fisheries agreement in order to maximise the benefits for the local population. [Emphasis added].
Once again, as regards these sui generis (and legally irrelevant) 'consultations' carried out by the EEAS, it must be repeated that the relevant question is not the alleged potential 'benefits', but the consent of whoever is entitled to give or withhold it; nor is the relevant population 'the local population' (largely Moroccan occupation forces and settlers illegally transferred to the Non-Self-Governing Territory, in violation of the Geneva Convention) but the people of Western Sahara. As for the expression "it has been possible to ascertain", who really ascertained the will for freedom, independence and support for the Polisario Front was the UN Mission that visited the territory in May 1975, when it was still officially a Spanish province, Province 53. It is unheard of that the Commission, the EEAS and the Legal Service should hide this fundamental fact, contained in the relevant UN texts, and that they should try to impose their particular 'statement' -without any legal basis- over the historical, genuine and legal statement of the UN. The UN visiting Mission noted in situ the will for self-determination and independence of the Saharawi people, a will that it has demonstrated on numerous occasions: in its struggle against Spanish colonialism, in the cry of Zemla in 1970, in the creation of the Polisario Front, in the proclamation of SADR and the Constitution of the Saharawi State, in the lifting of the Dignity Camp (Gdeim Izik), in its permanent struggle against the Moroccan invader, in the number of sham trials promoted by the occupier, in the suffering of disappearances, arbitrary detentions, torture, sentences of life imprisonment.…
On the other hand, the Commission and the EEAS should be congratulated for having managed -we presume- to enter the occupied territories of Western Sahara to carry out such 'consultations', given that the Moroccan occupation authorities prevent access to the territories and expel without contemplation - sometimes without even letting them get off the plane - all those MEPs, national deputies, jurists, lawyers, international observers, journalists, members of NGOs, students, artists, simple citizens who try to enter Western Sahara to learn about the reality on the ground, in view of the severe information and media blockade imposed by the occupation authorities and the directives given by the pro-Moroccan lobby to "encapsulate the Sahara issue." Morocco went so far as to expel, with impunity, 73 members of the UN/MINURSO, and the UN Secretary General himself, Ban Ki-moon, was forbidden access to the Occupied Territories and, moreover, the Moroccan authorities organized an unspeakable campaign of personal and institutional smear campaign for having mentioned the word "occupation" during his visit to the Saharawi refugee camps in Tindouf (Algeria). Without a doubt, this freedom of access to certain community officials of the EEAS is the result of connivance with the occupation authorities. A further observation of the authoritarian, antidemocratic, discriminatory and reactionary policy displayed by the Moroccan authorities and silenced by the EU authorities.
"No specific human rights questions were raised by the consulted parties in relation to fisheries collaboration and no grounds for discrimination on ethnic grounds were found. The interlocutors welcomed the existence in the SFPA and the protocol of a general human rights clause and specific provisions on non-discrimination and labour rights, in accordance with ILO standards. For their part, the Polisario Front and several other actors sensitive to their cause refused to participate in the consultation process without presenting any arguments against the new SFPA 'Sustainable Fisheries Partnership Agreement'. [Emphasis added].
Now, this is pure fiction: the Saharawis are delighted with the military occupation of their territory, the plundering of their natural resources and celebrating Morocco's respect for human rights! And the Commission and the EEAS are so happy. The issue of "interested parties consulted" has already been clarified above. As far as human rights are concerned, the Saharawi people not only "ask" about the permanent and systematic violation of human rights in the occupied territories of Western Sahara - starting with the main right: the denial, by the Moroccan establishment, of their inalienable right to self-determination and independence, but they have been continuously denouncing this flagrant violation in all forums and before the international community and have been carrying out continuous demonstrations of protest and demand for their rights. And when they demonstrate even for mere labor issues (“in accordance with ILO standards”), "they are brutally repressed and even sentenced to life imprisonment." (Gdeim Izik). It seems incredible that the Commission and the Legal Service shamelessly omit these constant denunciations and this systematic and brutal repression.
There are plenty of documents on this subject. The recent statement by Colin O'Brien before the United Nations Human Rights Council in Geneva, stating that "the illegal exploitation of the natural resources of Western Sahara by Morocco and some of its partners consolidates the occupation and prolongs the suffering of the Saharawi people" serves as a testimony, as a snapshot and as an example for the Spanish and EU rulers. And in his response to the fallacy and false and unfounded statements of the representative of Morocco, O'Brien added: "Namibia, as a country that has gone through the same experience, is determined to be on the right side of History in this matter, and will not allow the suffering of occupied peoples like Palestine and Western Sahara", since their fundamental and inalienable rights to self-determination and independence are enshrined in the principles of international law. The Namibian diplomat also explained that his country is not among the parties that agreed to deprive and violate the rights of the Saharawi people and illegally exploit their natural resources. Addressing the Moroccan ambassador, he said that the continuation of human rights violations, including the illegal exploitation of Western Sahara's resources, in addition to supporting the continued illegal occupation of the territory, prevents any peace plan due to the economic interests of the Moroccan occupation and its partners. [Emphasis added].
On the violation of human rights in the Moroccan-occupied Western Sahara, Aminetu Haidar (Alternative Nobel Prize 2019, for her selfless dedication to the defense of the rights of the Saharawi people) also testified recently in Geneva, at the 43rd session of the UN Human Rights Council, mentioning some of the methods of the Moroccan regime against Saharawi citizens: "torture, cruel and degrading treatment, arbitrary arrests, false accusations, expulsion from work, forced deportation to the cities of Morocco, defamation by the Moroccan press", and denouncing that while these violations are taking place, "the access of international observers to the occupied territory is impossible." And he said it precisely on February 28, the same day that Morocco prevented a commission of Catalan parliamentarians from entering El Aaiún and three days after the expulsion of an observer from the General Council of Spanish Lawyers.
Talking about human rights in Moroccan-occupied Western Sahara is not just a simple irony, but an enormous folly, a delusion, an absolute lack of sanity. Not only is respect for human rights conspicuous by its absence, but it is also violated with total impunity. We do not know what is worse, if living in the refugee camps in Tindouf, in an unlivable desert, in the middle of nowhere, lacking resources and with suffocating heat, or resisting in that open-air prison that Morocco has turned into the occupied territories, where the occupation forces systematically perpetrate all kinds of abuses against the defenseless Saharawis.
It is hard to believe that the EU-Morocco Fisheries Agreement is apparently conditioned by a clause on respect for human rights. It looks very nice on paper, but it's not worth the paper it´s written on, it totally fails to comply. And that non-compliance should be reason enough for the EU to suspend the application of the Agreement. What else is that clause for?
Alternatively, the EU has in its hand an important tool to put pressure on Morocco and force its authorities to treat the Saharawi political prisoners as human beings, rather than as mangy dogs to be extinguished. The point is that the EU does not want to know about all this or, even worse, looks the other way, as does the establishment press, the European, civilized, independent, global and politically correct press, for whom the injustices perpetrated with impunity and permanently are not 'news' to amuse civilized Europeans.
The most pathetic case is that of the Group of Prisoners of Gdeim Izik, tried in several sham trials, without evidence and under torture, with serious procedural "irregularities", and sentenced to 30 years in prison, some, and others to life imprisonment, subjected to all kinds of abuse and mistreatment, prolonged isolation, more than a thousand kilometers from their families, impoverished, sick and degraded, at the mercy of their jailers.
The 19 Saharawi political prisoners of the Gdeim Izik group are an example of Morocco's absolute disregard for the United Nations Human Rights Mechanisms (the Committee Against Torture, CAT) and the lack of independence of the CNDH (Moroccan National Council for Human Rights) as an alleged mechanism for the prevention of torture. The cases of Saadoni, Naama Asfari, Abdallah Abbahah, Neama Abdi Sid Ahmed, Sidahmed emjeyd, Houcein Zawi or Ali Saadoni, to name a few, are paradigmatic and very worrying.
But they are only the tip of the iceberg of the cruelty, revenge and persecution to which the Saharawi people are subjected, subjected to a kind of sadistic extermination, slow and invisible to those who do not want to see it, but who heroically resist the invader and maintain the banner of their dignity and their inalienable rights above the adversity, torture and outrages to which they are unjustly subjected.
It is these prisoners - and not a paper clause - who should attract the attention of the civilized EU - of high values and principles - to whom it should pay full attention in this 'current context', because they are the reflection, precisely, of the EU's connivance with the Moroccan occupier, embodied in the Fisheries Agreement. The EU finances Morocco on the theoretical and paper basis of respect for human rights. But this funding - as the European Court of Auditors own report shows - is far from fulfilling its function.
The Moroccan National Council for Human Rights (CNDH), presented as the EU's interlocutor on human rights issues and for which the EU has paid and is paying, and which Morocco has sought to present as the 'Monitoring Mechanism against Torture' - a poor copy of the Ombudsman in Europe - is neither independent nor impartial. It serves exclusively as a cover for receiving EU funding. It does not investigate the violations perpetrated, the torture inflicted on the Saharawi political prisoners, their complaints of mistreatment and medical neglect, for denial of all rights.
Some prisoners who have dared to denounce, as they have been able to, these facts before the UN Committee Against Torture (CAT), have been subjected to new reprisals because of this, for exercising their rights recognized by International Humanitarian Law, subjected to new punishments, prolonged isolation, not being visited by their relatives, not receiving medical or legal attention ...
And in the cases where the CAT has decreed the adoption of urgent measures to care for these prisoners, their jailers, the authorities and the Moroccan CNDH have turned a deaf ear. And despite this, and the blessed paper clause in the Fisheries Agreement and its Protocol, EU funding continues to flow, as if nothing had happened, while lawyers are not allowed to meet the prisoners they claim to be protecting, as the lawyer Maître Olfa Ouled has denounced.
What does the EU know about all this? What does the EU want to know? How long will the EU keep its eyes closed? At the very least, it could make use of the human rights clause - so vaunted by the Legal Service - embedded meaninglessly, in the EU-Morocco Fisheries Agreement. Surely, the ECJ will have something to say about this, just as it deals with banking abuses.
"Finally, it should be noted," continues the Legal Service, "that the EU-Moroccan Fisheries Partnership Agreement does not prejudge the EU's position on the political situation in Western Sahara and the UN-led process. The EU supports the efforts of the United Nations to find a just, lasting and mutually acceptable political solution which will provide for the self-determination of the Western Sahara in the context of arrangements consistent with the purposes and principles of the Charter of the United Nations". [Emphasis added].
It is not that the Agreement does not "prejudge", but on the contrary, in connivance with the Moroccan regime, it contributes to continuing the subjugation and subjecting the people of Western Sahara to Morocco's annexationist pretensions, whose government this Agreement serves to further justify its alleged territorial sovereignty over the non-self-governing territory of Western Sahara pending decolonization, as French officials who direct and control the Legal Service are well aware, and make this clear in paragraph 2 of the Exchange of Notes, which is an integral part of the Fisheries Agreement. And what is even more serious, encouraging war in the region once again. Because that is what we are talking about, the implications and consequences of a fraudulent and prevaricating legal opinion. Its perpetrators are not put in prison, tortured, expelled from their land, or bombarded with napalm and white phosphorus. No, they get to walk away scot-free and a thick veil is unfurled.
With its attitude and behaviour, the EU gives wings to Moroccan expansionism, instead of demanding Morocco comply with international law and the EU itself. This is not how you contribute to peace in the region, quite the contrary.
The EU could and may exclude Western Sahara from its Fisheries Agreement with Morocco, as the US, Norway or Iceland have done in their trade agreements with the Kingdom of Morocco. The systematically deaf, blind and mute attitude of the EU in relation to the permanent violation of human rights in occupied Western Sahara cries out to the heavens.This is by no means the way to support "the efforts of the United Nations to find a just, lasting and mutually acceptable political solution that will allow for the self-determination of Western Sahara", but rather the opposite, a clear interference in favor of the executioner and occupier, to the detriment of the victim and occupied, the Saharawi people.
And it must be clear that what is hidden under the expression "political situation in Western Sahara" is nothing other than the fait accompli, the accomplished fact of a warlike aggression, the invasion and military occupation by the Kingdom of Morocco. There are too many euphemisms, distortions and conveniently manipulated silences. This behavior of the EU, consciously neglecting the jurisprudence of the ECJ and acting in collusion with those who violate international law with impunity, instead of demanding respect for it, leaves very badly the very principles proclaimed in the Treaty of the Union and presumably assumed by all member States, to which it is legally incumbent to apply the jurisprudence of the ECJ, having to abide by the consequences if they do not do so, as in the case here exposed of Western Sahara.
It is also clear that, by concluding a Fisheries Agreement with Morocco covering the waters adjacent to Western Sahara, the EU is doing a disservice to the (dubious) efforts of the UN to find a solution to the conflict, since precisely this Agreement serves it and is used by Morocco to 'demonstrate' its sovereignty over the occupied territory and thus proclaim it urbi et orbi, precisely when the UN Secretary General, António Guterres, has called for the eradication of colonialism "once and for all".
So the argument of the Legal Service is fallacious, cynical, misleading, allegedly an act of prevarication and contempt. It is also dubious and self-serving to use the expression "(...) acceptable to allow for the self-determination of Western Sahara in the context of agreements compatible with the purposes and principles of the Charter of the United Nations". What is this "in the context of compatible agreements?" It seems that the Legal Service, eluding all jurisprudential support, considers itself competent and capable of foisting upon the UN Charter nothing less than the underlying interests of those who trade in the life of the Saharawi people, their legitimate rights and the violation of international legality. Undoubtedly, it will be again the ECJ who will be able to clarify this situation, not a simple citizen who cries out for the obvious.
The Legal Service considers that, according to "the documents submitted to the Council, all reasonable and practicable steps were taken to ascertain the consent of the people of Western Sahara to the draft Agreement and Protocol through consultation with the representative of that people" (sic!). This is a crude falsehood ("to the representative of that people"!) and a clear contradiction with what the Legal Service itself has stated above, confessing that it has had to "determine" (but not "obtain", and even less so from its legitimate representative) the consent of certain Moroccan entities and bodies; not at all of the Saharawi people: not a single Saharawi organisation has taken part in this farce of "consultation"; not even the main Moroccan human rights organisation, the AMDH; there is a reason for that. In this respect, we have already pointed out above possible reasonable and feasible measures to be adopted (as they have been for over 80 countries), which have not been considered by the Commission/EAE. It is another matter that they are not 'interested' in considering them; and that the instructions received are very different.
Let us recall that Morocco - always so ... respectful of legality - suspended formal political dialogue with the EU after the European Court of Justice ruled that Western Sahara was not part of its fisheries and agriculture agreements with the EU; and that, despite this, in reciprocity ... "the Commission continued to provide budgetary support [hard cash] during the suspension period, which lasted until 2019," as the devastating European Court of Auditors' 2019 report states.
We are unaware of those documents that the Legal Service claims to have submitted to the Council to state that "all reasonable and feasible measures were taken (...)".
What is public knowledge is the 'warning' (read threats) of the Moroccan authorities to the ruling of the ECJ denying the applicability of the Fisheries Agreement to the separate and distinct territory of Western Sahara and the immediate 'availability' of the EU High Representative for Foreign Affairs, Federica Mogherini, to 'settle' the matter ("we will find a technical solution") in accordance with the expansionist and annexationist wishes of Morocco, ignoring the jurisprudence of the ECJ and international legality.
If the United States, Norway and Iceland have excluded Western Sahara from their respective agreements with Morocco, can't the EU do the same, instead of tailing Moroccan expansionist pretensions and bypassing the jurisprudence of the ECJ and international law? Don't you have enough independence to do so?
In other words, if it is legally unfeasible for the EU to obtain the consent of the Saharawi people, through their legitimate representative, the Polisario Front, leave the waters adjacent to Western Sahara (from which more than 90 percent of the catch is taken) out of the Fisheries Agreement, instead of juggling things or pretending to square the circle in both a fraudulent and incoherent manner. The end (access to Saharan waters) cannot justify the means (violation of ECJ jurisprudence and international law). Once again, it is not a question of "determining" the consent of the people of Western Sahara, but rather of obtaining it. And it has not been obtained. The Polisario Front has publicly and repeatedly warned that it will not accept any solution that does not guarantee the right of the Saharawi people to self-determination and independence, and that it rejects the inclusion of Western Sahara in the renegotiation of the EU-Moroccan Fisheries Agreement.
It is not true, we repeat, that "all reasonable and feasible measures in the present context" have been taken, as noted above. First, "the current context" is that of the illegal Moroccan military occupation, considered as such and condemned by the relevant UN resolutions. And the EU would not have to get into that "context", assume it and become an accomplice to it. And secondly, among the 'reasonable and feasible' measures, is the establishment of high-level relations with the legitimate Saharawi authorities, if not the recognition of the Saharawi Arab Democratic Republic (SADR), which has more than four decades of successful existence, consolidated institutions, is a founding member of the African Union (AU) and has been recognized by more than eighty countries.
Instead, the EU boycotts the people of Western Sahara and their legitimate authorities and humiliates itself in the face of Moroccan annexationist pretensions, even when its own MEPs are prevented from entering occupied Western Sahara and Morocco expels them without any consideration, as it does many other European elected representatives, jurists, journalists, observers and human rights defenders, without the EU institutions being impressed.
The Legal Service's assessment is that "the support expressed for the draft Agreement and Protocol seems to reflect that they would bring benefits to the people concerned and ensure sustainable exploitation of natural resources. [Emphasis added].
Once again: it is not about the alleged "benefits", but about the "consent"; and it is not about "the persons concerned" or the "affected populations", but about the interests and rights of the Saharawi people, legally and legitimately represented by the Polisario Front.
Those who have expressed their support - according to the document of the Legal Service - to the draft Agreement and Protocol are the Moroccan organizations and entities (even the Moroccan Ministry of Agriculture and Maritime Fishing!) or those under the control of the occupation authorities, not the genuinely Saharawi ones. Was it also necessary to 'consult', even, the mentioned Moroccan Ministry, which is a proposing party of the Fisheries Agreement, following the mandate of the Palace? This is yet another example of cynicism, legal fraud and the tricks used to somehow make the Fisheries Agreement possible.
And already put to 'consult', let's say that it has not been 'consulted' -although it would also be legally irrelevant, but it serves to highlight the partiality of the Legal Service or the instructions received by it- to international organizations -some with observer status at the UN ECOSOC- or to the hundreds of Spanish associations in solidarity with the Saharawi people, grouped and represented by the Coordinadora Estatal de Asociaciones Solidarias con el Sáhara, CEAS-Sáhara, given that Spain is de jure the administering power, a social and legal state (rule of law) with historical, legal and ethical obligations to the Saharawi people and the international community.
III. Regarding the Moroccan claims of sovereignty over Western Sahara, the Legal Service says:
To comply with the jurisprudence of the Court of Justice, it is also essential that the manner in which the waters adjacent to Western Sahara are included in an agreement with Morocco, it does not amount to recognition of Moroccan sovereignty over Western Sahara.
In this regard, the fishing zone is defined in the draft Agreement without any reference to Moroccan sovereignty or jurisdiction, unlike the provisions of the previous Fisheries Agreement, which applied to "the territory of Morocco and the waters under Moroccan jurisdiction" and "Moroccan fishing zone", defined as "the waters falling within the sovereignty or jurisdiction of the Kingdom of Morocco".
Furthermore, the draft exchange of notes explicitly confirmed that the draft Agreement is without prejudice to the respective positions of the parties on Western Sahara and that, for the Union, references in the Fisheries Agreement to Moroccan laws and regulations are without prejudice to its position on the status of the non-self-governing territory of Western Sahara and its right to self-determination.
Therefore, the draft agreement, including the exchange of notes, in no way constitutes recognition by the EU of any Moroccan claim to sovereignty over Western Sahara and its adjacent waters. It simply reflects that Morocco de facto controls access to these waters and that fishing there cannot take place without the agreement of the Moroccan occupation authorities. [Emphasis added].
In other words, if the previous fisheries agreement flagrantly violated international law and unduly attributed the waters of Western Sahara to Moroccan jurisdiction or sovereignty, now, in the new agreement, the EU “¡simply!” accepts the de facto military occupation of a foreign power and negotiates with it the illegal and illegitimate plundering of another's colonial territory, also denying de facto the right to self-determination, submitting to "the Moroccan occupation authorities, who control access to these waters".
The EU, in connivance with the Moroccan occupation authorities, is interested exclusively, and at any price, in "access to those waters", disregarding any other consideration, such as international legality, the illegal Moroccan military occupation or the denial of the fundamental and inalienable right of the people of Western Sahara to self-determination and the permanent right to their natural resources. And in order to achieve this objective, it considers it sufficient not to make "any reference to Moroccan sovereignty or jurisdiction", as if by covering its eyes this illegal colonial reality and its extremely serious and intolerable consequences in many areas ceased to exist; among others, the impoverishment and unspeakable suffering of the Saharawi people, the plundering of their natural resources, the structural violation of human rights inherent in the occupation, disappearances, torture and imprisonment, sham trials of political prisoners, life sentences, the loss of entire generations, exile and diaspora.
Who are you trying to fool? It is obvious that this shameless way of proceeding by the EU merely entrenches Morocco's annexationist pretensions through the fait accompli, as the occupying government wishes, further complicating the situation and making the long, tortuous and manipulated process of finding a solution under the auspices of the United Nations, already sufficiently torpedoed by France, even more difficult.
As Katja Kipping, co-president of the German party Die Linke and member of parliament in the Bundestag, rightly pointed out recently, "without Europe's support, Morocco will not be able to continue violating human rights in Western Sahara". But this has not been a matter of interest or consideration by the Legal Service. There is an unjust and illegal reality, but as the EU is not interested in taking it into consideration (because there are other 'more important' interests), it 'simply' takes a tortuous detour and 'accesses those waters' anyway, in any case, by a mere terminological device; to the satisfaction of Morocco, the EU's "strategic partner", which can thus plunder or benefit-as does the EU itself-from the fishing wealth of Saharan waters with total tranquility and impunity, without getting its hands dirty, without charges of conscience and with the heads of its rulers held high, as if it were the dogma of the immaculate conception, without breaking or getting dirty. A cynical position that undermines the credibility of the EU institutions, their proclaimed values and principles, and the honourability of the rulers of the Member States. As the writer and journalist Géraldine Schwarz recently pointed out, "if European countries want to have normative influence in the world and reaffirm the values of an open and democratic society in the face of authoritarian models, the former colonial powers must assume their historical responsibilities".
In order to try to be "convincing", the Legal Service needs to reiterate it time and again, so as to make the message of its account credible and reassuring to the most sceptical Member States and for the Council to finally take the appropriate decision: to access above all the waters adjacent to Western Sahara and appropriate, without the consent of their legitimate owners, their marine wealth, allegedly without contradicting the jurisprudence of the ECJ, the spirit of it, or international legality.
These are the justifications:
This position of the Union is also reflected in the proposals for decisions [to the Council] on the signing and conclusion of the draft Agreement, which contain considerations which read as follows:
"The Union does not prejudge the outcome of the political process on the final status of Western Sahara being conducted under the auspices of the United Nations, and has consistently reaffirmed its commitment to the settlement of the dispute in Western Sahara, which is currently listed by the United Nations as a non-self-governing territory and administered primarily by the Kingdom of Morocco. It fully supports the efforts of the United Nations Secretary-General and his personal envoy to assist the parties to achieve a just, lasting and mutually acceptable political solution, which will provide for the self-determination of the people of Western Sahara as part of arrangements consistent with the purposes and principles established in the Charter of the United Nations and embodied in the resolutions of the United Nations Security Council, [...]. [Emphasis added].
What is the EU's genuine 'commitment' to the resolution of the dispute in Western Sahara? To further entrench the Moroccan claims by including the waters adjacent to Western Sahara in the fisheries agreement without the consent of the Saharawi people and by distorting - at the very least - the spirit of the jurisprudence of the ECJ because anything else would not be 'realistic' or 'pragmatic', as the Moroccan establishment and its supporters in the EU claim? The Kingdom of Morocco administers "mainly" the non-self-governing territory, first, because Spain, the de jure administering power, failed to fulfil its obligations to the Saharawi people and to the international community, obligations which remain in force and from which all democratic governments seek to escape; and, secondly, because Morocco, in collusion with the United States and France, has carried out an illegitimate invasion and military occupation, a war of aggression and extermination and the continuous illegal transfer of Moroccan settlers in order to completely alter the demographic structure of a non-self-governing territory over which it has no territorial sovereignty. These are acts of aggression which the EU refuses to condemn consistently with its proclaimed values and principles.
But the de jure administering power remains Spain, whose government is today being asked by citizens around the world to fulfil its historical commitments and legal obligations, as the so-called 'Madrid Tripartite Agreements' (14/11/1975) are illegal and were declared null and void by the UN (Corell Opinion, 2002): "The Madrid Agreement did not transfer sovereignty over the Territory nor did it confer on any of the signatories the status of administering Power, a status that Spain, on its own, could not transfer unilaterally. The transfer of administrative authority over the territory to Morocco and Mauritania in 1975 did not affect the international status of Western Sahara as a non-self-governing territory."
It is more than evident that the EU does not 'help the parties', as the Legal Service claims, but rather helps and empowers a single party, the aggressor, Morocco, in spite of and against the jurisprudence of the ECJ and international legality, trampling on the legitimate rights of the Saharawi people and using them as a bargaining chip for the geostrategic and economic interests of the EU and Morocco; interests that should be settled in other areas, at least, by enforcing international legality on the EU's partners, also from the point of view of the opinion or suggestions and distorted accounts of the Legal Service.
And it continues to manipulate language. Because, indeed, the UN has proclaimed, time and again, the right to self-determination of the people of Western Sahara; but not, as the Legal Service says, 'as part of agreements consistent with... ' Is this expression suggesting or alluding to the alleged coherence of the EU-Morocco Fisheries Agreement with UN jurisprudence on the decolonisation of colonial countries and peoples and the permanent right of these peoples over their natural resources? On the other hand, why does the EU not base itself on the jurisprudence of the ECJ and the UN resolutions precisely in order to leave the waters of Western Sahara out of its agreement with Morocco, as the USA has done in its free trade agreement (FTA) with Morocco? Why this absolutely biased, partial, fraudulent and one-sided use of legal bases by the EU?
And yes, these are 'objectives and principles enshrined in the Security Council resolutions', but which the EU circumvents and none of them in the case of the aforementioned Fisheries Agreement.
“…there is nothing in the terms of the Agreement to suggest that it would recognise Morocco's sovereignty or sovereign rights over Western Sahara and its adjacent waters. The Union will also continue to intensify its efforts in support of the process, initiated and carried out under the auspices of the United Nations, to resolve the dispute peacefully". [Emphasis added].
