VAT is applied to all transactions carried out in the EU for consideration (payment) by a taxable person, i.e. any individual or body that supplies taxable goods and services in the course of business. Imports by any such person are also subject to VAT.
Taxable transactions include supplies of goods or services within a single EU country, intra-EU acquisitions of goods (goods supplied and dispatched or transported by a business in one EU country to a business in another) and imports of goods into the EU from outside.
Regarding the place of transaction, different rules apply depending on the nature of the transaction, the kind of product supplied, and whether transport is involved.

Supply of goods — the place of taxation is where the goods are supplied.
—
Intra-EU acquisition of goods — the place of taxation is the place where the party acquiring goods takes delivery of them, i.e. the EU country where the goods are finally located after transport from another EU country.

Imports of goods into the EU from non-EU countries are generally taxed in the EU country where they arrive.

Supply of services — the place of taxation is the place where the services are supplied. This depends not only on the nature of the service supplied but also on the status of the customer receiving the service. To ensure that the service is taxed at the place where it is actually consumed, there are some exceptions to these general rules, such as:

services connected with immovable property (real estate),
—
passenger transport,
—
activities relating to culture, sport, education and entertainment,
—
restaurant services.
VAT becomes chargeable depending on the nature of the transaction, e.g. when the goods or services are supplied. The chargeable event for an intra-EU acquisition (purchase) generally occurs when the goods are acquired, i.e. when a supply of similar goods in the EU country of acquisition would be regarded as complete. For imports into the EU, the chargeable event occurs when the goods are brought into an EU country.
The taxable amount in the case of supply of goods and services and the intra- EU acquisition of goods includes all payments to the supplier in return for the supply. Where goods are imported, the taxable amount is their value for customs purposes. Duties, taxes and other charges are included in the taxable amount but the VAT itself, price discounts and rebates granted to the customer are excluded.
The standard rate of VAT to be applied by all EU countries to goods and services is no less than 15 %. EU countries may apply 1 or 2 reduced rates of no less than 5 % to specific goods or services listed in Annex III to the Directive. A number of provisions which derogate from these rules (lower rates, reduced rates on other goods or services, etc.) also apply under certain conditions.
The Directive provides for exemptions from VAT. Most of them are exemptions without the right to deduct, e.g. financial and insurance services, medical care or social services. However, exemptions with the right to deduct also exist, e.g. intra-EU supplies of goods or exports of goods to a non-EU country. Certain exemptions are obligatory for Member States, while others are optional.
A taxable person has the right to deduct the amount of VAT paid on acquired goods or services in the EU country where these transactions are carried out. This input VAT can be deducted from VAT payable on taxable transactions, e.g. domestic supplies of goods or services. There is in general no right to deduct in the case of an exempt economic activity, or if the taxable person qualifies for a special scheme. In certain cases deductions may be limited or adjusted.
The Directive sets out the obligations of taxable and certain non-taxable persons. Generally, VAT is payable by any taxable person making a taxable supply of goods or services. Exceptions include specific transactions where it is the customer who pays VAT, e.g. supplies of natural gas, and transactions where the EU country may choose to designate the customer to pay VAT, as with certain fraud-sensitive supplies, such as emission allowances (until 31 December 2018).
The Directive provides for derogations by EU countries from standard VAT rules, e.g. to prevent certain types of tax evasion. There are also special VAT schemes designed to reduce paperwork, e.g. for small businesses and for farmers.
Translation - Polish VAT stosuje się do wszystkich transakcji przeprowadzanych odpłatnie w UE przez podatnika, tj. osobę lub podmiot dostarczający towary i świadczący usługi w ramach swojej działalności. Import wykonywany przez takie osoby także podlega pod VAT.
Transakcje podlegające opodatkowaniu obejmują dostarczanie towarów lub usług w jednym kraju UE, wewnątrzwspólnotowe nabywanie towarów (towarów dostarczanych i wysyłanych lub transportowanych przez przedsiębiorstwo w jednym kraju UE do przedsiębiorstwa w innym kraju UE) oraz import towarów spoza UE do UE.
Odnośnie do miejsca opodatkowania stosuje się różne zasady zależnie od charakteru transakcji, rodzaju dostarczanych towarów oraz tego, czy wiąże się to z transportem.

Dostawa towarów – miejscem opodatkowania jest miejsce, do którego towary są dostarczane.

Wewnątrzwspólnotowe nabywanie towarów – miejscem opodatkowania jest miejsce, w którym strona nabywająca przyjmuje towar, tj. kraj UE, w którym towary się ostatecznie znajdują po transporcie z innego kraju UE.

Import towarów do UE z krajów spoza UE podlega zwykle opodatkowaniu w kraju UE, do którego towary są wwożone.

Świadczenie usług – miejscem opodatkowania jest miejsce, w którym usługi są świadczone. Rozróżnienie zależy nie tylko od charakteru świadczonej usługi, ale także od statusu klienta otrzymującego usługę. W celu zapewnienia, że usługa podlega opodatkowaniu w faktycznym miejscu jej świadczenia, stosuje się wyjątki od tych zasad ogólnych, które obejmują:

usługi związane z nieruchomościami,
—
przewóz osób,
—
działalność kulturalną, sportową, naukową, edukacyjną lub rozrywkową,
—
usługi restauracyjne.
Obowiązek płacenia VAT powstaje zależnie od charakteru transakcji, np. od tego, kiedy towary lub usługi są dostarczane. Dla wewnątrzwspólnotowego nabywania towarów (zakupów) obowiązek podatkowy powstaje zwykle z chwilą nabycia towarów, tj. w chwili, gdy dostarczenie podobnych towarów w kraju UE, w którym zostają nabyte, byłoby uznane za zakończone. Dla importu do UE obowiązek podatkowy powstaje z chwilą wwiezienia towarów do kraju UE.
Podstawa podatkowa w przypadku dostarczania towarów i usług oraz wewnątrzwspólnotowego nabywania towarów obejmuje wszystkie płatności na rzecz dostawcy w zamian za dostarczenie towarów lub usług. Jeśli towary są importowane, podstawą podatkową jest ich wartość na potrzeby celne. Cła, podatki i inne opłaty ujęte są w podstawie podatkowej, lecz sam VAT, opusty i obniżki udzielone klientowi są wyłączone.
Podstawowa stawka VAT stosowana we wszystkich krajach UE do towarów i usług wynosi co najmniej 15%. Kraje UE mogą stosować jedną lub dwie stawki obniżone wynoszące co najmniej 5% do określonych towarów i usług wymienionych w załączniku II do dyrektywy. Pewne przepisy odstępujące od tych zasad (niższe stawki, stawki obniżone na inne towary lub usługi itd.) także mają zastosowanie w określonych warunkach.
Dyrektywa przewiduje zwolnienia z VAT. Większość z nich to zwolnienia bez prawa odliczenia podatku, np. usługi finansowe i ubezpieczeniowe, opieka medyczna lub usługi socjalne. Jednakże istnieją także zwolnienia z prawem do odliczenia podatku, np. wewnątrzwspólnotowa dostawa towarów lub eksport towarów do kraju spoza UE. Jedne zwolnienia są obowiązkowe dla krajów UE, natomiast inne są opcjonalne.
Podatnik posiada prawo odliczenia kwoty VAT zapłaconej z tytułu nabytych towarów lub usług w kraju UE, w którym przeprowadzono transakcję. Taki naliczony VAT może być odliczony od VAT-u płatnego z tytułu transakcji podlegających opodatkowaniu, np. krajowa dostawa towarów lub usług. Generalnie nie istnieje prawo do odliczenia podatku w przypadku działalności gospodarczej objętej zwolnieniem lub jeśli podatnik kwalifikuje się do opodatkowania według procedury szczególnej. W pewnych przypadkach odliczenia mogą być ograniczane lub korygowane.
Dyrektywa ustanawia zobowiązania podatników i określonych osób niebędących podatnikami. Ogólnie VAT jest płacony przez każdego podatnika dokonującego dostawy towarów lub usług podlegającej opodatkowaniu. Wyjątki obejmują określone transakcje, w których to klient płaci VAT, np. dostawa gazu, oraz transakcje, w których kraj UE może postanowić, by to klient płacił VAT, jak w przypadku pewnych dostaw podatnych na oszustwa, takich jak handel przydziałami (do 31 grudnia 2018 r.).
Dyrektywa przewiduje odstępstwa dla krajów UE od zasad ogólnych VAT, np. w celu zapobiegania pewnym rodzajom uchylania się od podatków. Istnieją także procedury szczególne VAT, opracowane z myślą o ograniczeniu pracy z dokumentacją, np. dla małych przedsiębiorstw czy dla rolników.
