Neither party shall be responsible to the other for any failure to perform in accordance with this Contract when such failure is caused by any circumstance constituting Force Majeure. The following circumstances shall be regarded as cases of Force Majeure if they intervene after the forma¬tion of this Contract; impede the performance of either party thereunder and are beyond the control of the affected party:
industrial disputes, strikes, fire, mobilization, requisition, embargo, currency restriction, insurrec¬tion, shortage of transport, general shortage of materials, restrictions in the use of power and delays or defects in deliveries by sub-contractors when attrib¬utable to cases of Force Majeure as specified herein or any other circumstances beyond the control of the parties.
Claim of relief
The party wishing to claim relief by reason of Force Majeure shall notify the other party in writing without delay on the inter¬vention and cessation of any relevant circumstance constituting Force Majeure affecting the performance of such party hereunder.
Frustration
If by any reason of the aforesaid circumstances the implementation of the Contract is delayed for more than six (6) months or becomes impossible either party shall be entitled to terminate the Contract by notice in writing to the other party.

Egyik fél sem tehető felelőssé a másikkal szemben bármilyen hibáért a Szerződésnek megfelelően, ha a hiba Vis Maior miatt következett be. A következő körülményeket Vis Maiornak kell tekinteni, ha a szerződés létrejötte után következtek be, megakadályozva bármely fél működését és azt az érintett félnek nem áll módjában kontrollálni:
munkaadók és munkavállalók közötti ellentét, sztrájkok, tűz, mozgósítás, rekvirálás, embargó, valutakorlátozás, felkelés, szállítási hiány, általános anyaghiány, energia használatának korlátozása és késedelem vagy hiány az alvállalkozó szállításában amikor Vis Major esete áll fenn az itt megjelöltek szerint vagy bármilyen más körülmény miatt, amit feleknek nem áll módjában kontrollálni.
Jogorvoslat iránti kérelem
A Vis Maior miatt jogorvoslat iránti kérelmet benyújtó fél köteles haladéktalanul írásban értesíteni a másik felet bármely Vis Maiorhoz köthető körülmény felmerülése és megszűnése esetén, amely befolyásolja Felek teljesítményét jelen szerződés szerint.
Meghiúsulás
Ha a fent említett körülmények bármelyike miatt, a Szerződésben foglaltak teljesítése késik több mint hat (6) hónapot vagy teljesíthetetlenné válik, bármelyik félnek joga va a másik fél részére írásban benyújtott felmondással élnie.

2. Általános szabályok
2.1. Jelen „Általános Szerződési Feltételek” (a továbbiakban: ÁSZF) szabályozzák a Szolgáltató szálláshelyeinek, és az ott kínált szolgáltatásainak igénybevételével kapcsolatos feltételeket.
2.2. A Szolgáltató külön megállapodást köthet az általa kínált szolgáltatásokkal kapcsolatban, melynek speciális rendelkezései eltérhetnek a jelen rendelkezésektől.
2.3. Jelen ÁSZF-et a Szolgáltató jogosult módosítani. A módosított ÁSZF rendelkezéseit a módosítás hatályba lépését követően a Szolgáltató által megküldésre kerülő ajánlatkérésekre, valamint az azok alapján létrejött szerződésekre kell alkalmazni.
3. Szerződő fél
3.1. A szerződő fél a Szolgáltató szolgáltatásait megrendelő és/vagy igénybe vevő természetes személy vagy jogi személy, illetve egyéb szervezet. Szerződő fél az a természetes személy is, aki a szolgáltató szolgáltatását ténylegesen igénybe veszi. A szolgáltatást megrendelő és/vagy igénybe vevő a továbbiakban együttesen: Vendég. A Szolgáltató és a Vendég – a feltételek teljesülése esetén – szerződő felekké válnak – a továbbiakban együttesen: szerződő felek.
4. A Szerződés létrejötte, a foglalás módja, módosítása, értesítési kötelezettség
4.1. A Vendég szóban vagy írásban – levélben, online, telefaxon, e-mailben – megküldött ajánlatkérésére a Szolgáltató ajánlatot küld. Amennyiben az ajánlat elküldésétől számított 48 órán belül nem érkezik konkrét, a Szolgáltató ajánlatát elfogadó írásbeli megrendelés, úgy a Szolgáltató ajánlati kötöttsége megszűnik.
4.2. A szerződés a Vendég írásban, levélben on-line, e-mailben vagy telefax küldésével leadott foglalásának a Szolgáltató által írásban megküldött visszaigazolásával jön létre, és így az írásban megkötött szerződésnek minősül.
4.3. Szóban leadott foglalás, megállapodás, módosítás, vagy annak a Szolgáltató általi szóbeli visszaigazolásával nem jön létre a szerződés, vagy szerződés módosítás, kizárólag abban az esetben, amennyiben az valamennyi fél részéről írásban is megerősítésre kerül.
4.4. A Szolgáltatónál a Vendég által személyesen leadott megrendelésnél a Vendég helyben aláírja az általa megrendelt szolgáltatásról a kinyomtatott megrendelőlapot. A visszaigazolás a Szolgáltató részéről a megrendelőlapnak a Szolgáltató recepciójában dolgozó munkatársának aláírásával történik, amely írásban megkötött szerződésnek minősül.
4.5. A szállás-szolgáltatás igénybevételéről szóló szerződés minden esetben meghatározott időtartamra szól.
4.6. Ha a Vendég a Felek között létrejött szerződésben meghatározott időtartam lejárta előtt véglegesen elhagyja a szobát, a Szolgáltató jogosult a Felek között létrejött szerződésben rögzített – Vendég által megrendelt – szolgáltatás teljes ellenértékére, függetlenül attól, hogy azt a Vendég részben nem vette igénybe.
4.7. A 4.6. pont szerint a lejárati idő előtt megüresedett szobát a Szolgáltató jogosult újra értékesíteni.
4.8. A szállás-szolgáltatás igénybevételének Vendég által kezdeményezett meghosszabbításához a Szolgáltató előzetes, írásbeli hozzájárulása szükséges. Ebben az esetben a Szolgáltató kikötheti a meghosszabbítás feltételeként a már teljesített szolgáltatás díjának megtérítését.
4.9. A szerződés módosításához és/vagy kiegészítéséhez a Felek által aláírt írásbeli megállapodás szükséges.
4.10. Az e szerződésben rögzítettektől a felek eseti megállapodásban eltérhetnek, amely esetben a Felek közötti jogviszonyt az eseti megállapodásban rögzítettek határozzák meg.
5. Lemondási feltételek
5.1 A Vendégnek a Szolgáltató által küldött írásbeli visszaigazolás megküldéséig szállás-szolgáltatás kötbérmentes lemondására van lehetősége.
5.2. A lemondási feltételek eltérőek az un. egyéni foglalás esetén, amely legfeljebb 10 természetes személy főt foglal magában, illetve csoportos foglalás esetén, amely 10 főt meghaladó természetes személy általi, vagy azok részére történő foglalása esetén érvényes. A lemondási feltételekre külön, eltérő rendelkezések vonatkoznak a kiemelt időszakokban, valamint a vissza nem térítendő ár kategória esetében. (lásd. 5.4, 5.7, 5.8)
5.3. Lemondási feltételek nem kiemelt időszakokban egyéni foglalás esetén:
5.3.1. A Vendég a Szolgáltató írásbeli visszaigazolásának megküldését követően a 10 főt meg nem haladó foglalás esetében az érkezés dátumát megelőző nap 14 óráig a foglalásának kötbérmentes lemondására jogosult.
5.3.2. A Vendég a Szolgáltató írásbeli visszaigazolásának megküldését követően a 10 főt meg nem haladó foglalás esetében az érkezés dátumát megelőző nap 14 óráig a foglalását, a foglalásban szereplő szolgáltatások teljes ellenértékének, azaz ellenértéke 100%-nak megfelelő mértékű kötbér megfizetése ellenében módosíthatja vagy mondhatja le. Amennyiben a módosítás kizárólag a Szolgáltató visszaigazolásában szereplő szolgáltatásokon túli, további szolgáltatás(ok) igénybevételére irányul, úgy a Vendég nem köteles kötbért fizetni, ez esetben a további igényelt szolgáltatás(ok) nyújtásában a felek írásban megállapodhatnak.
5.4. Lemondási feltételek kiemelt időszakokban, ünnepek idején, valamint a vissza nem térítendő ár kategória esetében egyéni foglalás esetén:
5.4.1. A Vendég a Szolgáltató írásbeli visszaigazolásának megküldését követően, 10 főt meg nem haladó foglalás esetében az érkezés dátumát megelőző 8. napig a foglalását kötbérmentesen módosíthatja, lemondhatja. Vissza nem térítendő kategória esetében a szálloda vezetősége bizonyítható vis maior esetén visszatérítésről dönthet.
5.4.2. A Vendég a Szolgáltató írásbeli visszaigazolásának megküldését követően a 10 főt meg nem haladó foglalás esetében az érkezés dátumát megelőző 7. napon illetőleg 7. napon belül a foglalását, a foglalásban szereplő szolgáltatások teljes ellenértékének, azaz ellenértéke 100%-nak megfelelő összegű kötbér megfizetése ellenében módosíthatja, mondhatja le. Amennyiben a módosítás kizárólag a Szolgáltató visszaigazolásában szereplő szolgáltatásokon túli, további szolgáltatás(ok) igénybevételére irányul, úgy a Vendég nem köteles kötbért fizetni, ez esetben a további igényelt szolgáltatás(ok) nyújtásában a felek írásban megállapodhatnak.
5.5. Lemondási feltételek csoportos foglalás esetén (beleértve a kiemelt időszakokat is):
5.5.1. A 10 főt meghaladó csoportok foglalásait a Vendég a Szolgáltató írásbeli visszaigazolásának megküldését követően kötbérmentesen nem mondhatja le.
5.5.2. A 10 főt meghaladó csoportok foglalásait a Vendég az érkezés dátumát megelőző 45. napig a megrendelt, és Szolgáltató által visszaigazolt valamennyi szolgáltatás (szobamennyiség, terem- és technika bérleti díj, vendéglátás – pl. étkezések, kávészünetek – és egyéb megrendelt szolgáltatások) összes ellenértéke 25%-ának megfelelő összegű kötbér megfizetése ellenében módosíthatja vagy mondhatja le.
5.5.3. A 10 főt meghaladó csoportok foglalásait a Vendég az érkezés dátumát megelőző 30. napig a megrendelt, és Szolgáltató által visszaigazolt valamennyi szolgáltatás (szobamennyiség, terem- és technika bérleti díj, vendéglátás – pl. étkezések, kávészünetek – és egyéb megrendelt szolgáltatások) összes ellenértéke 50%-ának megfelelő összegű kötbér megfizetése ellenében módosíthatja vagy mondhatja le.
5.5.4. A 10 főt meghaladó csoportok, valamint a konferenciák és rendezvények foglalásait a Vendég az érkezés dátumát megelőző 15. napig a megrendelt, és Szolgáltató által visszaigazolt valamennyi szolgáltatás (szobamennyiség, terem- és technika bérleti díjának, vendéglátás – pl. étkezések, kávészünetek – és egyéb megrendelt szolgáltatások) díjának összes ellenértéke 100%-ának megfelelő összegű kötbér ellenében módosíthatja vagy mondhatja le.
5.5.5. Amennyiben a Vendég általi foglalás módosítás kizárólag a Szolgáltató visszaigazolásában szereplő szolgáltatásokon túli, további szolgáltatás(ok) igénybevételére irányul, úgy a Vendég nem köteles kötbért fizetni, ez esetben a további igényelt szolgáltatás(ok) nyújtásában a felek írásban megállapodhatnak.
5.6. Amennyiben a Vendég a foglaláskor vagy azt követően a Szolgáltató részére – a felek megállapodása alapján – előleget fizet, azonban a foglalásban szereplő és Szolgáltató által visszaigazolt szolgáltatást nem veszi részben vagy teljes egészében igénybe és/vagy azt részben vagy egészben lemondja, úgy a Szolgáltatót a befizetett előleg teljes összege megilleti, ez esetben a Vendég által igénybe vett szolgáltatások ellenértéke és az előleg közötti különbözetre a Szolgáltató bánatpénzként jogosult.
5.7. A fenti 5.4. és 5.5. pontokban rögzített kötbéreket a Szolgáltató jogosult a Vendég által nyújtott előleg vagy bármely a Vendég által teljesített fizetés terhére érvényesíteni, azzal szemben beszámítani.
5.8. A Szolgáltatót a Vendég (No Show) távolmaradása esetén a foglalásban szereplő szolgáltatások ellenértéke 100%-ának megfelelő összegű kötbér illeti meg.

2. General rules
2.1. The „General Terms and Conditions” (hereinafter referred to GTC) shall define the rules of the conditions in connection with the accommodations of the Service Provider and the services using there.
2.2. The Service Provider can make a special agreement in connection with their services which special provisions can differ from these provisions.
2.3. The Service Provider is entitled to modify this GTC. The provisions of the modified GTC shall be applied for the enquires sent by the Service Provider and the contracts based on these enquires after the modification coming into force.
3. The contracting party
3.1. The contracting party is natural or legal party or any organisations who use and/or order the services of the Service Provider. The contracting party is the natural person too who, actually uses the services of the Service Provider. The persons who order or/and use the service are collectively hereinafter referred to as: Guest. The Service Provider and the Guest are – in case of the fulfilment of the conditions – become contracting parties – hereinafter collectively: contracting parties.
4. The reach of the Contract, the method, modification of the booking
and the notification obligation
4.1. The Service Provider sends an offer for the enquiry of the Guest sent orally or in writing - in letter, online, telefax, e-mail. If the Service Provider does not get a concrete written order accepting the offer of the Service Provider within 48 hours, the offering restriction of the Service Provider ceases.
4.2. The Guest and the Service Provider enter into contract when the Guest sends the booking in written by letter or online and the Service Provider confirms it in written, so it is qualified as a written contract.
4.3. The Guest and the Service Provider does not enter into contract or its modification, if the booking, agreement, modification is made orally and the confirmation of the Service Provider is made orally, solely in that case if it is affirmed by all parties in written.
4.4. In case of placing the order in person at the Service Provider by the Guest, the Guest signs the printed order form about their services ordered on the spot. The confirmation of the Service Provider is the signed order form by the employee working at the reception of the Service Provider which is qualified as a written contract.
4.5. The contract of the use of the accommodation service is only for a determined period in every case.
4.6. If the Guest leaves the room definitely before the expiry of the period determined in the contract between the Parties, the Service Provider is entitled to get the full payment of the services -ordered by the Guest- recorded in the contract between the parties, independently of the fact that the Guest used it partially.
4.7. According to the 4.6 point the Service Provider is entitled to let the room become vacant before the expiry.
4.8. To extend the use of the accommodation service initiated by the Guest a previous written approval of the Service Provider is needed. In this case the Service Provider can insist on the covering costs of the settled service as the condition of the extension.
4.9. To modify and/or complete the contract a written agreement signed by the Parties is needed.
4.10. The Parties can depart from the records of this contract in an ad hoc agreement in which case the legal relationship between the Parties is determined by the records of the ad hoc agreement.
5. Cancellation conditions
5.1 The Guest can cancel the accommodation service without penalty until getting the written confirmation of the Service Provider.
5.2. The conditions of the cancellation can differ in case of so called individual booking which consist of maximum 10 natural persons or in case of group booking which is available for more than 10 persons booked for natural persons or by natural persons. For the cancellation conditions special and different regulations apply in the high season period or in case of nonrepayable price category (see 5.4, 5.7, 5.8).
5.3. Cancellation conditions in case of booking in low season period by individuals:
5.3.1. The Guest is entitled to cancel the booking without penalty until 14.00 on the day before the arrival date in case of booking for not more than 10 persons after getting the written confirmation of the Service Provider.
5.3.2. The Guest can modify or cancel their booking with a penalty equivalent with the full payment included in the booking namely 100% of the full payment until 14.00 on the day before the arrival date in case of booking for not more than 10 persons after getting the written confirmation of the Service Provider. If the modification is solely aimed at using further service(s) which were not in the confirmation of the Service Provider, the Guest shall not pay penalty and it his case the parties agree in written about the additional required service(s).
5.4. Cancellation conditions in case of booking in high season period, during holidays and nonrepayable price category by individuals:
5.4.1. The Guest is entitled to modify, cancel the booking without penalty until 8.00 on the day before the arrival date in case of booking for not more than 10 persons after getting the written confirmation of the Service Provider. In case of nonrepayable price category the management of the hotel can decide about the refund in case of provable vis major.
5.4.2. The Guest can modify or cancel their booking with a penalty equivalent with the full payment included in the booking namely 100% of the full payment until the 7th day before the arrival date or within 7 days in case of booking for not more than 10 persons after getting the written confirmation of the Service Provider. If the modification is solely aimed at using further service(s) which were not in the confirmation of the Service Provider, the Guest shall not pay penalty and it his case the parties agree in written about the additional required service(s).
5.5. Cancellation conditions in case of booking by groups (including the high season period):
5.5.1. The groups consist of more than 10 persons cannot cancel the accommodation service without penalty after getting the written confirmation of the Service Provider.
5.5.2. The Guest can modify or cancel all the orders of the groups consist of more than 10 persons with a penalty equivalent 25% of the full payment of the services (number of rooms, renting fee for rooms and technical equipment, catering - for example meals and coffee breaks – and other service ordered) until the 45th day before the arrival date after getting the confirmation of the Service Provider.
5.5.3. The Guest can modify or cancel all the orders of the groups consist of more than 10 persons with a penalty equivalent 50% of the full payment of the services (number of rooms, renting fee for rooms and technical equipment, catering - for example meals and coffee breaks – and other service ordered) until the 30th day before the arrival date after getting the confirmation of the Service Provider.
5.5.4. The Guest can modify or cancel all the orders of the groups consist of more than 10 persons, and the conferences and events with a penalty equivalent 100% of the full payment of the services (number of rooms, renting fee for rooms and technical equipment, catering - for example meals and coffee breaks – and other service ordered) until the 15th day before the arrival date after getting the confirmation of the Service Provider.
5.5.5. If the modification of the booking made by the Guest is solely aimed at using further service(s) which were not in the confirmation of the Service Provider, the Guest shall not pay penalty and it his case the parties agree in written about the additional required service(s).
5.6. If the Guest pays advance at the booking or after for the Service Provider according to the agreement of the parties but does not use the service included in the booking and confirmed by the Service Provider partly or completely and/or does not cancel partly or completely the Service Provider is due to get the full amount of the advance payed, in that case the Service Provider is entitled to get the difference between the price of the used services by the Guest and the advance as a forfeit.
5.7. The Service Provider is entitled to enforce the penalties recorded in the 5.4 and 5.5 points above for the charge of any advances or any completed payment made by the Guest or include it.
5.8. In the case of nonappearance of the Guest (No Show) the Service Provider is due to get a penalty equivalent 100% of the full payment of the services recorded in the booking.
