MADDE 22 – (1) Gümrük mevzuatı kapsamında gümrük işlem ve uygulamalarının kolaylaştırılması amacıyla belirlenen basitleştirilmiş usul, uygulama ve yetkilerden yararlanmak üzere 23 ve 24 üncü maddelerde belirlenmiş koşulları sağlayan, Türkiye Gümrük Bölgesinde yerleşik gerçek ve en az iki yıldır fiilen faaliyette bulunan ve tüzel kişilere talep etmeleri halinde A, B veya C sınıfı onaylanmış kişi statüsü verilir.

MADDE 1 – 7/10/2009 tarihli ve 27369 mükerrer sayılı ResmîGazete’de yayımlanan Gümrük Yönetmeliğinin 22nci maddesinin birinci fıkrasına “Türkiye Gümrük Bölgesinde yerleşik” ibaresinden sonra gelmek üzere “ve en az iki yıldır fiilen faaliyette bulunan” ibaresi eklenmiştir.
MADDE 22 – (1) Gümrük mevzuatı kapsamında gümrük işlem ve uygulamalarının kolaylaştırılması amacıyla belirlenen basitleştirilmiş usul, uygulama ve yetkilerden yararlanmak üzere 23 ve 24 üncü maddelerde belirlenmiş koşulları sağlayan, Türkiye Gümrük Bölgesinde yerleşik gerçek “ve en az iki yıldır fiilen faaliyette bulunan ve tüzel kişilere talep etmeleri halinde A, B veya C sınıfı onaylanmış kişi statüsü verilir
MADDE 77
(7) Özet beyan eksiklik veya fazlalığının eşyanın tabiatı icabı ek-11’deki oranlarda olduğunun anlaşılması halinde, özet beyan eksiklik veya fazlalık takibatı yapılmayarak işlemler gümrük idaresince tespit edilen miktar üzerinden yapılır ve ceza uygulanmaz.
MADDE 2 – Aynı Yönetmeliğin 75 inci maddesinin yedinci fıkrası aşağıdaki şekilde değiştirilmiştir.
“(7) Dökme gelen eşyada ortaya çıkan eksiklik ve fazlalıklar ile ilgili olarak, Kanunun 237 nci maddesi uyarınca Bakanlar Kurulu kararı ile belirlenen farklılıklar için özet beyan eksikliği veya fazlalığı takibatı yapılmaz. Özet beyan eksikliği veya fazlalığı takibatı gerektiren durumlar için takibat ve varsa cezaî işlem, eksiklik veya fazlalığın tamamı için değil, Bakanlar Kurulu kararı ile belirlenen takibat gerektirmeyen farklılıkları aşan kısmı için uygulanır. Takibata konu olmayan miktar için herhangi bir cezaî işlem uygulanmaz. Ek-11’de yer alan fire oranları, özet beyan eksikliği veya fazlalığı takibatlarında dikkate alınmaz.”
MADDE 86 – (1) Geçici depolanan eşya, sahipleri veya bunların temsilcileri tarafından verilen usulüne uygun beyanname ile gümrükçe onaylanmış bir işlem veya kullanıma tabi tutulur.
(2) Kanunun 46 ncı maddesi ile ve bu Yönetmeliğin 76 ncı maddesinde belirtilen süreler içerisinde gümrükçe onaylanmış bir işlem veya kullanım belirlenerek buna ilişkin işlemlere başlanmayan eşya hakkında herhangi bir adli veya idari takibat olmaması halinde tasfiye hükümleri uygulanır. Gümrük idareleri, bu tür eşyayı durumu belirleninceye kadar eşya sahibinin risk ve hesabına gümrüğün denetimindeki uygun göreceği bir yere sevk edebilir veya söz konusu eşya sahipleri hesabına geçici depolama yeri işleticisince antrepoya kaldırılabilir. Bu tür işlemlerin yapılması sırasında eşya hakkında tasfiye hükümlerinin uygulanmasına devam olunur.

MADDE 3 – Aynı Yönetmeliğin 86 ncı maddesine aşağıdaki üçüncü fıkra eklenmiştir.
“(3) Kara hudut kapılarında, gümrüklü sahaya giriş tarihinden itibaren Kanunun 46 ncı maddesi ve bu Yönetmeliğin 76 ncı maddesinde belirtilen süreler içerisinde gümrükçe onaylanmış bir işlem veya kullanım belirlenerek buna ilişkin işlemlere başlanmayan taşıtlar hakkında ikinci fıkra hükümleri uygulanır.”
MADDE 4 – Aynı Yönetmeliğin 169 ve 170 inci maddelerinin birinci fıkralarının (g) bentlerinde geçen “167 ncimaddesinin üçüncü fıkrası” ibareleri “167 nci maddesinin birinci fıkrasının (3) numaralı bendi” olarak değiştirilmiştir
Madde 171 “(4) Dâhilde işleme izni kapsamında, ithalatını müteakip, ihraç ürünlerinin elde edilmesinde kullanılmak üzere Türkiye Gümrük Bölgesine getirilen elyaf, iplik, ham ve mamul mensucat (astar dâhil) gibi temel tekstil hammaddeleri ile tekstil ve deri kimyasal maddeleri dışında kalan tela, etiket, düğme, fermuar, çıtçıt, rivet, askı, kuşgözü, şerit, kordela ve lastik gibi yardımcı maddeler gümrük idarelerine sözlü olarak beyan edilebilir.
MADDE 5 – Aynı Yönetmeliğin 171 inci maddesinin dördüncü ve altıncı fıkraları aşağıdaki şekilde değiştirilmiştir.
“(4) Dahilde işleme rejimine konu olan aşağıda belirtilen eşya gümrük idarelerine sözlü beyan edilebilir.
a) Dahilde işleme izni kapsamında, ithalatını müteakip, ihraç ürünlerinin elde edilmesinde kullanılmak üzere Türkiye Gümrük Bölgesine getirilen elyaf, iplik, ham ve mamul mensucat (astar dâhil) gibi temel tekstil hammaddeleri ile tekstil ve deri kimyasal maddeleri dışında kalan tela, etiket, düğme, fermuar, çıtçıt, rivet, askı, kuşgözü, şerit, kordela ve lastik gibi yardımcı maddeler,
b) Dahilde işleme izni kapsamında, tamir ve bakım işlemine tabi tutulacak gemilere ait malzeme ve ekipmanlar,
c) Dahilde işleme izni kapsamında, tamir ve bakım işlemine tabi tutulacak motorlu nakil vasıtaları, tarım makineleri ve bunların parçaları.”
“(6) Dahilde işleme izni kapsamında sözlü beyan, dördüncü fıkranın (a) bendinde yer alan eşyanın sadece Türkiye Gümrük Bölgesine girişinde kullanılabilir.”
Madde 172 "(ç) Dâhilde işlemede 1, 5, 6, 8, 22, 29, 31, 33, 36, 37, 41, 42, 52 ve 54 no.lu kutularının doldurulması zorunlu; 2, 14, 16, 30, 34, 40 ve 44 no.lu kutularının doldurulması ihtiyaridir. MADDE 6 – Aynı Yönetmeliğin 172 nci maddesinin ikinci fıkrasının (ç) bendi aşağıdaki şekilde değiştirilmiştir.
“ç) Dahilde işleme kapsamı geçici ithalatta (b) bendinde, dahilde işleme kapsamı ihracatta ise (a) bendinde yer alan alanlar doldurulur.”
MADDE 7 – Aynı Yönetmeliğin 197 nci maddesinin birinci fıkrasının sonuna aşağıdaki cümle eklenmiştir.
“Tahlil ücreti, eşyanın tahlil masrafları ile bu işlemler sonucu ortaya çıkan artık ve atıkların imha masraflarını da kapsar
Madde 332 (2) Geçici depolama yerine konulmadan gümrük antrepo rejimine tabi tutulacak eşya antrepo beyannamesinin tescilini müteakip antrepoya alınır
“Antrepo beyannamesinin, taşıtın antrepoya gelişini takip eden iki iş günü içerisinde tescil edilmesi gerekir. Gümrük idaresi, sürenin bitiminden önce eşya sahibi ya da taşıyıcı tarafından yapılacak yazılı ve gerekçeli talebe istinaden bu süreyi bir gün uzatabilir. Süresi içerisinde antrepo beyannamesi verilmemesi halinde, antrepoda görevli yetkilendirilmiş gümrük müşaviri tarafından gümrük idaresine bilgi verilir ve bu durumdaki eşya, ilgili gümrük idaresinin denetimindeki en yakın geçici depolama yerine veya geçici depolama yeri yoksa gümrük idaresince uygun görülen yere gönderilir
MADDE 8 – Aynı Yönetmeliğin 332 nci maddesinin ikinci fıkrasının sonuna aşağıdaki cümleler eklenmiştir.
“Ancak, aynı sevkiyata konu olmakla birlikte antrepoya birden fazla taşıtla peyderpey sevk edilen ve tamamı bir seferde antrepoya alınamayacak eşya için, eşya sahibi veya temsilcisi ya da taşıyıcı tarafından ilgili gümrük idaresine yazılı talepte bulunulması halinde, gümrük idaresince, ilk eşyanın antrepoya girişinden itibaren en geç beş iş günü içinde antrepo beyannamesinin verilmesi koşuluyla eşyanın peyderpey antrepoya alınmasına izin verilebilir. İhtiyaç halinde bu süre gümrük idaresince bir defaya mahsus olmak üzere beş iş gününe kadar uzatılabilir.”
Madde 478 (2) Yukarıdaki sayılan hususları ispat eden belgeler ve götürü teminat ile birlikte, ek-75’te yer alan taahhütnameyi doldurarak ilgili gümrüğe ibraz eden firmalar; gemilere yağ ve yakıt verilmesine ilişkin işlemleri yürütebilir. Bu firmaların gemilere yağ ve yakıt verilmesine ilişkin her başvurularında ilgili kaptan veya gemi acentesinin talep veya izin yazısını gümrük idaresine ibrazı şarttır.
MADDE 9 – Aynı Yönetmeliğin 478 inci maddesinin ikinci fıkrasında yer alan “ve götürü” ifadesi yürürlükten kaldırılmıştır.
MADDE 493 (5) Götürü teminat sisteminden, Onaylanmış Kişi Statüsüne veya yetkilendirilmiş yükümlü sertifikasına” sahip olan yükümlüler ile Bakanlıkça belirlenen şartları taşıyan antrepo işleticileri yararlanabilir.
(6) Götürü teminat, 4760 sayılı Özel Tüketim Vergisi Kanununun eki (I) sayılı listede yer alan eşyanın ithaliyle ilgili Maliye Bakanlığınca yapılan düzenlemeler ve ilgili diğer düzenlemeler saklı kalmak kaydıyla, eşyanın gümrükçe onaylanmış işlem veya kullanıma tabi tutulmasına ilişkin tüm kamu alacakları için geçerlidir.
MADDE 10 – Aynı Yönetmeliğin 493 üncü maddesinin beşinci ve altıncı fıkraları aşağıdaki şekilde değiştirilmiştir.
“(5) Götürü teminat uygulamasından, onaylanmış kişi statü belgesine veya yetkilendirilmiş yükümlü sertifikasına sahip yükümlüler ile Bakanlıkça belirlenen şartları taşıyan antrepo işleticileri yararlanabilir.”
“(6) Götürü teminat, eşyanın gümrükçe onaylanmış işlem veya kullanıma tabi tutulmasına ilişkin tüm kamu alacakları için geçerlidir. Ancak, 4760 sayılı Özel Tüketim Vergisi Kanununun eki (I) sayılı listede yer alan eşyaya ilişkin kamu alacakları için götürü teminat uygulamasından yararlanılmaz.”

ARTICLE 22 – (1) Within the scope of the customs regulations and with the aim to simplify customs processes and applications, in order to benefit from methods, applications and authorizations determined, who satisfies the conditions determined in articles 23 and 24, settled in Turkey’s Customs Region, real and who has been acting for at least two years and in case they demand for legal entities, status of approved person of classes A, B or C is given to. ARTICLE 1 – To the first clause of the 22nd article of the Customs Regulations which was issued in the repeated numbered and 7/10/2009 dated Official Journal, following the phrase “settled in Turkey’s Customs Region”, the phrase “and acting for at least two years” was added.
ARTICLE 22 – (1) Within the scope of customs regulations and with the aim to simplify customs processes and applications, in order to benefit from methods, applications and authorizations determined, who satisfies the conditions determined in articles 23 and 24, settled in Turkey’s Customs Region, real “and who has been acting for at least two years” and in case they demand for legal entities, status of approved person of classes A, B or C is given to.
ARTICLE 77
(7) In case of lack or surplus in brief declaration, for the sake of the nature of things, is understood to be at rates in appx-11, prosecution for brief declaration of lack or surplus shall not be performed and procedures shall be done from the amount which is determined by the customs administration and no fine is applied. ARTICLE 2 – The seventh clause of the 75th article of the same regulations has been amended as given below.
“(7) In relation with lacks and surpluses occurred in goods which come in bulk, due to the 237th article of the Law, for the lack or surplus of brief declaration determined by the Council of Ministers’ decision, prosecution for brief declaration of lack or surplus shall not be performed. If there is prosecution for situations which require prosecution for lack or surplus of brief declaration and fining process if there is, are applied not to the whole of lacks and surpluses but to the part which exceeds the differences which do not require prosecution and which are determined by the Council of Ministers’ decision. For the amount which is not subject to prosecution, not any fining process is applied. Loss rates placed in Appx-11 are not taken into account in prosecutions for lack or surplus of brief declaration.
ARTICLE 86 – (1) Goods which are stored temporarily, with regular declaration which was given by the owners or their representatives are subjected to a process or usage which is approved by the customs. (2) With the 46th article of the Law and within the periods of time stated in the 76th article of the Regulations, a process or usage which is approved by the customs is determined and in case not any judicial or administrative prosecution for goods which are not begun related procedures takes place, clearance provisions are applied. Customs administrations, may consign such goods-till their situation is determined-to a place which shall be approved by the customs and be under custom’s control and on account and risk of the owner of goods or, on account of the owners of the concerned goods, may lift them to a temporary storage place operator, to storehouse. While performing these procedures, application of provisions about the goods continues.

ARTICLE 3 – The third clause below was added to 86th article of the same regulations.
“(3) At land border crossings, from the date of entrance to customs area and within the periods of time stated in the 46th article of the Law and the 76th article of this regulations, for vehicles which were not begun related procedures in accordance with a procedure or usage which is determined and approved by the customs, provisions of the 2nd clause are applied.”
ARTICLE 4 – The phrases “the third clause of the 167th article of” which are mentioned in first clauses of the 169th and the 170th articles of the same Regulations have been amended as the sub-clause numbered (3) of the first clause of the 167th article.
Article 171 “(4) Within the scope of the permission for inward processing, following the import, in order to be used for obtaining export products, auxiliary raw textile materials like fiber, thread, raw and textile fabric (including undercoating) with stiffening cloth, labels, buttons, zippers, grippers, rivets, hangers, eyelets, stripes and rubber which were brought to Turkey’s Customs Region and which are outside of textile and leather chemicals may verbally be declared to customs administrations. ARTICLE 5 – The fourth and the sixth clauses of the 171st article of the same Regulations have been amended as shown below.
“(4) Goods stated below which is subject to inward processing regime may verbally be declared to customs administrations.
a) Within the scope of the permission for inward processing, following the import, in order to be used for obtaining export products, auxiliary raw textile materials like fiber, thread, raw and textile fabric (including undercoating) with stiffening cloth, labels, buttons, zippers, grippers, rivets, hangers, eyelets, stripes and rubber which were brought to Turkey’s Customs Region which are outside of textile and leather chemicals,
b) Within the scope of the permission for inward processing, materials and equipment which belong to ships which shall be subjected to repair and maintenance process,
c) Within the scope of the permission for inward processing, motor transport vehicles, agricultural machines and parts of them which shall be subjected to repair and maintenance process.”
“(6) Within the scope of the permission for inward processing, verbal declaration, goods which are placed in the sub-clause (a) of the fourth clause can be used only when entering Turkey’s Customs Region.”
Article 172 “(ç) In inward processing, the boxes numbered 1, 5, 6, 8, 22, 31, 33, 37, 41, 42, 52, and 54 are compulsorily to be filled; filling the boxes numbered 2, 14, 16, 30, 34, 40, and 44 is optional. ARTICLE 6 – The sub-clause (ç) of the second clause of the 172nd article of the same Regulations has been amended as shown below.
“ç) Those which take place in the scope of inward processing, in the sub-clause (a) in temporary import and the scope of inward processing in export, in the sub-clause (a) are filled.

Article 332 (2) Following the registration of the storehouse declaration, goods to be subjected to the storehouse regime before put in the storage place is taken into the
Storehouse
“Storehouse declaration should be registered within two working days following the coming of the vehicle to the storehouse. The Customs Administration, upon written and substantiated demand by the owner or the carrier of the goods, may extend this period for one day. Within its period of time, in case the storehouse declaration is not submitted, the customs administration is informed by the authorized customs advisor who is in office and the goods in such condition is sent to the closest temporary storage place and in case there is not such a place, to a placed approved by the customs administration. ARTICLE 8 – The following sentences have been added to the end of the second clause of the 332nd article of the same Regulations.
“But, even if it is subjected to the same shipping, goods which are shipped to the storehouse part by part and for goods which cannot be taken into storehouse at once, in case the owner of goods or his representative demand in writing from the concerned customs administration, within five work days following the entrance of goods into the storehouse with the condition that storehouse declaration is given, permission may be given for goods to be taken into storehouse. When there is a need, this period may be extended by the customs administration up to five work days but only once.”
Article 478 (2) Together with documents proving the particulars counted above and the lump sum collateral, by filling the commitment letter and submitting it to the concerned customs, firms can run procedures about giving oil and fuel to ships. In every appeal of firms for giving oil and fuel to ships, the permission writing of the concerned captain or ship agent should be submitted to the customs administration. ARTICLE 9 – The phrase “and collateral” in the second clause of the 478th article of the same Regulations has been abolished.
ARTICLE 493 (5) Declarants who have Approved Person Status or authorized declarant certificate and storehouse operators who have the conditions determined by the Ministry may benefit from the collateral lump sum system.
(6) In relation with the import of goods in the appx (I) numbered list of the Private Consumption Tax numbered 4760, lump sum collateral is valid for all public accounts receivable related to being subjected to the process and usage approved by the customs. ARTICLE 10 – The fifth and the sixth clauses of the 493rd article of the same regulations have been amended as shown below.
“(5) Declarants who have Approved Person Status or authorized declarant certificate and storehouse operators who have the conditions determined by the Ministry may benefit from the collateral lump sum system.”
(6) Lump sum collateral is valid for all public accounts receivable related to being subjected to procedure or usage of the goods approved by the customs. But, for public accounts receivable related to the goods in the appx (I) numbered list of the Private Consumption Tax numbered 4760, lump sum collateral application cannot be benefited of.

4) If you have complaints about the dust of the crushed material, please ask for a sieving system. The material you are going to crush may be dusty and may need washing with water.

Our plastic crushing machines are equipped with security systems. All parts which may cause danger for the working person are taken under control. Machine disassembling and assembling operations and changing knives and sieves are never left to human initiative.
For the workers to work more efficiently, our machines are isolated against noises which may disturb the working people and the environment.

Klinik bilgi: Düşük doz
Teknik: Toraksa yönelik volümetrik aksial kesitler alınmıştır. I.V. kontrast madde verilmemiştir.
Bulgular:
Trakea, karina ve ana bronşlar açıktır. Endotrakeal sekresyonda artış dikkati çekmiştir. Proksimal trakea sağ posterolateral duvar kaynaklı divertikül mevcuttur.
Torasik aorta çapı normaldir. Pulmoner trunkus çapı 28 mm olup önceki incelemelerle benzer şekilde normalin üst sınırındadır. Aorta ve koroner arterlerde kalsifiye aterom plakları izlenmiştir. Kalp boyutları normaldir. Patolojik düzeyde artmış perikardial efüzyon saptanmamıştır.
03.05.2012 tarihli BT incelemesinde izlenen mediastinal LAP’ler bu incelemede izlenmedi.
Her iki akciğerde amfizematöz havalanma artışı mevcuttur.
Sol hemitoraksta sıvama tarzında minimal plevral efüzyon, solda alt kesitlerde posteriorda plevrada fokal kalınlaşma izlenmiştir.
Sağ akciğer orta lob santral kesimde traksiyon bronşiektazileri, peribronkovasküler interstisyumda kalınlaşma ve bu düzeyde post operatif olduğu düşünülen metalik dansiteler izlenmiştir. Benzer şekilde solda inferiorda paraaortik alanda staplere ait olduğu düşünülen metalik opasiteler mevcuttur.
Her iki akciğer parankiminde belirgin interstisyel kalınlaşma ya da subplevral hava kistleri izlenmemiştir.
Her iki akciğer parankiminde konsolidasyon ya da kitle saptanmadı.
Sağ akciğer alt kesitlerde büyüklükleri 2-5 mm arasında değişen, yakın komşuluk gösteren nodüller izlenmiştir. 6 ay sonra düşük doz BT ile kontrolü önerilir.
SONUÇ:
• Her iki akciğerde amfizematöz havalanma artışı
• Mayıs 2012 tarihli incelemede izlenen mediastinal LAP’ler bu incelemede izlenmedi

Thorax Computed Tomography
Clinical information: Low dosage
Technique: Volumetric axial sections intended for the thorax were taken. I. V. contrast material was not given.
Findings:
The trachea, carinae and main bronchia are open. Increase in the endotracheal secretion drew attention. Diverticulum originating from the proximal trachea right postero-lateral wall is present.
The diameter of the thoracic aorta is normal. The diameter of the pulmonary truncus is 28 mms and resembling the previous examinations is at the upper limit of the normal. Calcified atheroma plaques were observed in the aorta and coronary arteries. Heart dimensions are normal. No pericardial effusion increased
to pathological level was detected.
Mediastinal LAPs which were watched in CT examination dated 03.05.2012 were not watched in this examination.
There is increase of emphysema aeration in both lungs.
Plaster typed minimal pleural effusion in the left hemithorax and focal thickening in the posterior in the pleura was observed in lower sections.
Traction bronchiectasis in the central section of the middle lobe of the right lung, thickening in the peribronchiolitis vascular interstitium and at this level, metallic densities which are thought to be post-operative were watched. Similarly, in the left, in the inferior, in the paraaortic area, there are metallic opacities which are thought to belong to staplers.
In both lungs’ parenchyma, no consolidation or mass was detected.
In the lower sections of the right lung, nodules of which the sizes change between 2-5 mms and which show close neighborliness were watched. After 6 months, controlling with low dose CT is suggested.
CONCLUSION:
● Increase of emphysema aeration in both lungs
● Mediastinal LAPs which were watched in the examination in May 2012 were not watched in this examination
● Metallic densities which are thought to be post-operative and fibrotic changes in both lungs
● Minimal local pleural effusion in the left
● Traction bronchiectasis in the proximal of the middle lobe
