Dünyanın birçok ülkesinde olduğu gibi son 40 yıldır hızla gelişmesine paralel olarak nüfus artışının ve çevre sorunlarının yoğun yaşandığı ülkemizin en önemli metropol kentlerinden biri olma özelliğine sahip Kocaeli ilinde de hava kirliliği önemli bir sorun olarak kendisini göstermektedir. Son zamanlarda bölgede yaşayanların, hava kirliliği kaynakları ve maruz kaldıkları kirleticilerin sağlıkları üzerinde oluşturacağı etkiler konusunda bilgilerinin artması nedeniyle, Kocaelide hava kirleticilerine olan maruziyet ve hava kalitesi üzerinde hava kirleticilerinin etkilerini çalışmak bir ihtiyaç haline gelmiştir. Bu nedenle sorunun çözümünde hava kirliliği modellemesi ile kirletici konsantrasyonlarının minimum hata miktarı ile tahmininin yapılması, tahmin edilecek kirliliğin olumsuz etkilerinin azaltılması için gerekli önlemlerin alınmasında etkili olacaktır.
Bu çalışmada, Kocaeli İli özelinde, birçok çalışma alanında daha fazla uygulama olanağı bulan ve geleneksel istatistiksel tekniklere nazaran daha başarılı sonuçlar veren Adaptif yapay sinir ağlı bulanık mantık çıkarım sistemi (ANFIS) modeli kullanılarak hava kirliliğinin çeşitli meteorolojik parametrelere bağlı olarak modellenmesi ve hava kirliliği tahmini gerçekleştirilecektir. Rüzgâr yönü ve hızı, basınç, bağıl nem, sıcaklık, bulutluluk seviyesi ve yağış miktarı gibi meteorolojik parametrelerdeki değişimlerin seçilen hava kirleticilerinin (Metan Dışı Uçucu Organik Bileşikler, PM2.5 kütlesi, PM10 kütlesi, CO, NOx, NO2, SO2 ve O3) konsantrasyonları üzerine olan etkileri incelenecektir.
Bölgede kirliliği oluşturan kaynaklar ve bu kaynaklardan ortama yayılan kirletici miktarlarının belirlenmesi, ölçüm ve model çalışmaları ile tespit ve tahmin edilen kirliliğin kontrolu, alınacak önlemlere yol göstermesi gibi bütüncül bir yaklaşımın gerçekleştirilmesi açısından önemlidir. Bu nedenle, çalışma kapsamında ayrıca endüstri ve trafiğin yoğun etkisi altında olan Kocaeli kentinde dış ortam hava kalitesini etkileyen kirletici kaynaklardan (evsel, endüstriyel, trafik) ortama yayılan kirleticilerin miktarları (Metan Dışı Uçucu Organik Bileşikler, PM10, CO, NOx, SO2) hazırlanacak emisyon envanterlerine dayanarak, emisyon faktörleri kullanılarak saptanacaktır. Kocaelide daha önce sınırlı bir alan ve tüm kirlilik kaynaklarını içermeyecek şekilde yapılmış olan emisyon envanteri çalışmaları tüm Kocaeli ilini kapsayacak şekilde ve yeni parametreler eklenerek geliştirilecek, elde edilecek envanter bilgileri ile bir veri tabanı oluşturulacaktır.
Modelin tutarlılığı için her mevsime ait atmosferik ve meteorolojik değişkenlerin uygulanması gerekmektedir. Bu amaçla ölçümler tüm mevsimleri kapsayacak şekilde yapılacaktır. Önerilen projenin ölçümlerin yapılması, envanter ve modelleme çalışmalarının tamamlanması, sonuçların değerlendirilmesi ve raporlanması aşamalarını içeren yaklaşık 2 yıllık bir sürede tamamlanması öngörülmektedir.
Translation - English ABSTRACT
Air pollution has manifested itself as a major problem in Kocaeli district which is one of the biggest cities in our country where high population growth and environment problems intensively exist in parallel with rapid development in last 40 years like in many other world countries. In recent times, as people living in the district, have been acquiring more information about sources of air pollution and side effects of pollutants to which they are exposed, on their health, a broad study in effects of air pollutants on being exposed to air pollutants and quality of air in Kocaeli, has become a necessary. For this reason, estimation of pollutants concentration with minimum error with air pollution modelling will be ultimately effective in taking necessary measures to decrease negative effects of estimated air pollution in solution of this problem.
In this study, privately in Kocaeli district, modelling of air pollution depending on various meteorological parameters and estimation of air pollution with Adaptive Neuro Fuzzy-Inference System which finds more application in many study fields and gives more successful results in comparison with conventional statistics techniques will be realized. Effects of changes in parameters like direction of wind and its speed, pressure, relative humidity, temperature, clouds level and amount of rain, on concentration of selected air pollutants (evaporable organic compounds except methane, PM2.5 mass, PM10 mass, CO, NOx, NO2, SO2 and O3), will be analyzed.
Determination of pollutant sources in the district and average amount of pollutant emitting from these sources and control of pollution determined by measurement and modelling are very important as a guide in realization of precautions with complete approach. For this reason, average emission amount of pollutants (evaporable organic compounds except methane, PM2.5 mass, PM10 mass, CO, NOx, NO2, SO2 and O3) from sources (domestic, industrial, traffic) effecting outside air quality will be determined by using emission factors based on emission inventory will be determined within this study in Kocaeli city which is heavily exposed to industrial and traffic emission.
Emission inventory studies which did not cover all pollution sources within a limited area will be further developed by covering whole Kocaeli district and adding new parameters, a data base will be established with these inventory data. Atmospheric and metrological variables for all seasons must be applied for the consistency of model. For this purpose, measurements will be made by covering all seasons. Duration of study is estimated approximately 2 years which includes steps of making measurements, completing inventory and modelling works, analyzing results and reporting.

This Agreement is entered into between (1) ....... LIMITED, a company registered in England and Wales under number 2544185 whose registered office is at ......... (Us") and (2) [ ] of [ ] ("You") on [ ].
1 SUPPLY OF EQUIPMENT
1.1 We agree to provide to You free of charge certain equipment (having the serial number [ ]) (the “Equipment”) that is used in the process and application of those products set out in the Schedule (the “Products”) that are manufactured by Us and supplied to you by our distributor, [ ], [Insert full details (name and registered office) of distributor] (“Distributor”).
1.2 We have agreed that Your likely quarterly requirements of Products will be [ ] tonnes. If You fail to purchase a minimum of [ ] tonnes of Product per calendar quarter from our Distributor, We shall be entitled to charge You a monthly equipment rental of [US$] [€ Euro] [£ Sterling] [ ] (“Monthly Rentals”).
1.3 The Equipment shall be installed at such part of the premises set out in the Schedule (“Premises”) as is agreed between You and Us. You will provide (at Your cost) all the necessary mains services for the operation of the Equipment (compressed air, water and electricity).
1.4 Any dates that we give for delivery of the Equipment are estimates only and we will not be liable for the consequences of any delay in delivery. All costs of delivery and carriage (including any insurance, tax or duty (including export and/or import duty) relating to the transportation or delivery of the Equipment shall be borne by You. Such costs and expenses shall be paid by You when invoiced by Us to You.
2 PAYMENTS
The Monthly Rentals are expressed as exclusive of VAT and any all taxes or duties which may be payable. If the Monthly Rentals become payable then You agree to pay them (together with all relevant taxes and duties) to Us within 5 days of the end of each calendar month. Any payment which is not received by Us on the due date for payment will carry interest from that due date to the day on which We receive payment calculated at 5% over the base rate of Barclays Bank plc.
3 INSURANCE
You shall (at Your own cost) insure the Equipment and keep it insured for its full replacement value (being US$ [ ]) (“Replacement Value”) against loss or destruction from all risks against which it is normal and prudent to insure. You agree to comply in all respect with the terms and conditions of the relevant policy or policies of insurance.
4 OBLIGATIONS
You will throughout the term of this Agreement (i) only process or apply the Products in/or through the Equipment (ii) ensure the Equipment is operated and used by trained personnel in accordance with the written instructions issued by Us from time to time, good working practices and the highest standards of safety (iii) keep the Equipment in good repair (fair wear and tear excepted) in accordance with Our instructions (iv) immediately notify Us and cease to use the Equipment if the Equipment develops any fault (v) not fix the Equipment to any land or building (vi) not sell, transfer, let or otherwise dispose of any land or building on which the Equipment is situated or create or permit to subsist any encumbrance affecting or likely to affect the Equipment (vii) not remove any labels or plates (in a form approved by Us) indicating that title to the Equipment is owned by Us (viii) immediately notify Us and the relevant insurers in writing of any material loss, theft, destruction or damage of any kind whatsoever of or to the Equipment (fair wear and tear excepted) (ix) allow Us (and our representatives or agents) on reasonable notice to have access to the Equipment for purpose of servicing the Equipment (x) not make any alteration, addition or modification or carry out any servicing or maintenance to the Equipment (xi) pay Us at our standard rates from time to time for any repairs and/or servicing that is required as a result of any damage caused by You (or Your agents or representatives) or any failure by You to comply with the terms of this Agreement and (xii) not remove the Equipment from the Premises.
5 INDEMNITY
You will be solely responsible for the Equipment whilst it is in Your custody or control and You agree to indemnify and keep indemnified Us (and our representatives and agents) against (i) any loss, theft, destruction of or damage to the Equipment (other than fair wear and tear); (ii) any injury to our employees, agents or representatives caused by your actions, omissions or negligence whilst at the Premises and (iii) subject to clause 8, all actions, claims, demands, proceedings, penalties, fines, liabilities, losses, damages, costs and expenses of whatsoever nature which may be brought against Us or which We may suffer, incur or sustain in connection with or arising directly or indirectly out of Your possession, use, or operation of the Equipment.
6 OWNERSHIP OF EQUIPMENT
Risk in the Equipment shall pass to You on delivery to the Premises. Ownership (legal or beneficial) of the Equipment shall remain with Us and shall not pass to You and You shall have no rights or interest to or in the Equipment other than as set out in this Agreement. You agree not to claim that You are the owner of the Equipment or sell, assign, transfer, mortgage, charge, pledge this Agreement or any rights or obligations under it or the Equipment or sub-hire, sub-let, rent, lend, abandon or otherwise dispose with possession of the Equipment.
7 TERMINATION
7.1 We may by notice in writing to You immediately terminate this Agreement if (i) You fail to pay Monthly Rentals or other sums payable under this Agreement on the due date for payment or (ii) You fail to perform or observe any of the terms and conditions of this Agreement where such failure is capable of being remedied You fail to remedy it within five days or (iii) the Equipment is subject to a total loss or (iv) You fail to purchase the quantities of Products set out in Clause 1.2 or (v) You are wound up or become insolvent or have a receiver or administrative receiver appointed or suffer the appointment or the presentation of a petition for the appointment of an administrator or any equivalent or analogous event occurs or (vi) You cease or threaten to cease to carry on the whole or a substantial part of Your business.
7.2 On the expiration or termination of this Agreement You will immediately cease to use the Equipment. Until collection by Us You will be solely responsible for (and for the cost of) ensuring the safe and proper storage, packing, loading, supervision, custody and insurance of the Equipment. You agree to assist and allow Us (and Our representatives and agents) at Your expense, at any time after termination of this Agreement (with or without notice) to retake possession of and, if necessary, to dismantle the Equipment and for that purpose to enter the location or any other premises where the Equipment is or is believed to be situated and if necessary to sever the Equipment from the premises.
8 LIABILITY
8.1 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Agreement.
8.2 We will not be liable to You in contract, tort (including but not limited to negligence), misrepresentation or otherwise for any economic loss of any kind (including but not limited to loss of profit, business, contracts, revenue or anticipated savings), any damage to Your reputation or goodwill, any product recall costs or any other special, indirect or consequential loss which arise out of or in connection with this Agreement. Nothing in this Agreement excludes or limits Our liability for fraudulent misrepresentation or for any death or personal injury caused by Our negligence.
8.3 Subject to the provisions of clause 8.1 and 8.2 Our total liability arising in connection with the performance of this Agreement and the use of the Equipment will be limited to the Replacement Value.
9 GENERAL
9.1 Ownership in all intellectual property rights subsisting in, resulting from or relating to the Equipment and the application process or any associated plans, descriptions, designs, technical information, drawings, documents or specifications vest exclusively in Us and you agree that nothing in this Agreement shall operate to vest any right, title or interest in the intellectual property rights in the Equipment in You.
9.2 These terms constitute the entire agreement between Us and You in relation to the Equipment and they may only be varied by Us in writing.
9.3 A person who is not party to this Agreement shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement.
9.4 These terms shall be governed by and construed in accordance with the laws of England and for the exclusive benefit of Us the English courts shall have the jurisdiction over any claim or matter arising under or in connection with this Agreement. We shall however have the right to take proceedings against You in any other court of competent jurisdiction.

1 EKİPMAN’IN TEMİNİ
1.1 Bizim tarafımızdan üretilen ve distribütörümüz tarafından [Distribütör’ün tüm detaylı bilgilerini girin (isim ve kayıtlı merkez adresi)] (“Distribütör”) size temin edilen, ekte belirtilen ürünlerin (“Ürünler”) işlenmesinde ve uygulamasında kullanılan belirli ekipmanı ([ ] seri numarasına sahip) (“Ekipman”) Size ücretsiz olarak sağlamayı kabul etmekteyiz.
1.2 Üç aylık Ürün ihtiyacınızın [ ] ton olacağını kabul ettik. Distribütör’ümüzden üç takvim ayı başına en az [ ] ton ürün satın almazsanız, Sizden [ ] [US$] [€ Euro] [£ Sterlin] tutarında aylık ekipman kirası [“Aylık Kiralar”] ücreti talep etme hakkımız olacaktır.
1.3 Ekipman, Siz ve Bizim aramızda mutabakata varıldığı şekilde, Ekte belirtilen tesisin (“Tesis”) belirli bir bölümünde kurulacaktır. Ekipman’ın çalışması için gerekli olan tüm ana hizmetleri (basınçlı hava, su ve elektrik) (maliyeti size ait olarak) karşılayacaksınız.
1.4 Ekipman’ın teslimatı için verdiğimiz tüm tarihler sadece tahminidir ve teslimattaki herhangi bir gecikmeden kaynaklanan sonuçlardan sorumlu değiliz. Ekipman’ın nakliyesi veya teslimatı ile ilgili olan tüm teslimat ve nakliye masrafları (herhangi bir sigorta, vergi veya gümrük vergisi (ihracat ve/veya ithalat vergisi dâhil), tarafımızdan Size fatura edildiğinde Sizin tarafınızdan ödenecektir.
2 ÖDEMELER
Aylık Kiralar, KDV ve ödenmesi gereken tüm vergiler ve harçlar hariç olarak belirtilmiştir. Aylık Kiralar’ın ödenmesi gerekirse, bunları (tüm ilgili vergiler ve harçlar ile birlikte) Bize her bir takvim ayının son 5 günü içinde ödemeyi kabul etmektesiniz. Vade tarihinde Bizim tarafımızdan alınmayan herhangi bir ödemeye, vade tarihinden başlayarak, Bizim ödemeyi aldığımız güne kadar Barclays Bank plc.’nin temel faiz oranına %5 eklenerek hesaplanan gecikme faizi işleyecektir.
3 SİGORTA
Normal olan ve sigortalanması gereken tüm risklere karşı Ekipman’ı (masrafı size ait olmak üzere) sigorta ettireceksiniz ve tam yenileme değeri üzerinden (“Yenileme Değeri”) ([ ] US$) sigorta ettirmeye devam edeceksiniz. Sigorta poliçesi veya poliçelerinin şartlarına ve koşullarına her açıdan uyacağınızı kabul etmektesiniz.
4 YÜKÜMLÜLÜKLER
Bu Anlaşma’nın süresi boyunca, (i) Ekipman’da sadece Ürünler'i işleyeceksiniz veya Ekipman'a sadece Ürünler'i besleyeceksiniz (ii) Bizim tarafımızdan zaman zaman verilen yazılı talimatlara, düzgün çalışma ilkelerine ve yüksek güvenlik standartlarına uygun olarak Ekipman'ın eğitim almış bir çalışan tarafından çalıştırılmasını ve kullanılmasını sağlayacaksınız (iii) Ekipman’ı Bizim talimatlarımıza uygun olarak iyi durumda tutacaksınız (makul aşınma ve yıpranmalar hariç) (iv) Ekipman herhangi bir arıza çıkardığında bizi hemen bilgilendirecek ve Ekipman’ı kullanmaya ara vereceksiniz (v) Ekipman'ı herhangi bir sahada veya binada tamir etmeyeceksiniz (vi) Ekipman'ın bulunduğu herhangi bir sahayı veya binayı satmayacaksınız, devretmeyeceksiniz, kiralamayacaksınız veya bunun dışında elden çıkarmayacaksınız veya Ekipman’ı etkileyecek veya etkileyebilecek herhangi bir ipoteğe izin vermeyeceksiniz (vii) Ekipman’ın Bize ait olduğunu belirten herhangi bir plakayı veya (bizim tarafımızdan onaylanan bir biçimde olan) etiketi sökmeyeceksiniz (viii) ne türden olursa olsun Ekipman’ın maruz kaldığı herhangi bir maddi zararı, hırsızlığı, tahribi veya ziyanı (makul aşınma ve yıpranmalar hariç) yazılı olarak derhal Bize ve ilgili sigortacılara bildireceksiniz (ix) makul bir ihtar verilerek bakım amacıyla Ekipman’a, Bizim (ve temsilcilerimiz veya acentelerimizin) erişimine izin vereceksiniz (x) Ekipman’da herhangi bir değişiklik, ekleme veya düzenleme veya Ekipman'ın onarımını veya bakımını yapmayacaksınız (xi) Sizin (veya Sizin acenteleriniz veya temsilcileriniz) tarafınızdan kaynaklanan herhangi bir hasarın veya bu Anlaşmanın hükümlerine uymamanız nedeniyle zaman zaman oluşan herhangi bir arızanın sonucu gerekli olan herhangi bir bakım ve/veya tamir için standart tarife üzerinden Bize ödeme yapacaksınız ve (xii) Ekipman’ı Tesisler’den kaldırmayacaksınız.
5 TAZMİN
Sizin gözetiminizde veya kontrolünüzde olduğu sürece Ekipman'ın tüm sorumluluğu size aittir ve (i) Ekipman’ın maruz kalacağı herhangi bir zararı, hırsızlığı, tahribatı veya hasarı (kabul edilebilir aşınma ve yıpranma hariç) (ii) Tesisler’deki eylemleriniz, ihmalkârlıklarınız veya dikkatsizliğiniz nedeniyle çalışanlarımızın, acentelerimiz ve yetkililerimizin herhangi bir yaralanmasını ve (iii) Madde 8 uyarınca, Ekipman’ın zilliyetinden, kullanımından ve işletilmesinden dolayı doğrudan veya dolaylı olarak ortaya çıkabilecek veya bunlarla bağlantılı olan, Bize karşı iddia olunan veya Bizim zarara uğrayabileceğimiz, maruz kalabileceğimiz veya karşılaşabileceğimiz, mahiyeti ne olursa olsun tüm eylemleri, iddiaları, talepleri, davaları, para cezalarını, cezaları, zararları, ziyanları, masrafları veya harcamaları bize (ve temsilcilerimize ve acentelerimize) tazmin edeceğinizi ve tazmin etmeye devam edeceğinizi kabul etmektesiniz.
6 EKİPMAN’IN MÜLKİYETİ
Ekipman'ın riski, Ekipman'ın Tesislere gönderilmesi ile size geçecektir. Ekipman'ın mülkiyeti (kanuni veya lehtar) Bizde kalacaktır ve Size geçmeyecektir ve Anlaşma'da belirtilenler dışında Ekipman üzerinde bir hakkınız veya menfaatiniz olmayacaktır. Ekipman'ın sahibi olduğunuzu iddia etmeyeceğinizi veya bu Anlaşma'yı veya bu Anlaşma’da bulunan herhangi bir hakkı veya yükümlülüğü veya Ekipman’ı satmayacağınızı, devretmeyeceğinizi, feragat etmeyeceğinizi, mortgage yapmayacağınızı, borca karşılık göstermeyeceğinizi, ipotek koydurmayacağınızı veya kiralamayacağınızı, icar etmeyeceğinizi kabul etmektesiniz.
7 FESİH
7.1 (i) Bu Anlaşma uyarınca ödenmesi gereken Aylık Kiraları veya diğer tutarları vade tarihinde ödemezseniz veya (ii) Bu Anlaşma’nın herhangi bir hükmünü veya koşulunu gerçekleştirmez veya uymazsanız ve bundan dolayı oluşan sorununun Anlaşma’da belirtilen çaresini beş gün içinde bulmazsanız veya (iii) Ekipman tamamen zarar görürse veya (iv) Madde 1.2'de verilen miktarda Ürünler’i satın almazsanız (v) Tasfiye edilirseniz veya borcunuzu ödeyemez hale gelirseniz veya Size bir kayyım veya idari kayyım atanırsa veya bu atamadan veya bir kayyım atanması için verilen bir dilekçenin ibrazından zarar görürseniz veya buna benzer veya eşdeğeri bir eylem gerçekleşirse (vi) İşinizin tamamını veya büyük bir kısmına son verirseniz veya bu sona erme tehlikesi ile karşılarsanız, Size yazılı ihtarname göndererek Anlaşma'yı feshedebiliriz
7.2 Bu Anlaşma’nın süresi sona erdiğinde veya Anlaşma feshedildiğinde, Ekipman’ı kullanmaya hemen son vereceksiniz. Bizim elimize geçinceye kadar, Ekipman’ın güvenli ve düzgün depolanmasından, paketlenmesinden, yüklenmesinden, nezaretinden, gözetiminden ve sigortalanmasından (masrafı size ait olarak) Siz sorumlu olacaksınız. Bu Anlaşma’nın feshinden (ihtarlı veya ihtarsız) sonra herhangi bir zamanda Ekipman’ın geri alınması ve gerekli ise Ekipman'ın sökülmesi amacıyla Ekipman'ın bulunduğu veya konulduğu düşünülen yere veya bir başka tesise girmek için ve gerekli ise Ekipman’ın tesislerden ayrılması için Bize (ve Bizim temsilcilerimize ve acentelerimize) yardım edeceğinizi ve izin vereceğinizi kabul etmektesiniz.
8 SORUMLULUK
8.1 Mevzuat ve genel hukukun açıkça belirttiği, Yasaların tam olarak izin verdiği ölçüde, tüm garantiler, yükümlülükler ve diğer şartlar Anlaşma’ya dâhil edilmemiştir.
8.2 Sözleşme, haksız muamele (ihmal dâhil fakat bununla sınırlı olmamak üzere), gerçeğe aykırı beyanat veya ne türden olursa olsun herhangi bir ekonomik zarar (kar, iş, sözleşme, gelir veya beklenen tasarruf zararı dâhil fakat bunlarla sınırlı olmamak üzere), saygınlığınıza veya ticari itibarınıza gelebilecek herhangi bir zarar, herhangi bir ürün geri alma maliyeti veya diğer özel, dolaylı veya bu Anlaşma’dan kaynaklanan veya bağlantılı olan zarardan dolayı Size karşı sorumlu olmayacağız. Bu Anlaşma’daki hiç bir şey, yalan beyan veya Bizim ihmalimiz sonucu meydana gelen herhangi bir ölüm veya kişisel yaralanma için sorumluluğumuzu ortadan kaldırmaz veya sınırlandırmaz.
8.3 Madde 8.1 ve 8.2’nin hükümlerine tabi olarak, Bu Anlaşma’nın yürütülmesi ve Ekipman’ın kullanımı ile bağlantılı olan toplam sorumluluğumuz Yenileme Değeri ile sınırlı olacaktır.
9 GENEL
9.1 Ekipman'da bulunan, Ekipman'dan kaynaklanan veya Ekipman ile bağlantılı ve herhangi bir uygulama prosesinde, planda, tanımlamada, tasarımda, teknik bilgide, çizimlerde, dokümanlarda veya spesifikasyonlarda bulunan, bunlardan kaynaklanan veya bunlarla bağlantılı tüm fikri mülkiyet hakları yalnızca Bize aittir ve Bu Anlaşma’daki hiç bir şeyin, Ekipman’daki fikri mülkiyet haklarında Size herhangi bir hak, yetki veya menfaat vermeyeceğini kabul etmektesiniz.
9.2 Ekipman ile ilişkin olarak bu hükümler Siz ve Bizim aramızdaki tüm anlaşmayı oluşturmaktadır ve sadece bizim tarafımızdan yazılı olarak değiştirilebilir.
9.3 Bu Anlaşma’nın taraflarından biri olmayan bir şahıs, 1999 tarihli Sözleşmeler Kanununa (Üçüncü Tarafların Hakları) göre bu Anlaşma’nın herhangi bir hükmünü yürütme hakkına sahip değildir.
9.4 Bu hükümler İngiltere kanunlarına göre yürütülür ve yorumlanır ve Bizim özel faydamız için, Bu Anlaşma'da veya Anlaşma ile bağlantılı olarak çıkabilecek herhangi bir davanın ve anlaşmazlığın halli için İngiliz mahkemeleri yetkilidir.

Source text - English Executive Decree No. 08-314 of 7 Chaoual 1429 corresponding to October 7, 2008 amending and completing Executive Decree No. 07-127 of 17 Rabie Ethani 1428 corresponding to May 5, 2007 concerning the delimitation and classification of the mining property into zones and the definition of prospecting, exploration and production blocks.
Art. 2. — Prior to performing any hydrocarbon activity, an environmental impact study has to be presented to the hydrocarbon regulatory authority by the interested contracting party or operator, designated hereinafter as the applicant.
This environmental impact study must include an environmental management plan which must contain the description of the preventive and environmental risk management measures associated with said activities pursuant to environmental legislation and regulations currently in force.
Art. 5. — Any modification of the perimeter of “hydrocarbon” activities, the size of facilities, the treatment and/or production capacity or anticipated technology procedures requires that an environmental impact study be submitted by the applicant to the regulatory hydrocarbon authority.
Any legal entity may engage in the Transportation and Storage of petroleum products in compliance with environmental regulations as set forth in Law No. 014/PR/98 of August 17, 1998. The procedures for obtaining construction of works and for their operation are set forth by regulation.
Natural Gas shall be used according to the following order of priority:
a. use by the Holder for the requirements of petroleum operations, specifically for production operations or re-injection into the deposit for purposes of assisted recovery;
b. to meet the local market requirements at a preferential price; the specific provisions for establishment of the price shall be set forth in the Petroleum Agreement;
c. exportation, before or after transformation.

Madde 5- “Hidrokarbon” faaliyetlerinin yapıldığı yerin, tesislerin bulunduğu alanın, arıtma işleminin ve/veya üretim veya öngörülen teknolojik proseslerin gerçekleştiği yerin çevresinde yapılacak herhangi bir düzenleme yapılması durumunda, başvuran, bir çevre etki çalışmasını hidrokarbonlardan sorumlu yetkili merciye sunmalıdır.
Herhangi bir tüzel kişi, 17 Ağustos 1998 tarihli ve 014/PR/98 No.lu kanunda belirtilen çevre mevzuatına uygun olarak, petrol ürünlerinin Taşıma ve Depolama işiyle uğraşabilir. Bu tür işletmelerin yapımına ve işletilmesine ilişkin usuller mevzuatla düzenlenir.
Doğal Gaz aşağıda belirtilen öncelik sırasına göre kullanılacaktır:
a. Başta üretim işlemleri veya ürünün destekli geri kazanımı amacıyla doğal gazın, doğal gaz yatağına yeniden aktarılması olmak üzere, petrol üretim işlemleri ihtiyaçları için Lisans Sahibi tarafından kullanımı;
b. Asgari tarife fiyatından iç piyasanın ihtiyacını karşılamak için. Fiyatın belirlenmesine dair özel hükümler petrol anlaşmasında belirtilecektir;
c. Doğal gazın işlenmesinden önce veya sonra ihracatı.

Source text - English Burmali Sutun, or the Serpent Column, is an eight-meter high column that depicted three serpents intertwined. It is more than 2,000 years old and once stood in front of the Temple of Apollo in Delphi. By 324 AD, the Roman Emperor Constantine I had the column transported to Constantinople, now Istanbul. The three snake heads are no longer attracted to column, although one of the pieces is located in the Istanbul Archaeology Museum.
The Alman Çeşmesi, or German Fountain, is a fountain located in Sultanahmet Square. It was constructed in 1898 in Germany and then transported two years later to Istanbul as a gift from the German Emperor Wilhelm II. This neo-Byzantine structure features an eight-sided dome with golden mosaics on the interior.
The Örme Sütun, also known as the Column of Constantine Porphyrogenetus and the Walled Obelisk, is a 32-meter-high monument. It was named after Constantine VII Porphyrogenetus. Located in Sultanahmet Square, the obelisk had bronze plates and golden lettering until soldiers from the Fourth Crusade stole them in 1204.
The Misir Dikilitasi, or Obelisk of Theodosius, is a historic monument dating back to Ancient Egypt. Pharaoh Tutmosis III built the obelisk in 1450 BC as a celebration of his victory on the banks of the Euphrates River. It was transported to Constantinople, now Istanbul, in 390 AD by the Emperor Theodosius I. The monument is 19.59 meters high with depictions of Thutmosis' victories.

1. Çalışma Saatleri:
XXXXX International İthalat İhracat ve Pazarlama Ltd Şti. (bundan böyle “XXXXX International” olarak anılacaktır) aşağıda belirtilen koşullar ve çalışma saatlerinde servis hizmetini yerine getirmekle yükümlüdür.
a) Servis hizmeti XXXXX International çalışanı olan teknik ekip tarafından Pazartesi‘den Cuma’ya 08:30 – 18:00 saatleri arasında verilecektir. (XXXXX International teknik ekibinin gerekli görmediği halde Müşteri’nin isteği üzerine yurtdışından teknisyen getirtilmesi durumunda; tüm masraflar sözleşme bedeli haricinde fatura edilmek suretiyle Müşteri tarafından karşılanacaktır.)
b) Pazar ve resmi tatil günleri ile madde 1a’da belirtilen saatler dışında verilen servis hizmeti, ulaşım ücreti dahil edilmeksizin XXXXX International’ın belirlemiş olduğu normal mesai saati ücreti üzerinden hesaplanarak Müşteri’ye ayrıca fatura edilecektir. Ancak Müşteri mesai saatleri içerisinde arıza bildiriminde bulunduğu halde XXXXX International teknik ekibinin Müşteri’ye mesai saatleri dışında ulaşması ve mesai saatleri içerisinde başlayan bir müdahalenin mesai saatleri dışında da devam etmesi durumlarında Müşteri’den herhangi bir ücret talep edilmez. Her ay bir sonraki aya devrolmamak kaydı ile 30 saatlik fazla mesaili çalışma bedelsiz olarak verilecektir.
c) Servis hizmeti esnasında gereksinim duyulan yedek parçalar madde 1a’da belirtilen çalışma saatlerinde temin edilebilmektedir. Belirtilen bu çalışma saatlerinin dışındaki parça temini gecikmelerinden XXXXX International sorumlu tutulamaz.
d) Bakımlı sözleşmelerde talep edilen bakım tarihinin, Müşteri tarafından en az 3 hafta önce bildirilmesi gerekmektedir.
2. XXXXX International’ın Yükümlülükleri:
Servis hizmeti Müşteri’ye ait makinelerin kesintisiz/sorunsuz çalışacağını garanti edemez.
XXXXX International iş bu sözleşme ile aşağıdaki maddeleri yerine getirmekle yükümlüdür:
a) Müşteriden gelen servis çağrılarına cevap vermek ve mümkün olan en kısa sürede servis elemanını Müşteri’ye yönlendirmek
b) Üretici firma tarafından makine üzerinde yapılması mecbur tutulan ve/veya tavsiye edilen teknik değişiklikleri Müşteri’ye haber vermek ve zorunlu hallerde bedelsiz; isteğe bağlı durumlarda ise Bakım Sözleşmesi kapsamı haricinde fatura edilmek suretiyle gerçekleştirmek
c) Müşteri’nin isteği doğrultusunda XXXXX International tarafından onaylanan ve makinenin teknik spesifikasyonlarına uygun teknik değişiklikleri, Bakım Sözleşmesi kapsamı haricinde fatura edilmek suretiyle gerçekleştirmek
d) Bakımlı sözleşmeler için, bakım sözleşmesinin başlamasını müteakiben Ek 1’deki listede yer alan makine/makinelerin yıllık bakımlarını, Müşteri’nin en az 3 hafta öncesinden bildirdiği ve uygunluğu XXXXX International tarafından onaylanan tarihte yapmak
3. Müşterinin Yükümlülükleri:
İş bu sözleşme ile Müşteri aşağıdaki şartları ve maddeleri yerine getirmeyi taahhüt eder.
a) Müşteri; sözleşmeye konu olan makine/makineleri, XXXXX International’ın ve üretici firmanın yazılı ve sözlü talimatları doğrultusunda ve her halükarda makul bir standarda uygun bir şekilde muhafaza edip kullanacağını garanti eder. Buna göre makine/makinelerin günlük, haftalık Müşteri’ye ait, aylık rutin bakımlar da XXXXX International’ın sorumluluğundadır.
b) Müşteri; XXXXX International’a bilgi vermeksizin Servis işlerini arttırıcı veya ağırlaştırıcı hiçbir değişiklik yapamaz/üçüncü şahıslara yaptıramaz. Müşteri, emniyet kapaklarını, emniyet bağlantılarını veya emniyet tertibatını çıkartarak, modifiye ederek veya iptal ederek güvenliği tehlikeye atmamalıdır. Güvenliğin tehlikeye atıldığı bu tarz durumlarda her türlü sorumluluk Müşteri’ye aittir.
c) Müşteri; XXXXX International’a danışmadan ve XXXXX International’ın yazılı onayını almadan makinelerin verimini arttırıcı veya kullanımını kolaylaştırıcı hiçbir değişiklik yapamaz/üçüncü şahıslara yaptıramaz. Müşteri; mümkün olabilecek değişiklikleri Bakım Sözleşmesi kapsamı haricinde, yedek parça ve işçilik bedellerini ödemek suretiyle XXXXX International teknik ekibine yaptıracaktır.
d) Müşteri; masrafları kendisine ait olmak üzere, makine/makinelerin düzgün çalışması için gerekli elektrik enerjisi veya benzeri sistemlerin maliyetleri ile klimatizasyon ve diğer alt yapı tesislerinden sorumlu olacaktır. Müşteri, XXXXX International’ın Servis hizmeti verebilmesi için, iş bu sözleşme kapsamındaki makine/makinelerin kurulu bulunduğu yerde, üretici firmaların ve XXXXX International’ın öngördüğü gerekli çevre ve işletim koşullarını (uygun sıcaklık, nem, zemin kalitesi, elektrik akımı, su vb.) sağlamakla yükümlüdür. Önerilen koşullara uyulmaması halinde doğabilecek hata, arıza ve aksaklıklar Bakım Sözleşmesi’nin kapsamı dışında olup, XXXXX International tarafından, Müşteri’ye ayrıca fatura edilmek suretiyle giderilecektir. XXXXX International, elektrik kesintilerinden zarar görülmemesi için makinelere UPS veya regülatör bağlanmasını önermektedir.
e) Müşteri, daha önce XXXXX International’a bildirdiği ve XXXXX International tarafından kabul edilen bakım tarihiyle ilgili değişikliği en az 2 iş günü önce XXXXX International’a yazılı olarak bildirmekle yükümlüdür. Aksi halde bakım için gönderilen XXXXX International teknik ekibinin ulaşım masrafları ile yolda geçen süre Müşteri’ye fatura edilecektir. Yeni bakım tarihi madde 1’e göre belirlenecektir.
f) Bakım Sözleşmesi - Ek 1’de listelenen makine/makinelere yapılacak her türlü müdahale, yalnızca XXXXX International teknik ekibinin yetkisi altındadır. Müşteri ancak XXXXX International teknik ekibi gözetiminde ya da onun direktifleri doğrultusunda belirli müdahalelerde bulunabilir. Bunun haricinde üçüncü şahıslar veya bizzat Müşteri tarafından yapılan müdahalelerden doğabilecek yedek parça sorunları ve arızalardan XXXXX International sorumlu tutulamaz. Bu arızaların giderilmesi ve ihtiyaç duyulan yedek parçaların temin edilmesi Bakım Sözleşmesi kapsamında yer almaz.
g) Bakım sözleşmesi Ek 1’de listelenen ve bakım sözleşmesi kapsamına giren makine/makinelere ait bakım veya bakımların anlaşma süresi içerisinde XXXXX International teknik ekibine yaptırılmaması durumunda, kazanılmış bakım veya bakımlar bir sonraki anlaşma dönemine aktarılamaz.
4. Yedek Parça:
XXXXX International sektörün ve makine portföyünün genel ihtiyaçları doğrultusunda stok miktar ve çeşidine kendisi karar verir, tüm yedek parçaları stokta bulundurmak zorunda değildir, Stokta parça bulunmadığı için Müşterilerin karşılaştığı maddi/manevi zararlardan XXXXX International sorumlu tutulamaz. XXXXX International’dan alınan ve XXXXX International personelinin değiştirdiği yedek parçaların garanti süresi, parçaya bağlıdır. Sarf malzemeleri ve aşınan parçalar ile dış etkenlerden ve kullanım hatasından kaynaklanan arızalar garanti kapsamında değildir. Müşterilerin kendi tespitleri doğrultusunda sipariş edilen yedek parça/parçaların yanlış olması halinde XXXXX International söz konusu parçayı geri almaz ve Müşteri’ye bu konuda herhangi bir geri ödeme yapmaz. XXXXX International teknisyenin tespit ettiği yedek parça/parçaların yanlış olması halinde söz konusu parça koşulsuz olarak geri alınır ancak konu ile ilgili herhangi bir maddi/manevi zarardan XXXXX International sorumlu tutulamaz. XXXXX International’ın kendisinden kaynaklanmayan nedenlerle parça teslim sürelerinin aşılması ya da yanlış parçanın gelmesi durumunda Müşteri’nin karşılaştığı maddi ve/veya manevi zararlardan XXXXX International sorumlu tutulamaz. Arıza tespiti için deneme amaçlı olarak getirilecek olan yedek parça/parçaların acil istenmesi durumunda aciliyet masrafı Müşteri’ye aittir. Garanti kapsamı dışında değiştirilen parçaların arızalıları Müşteri’ye teslim edilir. Müşteri almadığı parçalar üzerinde herhangi bir hak iddia edemez.
Servis sırasında tespit edilen ve değiştirilmesi gereken yedek parçalar Müşteri’nin onayı alınarak XXXXX International tarafından değiştirilecek ve Müşteri’ye ayrıca fatura edilecektir.
5. Tüketim Malzemeleri:
İş bu sözleşme kapsamındaki makine/makinelerde kullanılacak tüm tüketim malzemelerinin, üretici firma tarafından belirlenmiş standartlarda olması gerekmektedir. Servis sırasında kullanılacak tüketim malzemelerini sağlamak Müşteri’nin sorumluluğunda olup; Müşteri bu malzemelerin uygunluğu ile ilgili XXXXX International’dan yazılı onay almakla yükümlüdür. Tüketim malzemelerinin eksikliğinden dolayı rutin servisin ya da bakımın uzamasından XXXXX International sorumlu tutulamaz. Müşterinin tüketim malzemelerini temin edememesi durumunda malzemeler, Bakım Sözleşmesi kapsamı dışında fatura edilmek suretiyle, XXXXX International tarafından temin edilecektir.
6. Ödeme:
Bakım Sözleşmesi - EK 1’de belirtilen aylık servis hizmeti bedeli Müşteri’ye her ayın sonunda fatura edilecektir. Servis hizmeti haricindeki hizmet / yedek parça / tüketim malzemeleri ise hizmetin gerçekleştirildiği tarihte ayrıca fatura edilecektir. Müşteri, XXXXX International tarafından faturalanan hizmetleri, fatura kesim tarihinden itibaren 30 (otuz) gün içerisinde ödemekle yükümlüdür. Bu sürenin (vadenin) dolmasından itibaren herhangi bir ihtara gerek olmaksızın borç muaccel hale gelir. Ödemenin gecikmesi durumunda XXXXX International kanunun izin verdiği maksimum oranda aylık gecikme faizini uygulama hakkını saklı tutar. Müşteri, buna karşı hiç bir surette itirazda bulunmayacağını, buna ilişkin her türlü defi, itiraz ve dava hakkından peşinen feragat ettiğini beyan, kabul ve taahhüt eder.
7. Bakım Sözleşmesi Kapsamında Bulunmayan Haller:
İş bu sözleşme aşağıdaki halleri kapsamına almamaktadır. Müşteri aşağıda sayılan hallere ilişkin olarak hiç bir surette itirazda bulunmayacağını, buna karşı her türlü defi, itiraz ve dava hakkından şimdiden feragat ettiğini beyan, kabul ve taahhüt eder. Buna göre iş bu sözleşme;
a) Sözleşmeye konu olan ve Ek 1’de listelenen makine/makinelerin bulundukları yerlerden sökülmesi, taşınması, tekrar kurulması ve servis veya bakım işlermleri öncesinde temizlenmesini,
b) Sözleşmeye konu olan ve Ek 1’de listelenen makine/makineler için ilave eğitimler verilmesini,
c) Yangın, deprem, yıldırım düşmesi, sel baskını v.b. doğal afetler, resmi makamların fiilleri, ülkedeki olağanüstü haller, isyan, ayaklanma, harp, iç karışıklık, karantina, ambargo, savaş, terör olayları, grev, lokavt gibi olağanüstü hallerden doğabilecek aksaklıklar ve hasarları,
d) Bakımlı sözleşmeler için; sözleşme süresince müşteriden kaynaklanan nedenler dolayısıyla yapılamayan bakımların, sözleşme süresi bitiminden sonra bedelsiz olarak yapılmasını,
e) XXXXX International’ın tavsiye ettiği sarf malzemeler haricindeki malzemelerin kullanımından doğan arızaların giderilmesini,
f) Üretici firma tarafından üretilmemiş olan makinelerin verimini artırıcı ve/veya kullanımını kolaylaştırıcı teknik değişikliklerin yapılmasını,
g) XXXXX International’dan satın alınmamış olan orijinal parçaların ve/veya makinenin orijinal parçalarından farklı parçaların makinelere takılmasını ve/veya takılmış olan bu tip parçaların neden olduğu arıza ve hasarların XXXXX International teknik ekibi tarafından giderilmesini kapsamamaktadır.
h) Sözleşmeli makinelerde parça eksikliğinden ya da eskiliğinden kaynaklanan arızalarda, XXXXX International’ın yazılı uyarısına rağmen parça alımı/değişimi yapılmadığı için arızanın tekrar etmesi halinde, söz konusu arıza sözleşme kapsamı dışında değerlendirilir ve Müşteri’ye ayrıca fatura edilir.
j) Normal kullanım sonucu oluşan aşınma, kaza, normal dışı ve kötü kullanım, kullanım kılavuzuna aykırı kullanma, ihmal, kullanım hatası, virüsler, 3. şahısların müdahalesi ve XXXXX International tarafından yapılmayan her türlü müdahale ve bunlar sonucu ortaya çıkabilecek arızaların giderilmesi garanti ve sözleşme kapsamı dışındadır. Söz konusu durumlar Müşteri’ye ayrıca fatura edilmek sureti ile giderilecektir.
k) Dışarıda tamir ettirilmiş elektronik parçaların XXXXX International personeli tarafından makineye takılması yasaktır. Dışarıda tamir ettirilmiş mekanik parçaların montajı XXXXX International personeli tarafından yapılabilir ancak söz konusu parçanın makineye vereceği zararlardan XXXXX International sorumlu tutulamaz. Bu tür durumlarda söz konusu arızanın giderilmesi için gereken yedek parça ve servis ücreti, bakım sözleşme bedelinden ayrı olarak faturalandırılır.
8. Bakım Sözleşmesini Bozan Haller:
İş bu Bakım Sözleşmesi aşağıdaki durumlarda geçerliliğini kaybeder. Müşteri aşağıda sayılan hallere ilişkin hiç bir surette itirazda bulunmayacağını, buna karşı her türlü defi, itiraz ve dava hakkından şimdiden feragat ettiğini beyan, kabul ve taahhüt eder.
a) Sözleşmeye konu olan ve Ek 1’de listelenen makine/makinelerden biri veya birkaçının satılması;
b) Bakım Sözleşmesinin aylık ödemelerinin Müşteri tarafından zamanında yapılmaması; (Bu gibi anlaşmazlık durumlarında 11. Madde’de yer alan fesih konusu ile ilgili uygulamalar geçerli olacaktır.)
c) Makine/Makineler üzerinde XXXXX International’ın yazılı izni olmadan teknik değişiklikler yapılması;
d) Makine/Makinelerin, XXXXX International’ın ve üretici firmanın yazılı ve sözlü talimatları doğrultusunda ve her halükarda makul bir standarda uygun bir şekilde kullanılmaması;
e) XXXXX International tarafından Müşteri’ye tavsiye edilen çevre ve işletim koşullarına uyulmaması ve/veya bu koşulların iyileştirilmesine yönelik tedbir alınmaması;
f) Makine/Makinelerin XXXXX International’a yazılı haber verilmeden ve onay alınmadan başka bir yere taşınması;
g)Makine/Makinelere XXXXX International teknik ekibi ve XXXXX International teknik ekibi gözetimindeki Müşteri personeli haricindeki üçüncü kişiler tarafından müdahale edilmesi durumlarında işbu sözleşme geçerliliğini kaybedecektir.
9. Zorunlu Haller:
Yangın, deprem, sel baskını, kar yağışı v.b. gibi doğal afetler, resmi makamların fiilleri, ülkedeki olağanüstü haller, isyan, ayaklanma, harp, iç karışıklık, karantina, ambargo, grev, lokavt, sokağa çıkma yasağı, terör olayları v.b. gibi olağanüstü durumlarda verilecek servis hizmetinin gecikmesinden veya yapılamamasından XXXXX International sorumlu tutulamaz. XXXXX International’ın kontrolü altında bulunmayan bu tip durumlarda XXXXX International Müşteri’yi servis hizmetinin gecikeceğinden veya yapılamayacağından haberdar etmek zorundadır.
10. Nüshalar:
İşbu sözleşme 1 (bir) orijinal nüsha olarak hazırlanmıştır. Damga vergisi Müşteri’ye aittir.
11. Sözleşmenin Süresi:
Taraflar süre bitiminden en az 15 (onbeş) gün önce sözleşmeyi fesh etmedikleri takdirde sözleşme kendiliğinden devam eder. Servis sözleşme aylık bedeli Müşteri ile anlaşarak değiştirilebilir.
Müşteri’nin ödeme taahhütlerini yerine getirmemesi durumunda, XXXXX International Bakım Sözleşme kapsamını feshedebilir ve verilmiş olan parça ve servisleri standart tarifeler üzerinden faturalandırabilir. Bakım Sözleşmesi iptal edildikten sonra Müşteri’ye verilecek olan servisler ve tedarik edilecek olan yedek parçalar XXXXX International Türkiye standart tarifeleri üzerinden faturalanacaktır.
Bakımlı sözleşmeler için, Müşteri’nin bakım yaptırdıktan sonra sözleşmeyi fesh etmesi halinde, bakım ücreti XXXXX International’ın söz konusu tarihte geçerli olan saat ücretleri üzerinden hesaplanarak Müşteri’ye ayrıca fatura edilir.
12. Sözleşmenin Devri:
Müşteri XXXXX International’ın yazılı onayını almadan sözleşmeden doğan hak, yetki ve sorumlulukları başka bir kuruluşa ve/veya şahsa devredemez. Buna mukabil XXXXX International makine veya bu sözleşme üzerindeki hak, mülkiyet veya menfaatlerinin tamamını veya bir kısmını veya bu sözleşme çerçevesinde herhangi bir nedenle ödenecek olan meblağların tamamını veya bir kısmını devredebilir.
13. Sözleşmenin Değiştirilmesi
İş bu sözleşme, taraflarca usulü çerçevesinde imzalanmış bir belge ile yapılmadığı sürece tadil veya tebdil edilemez.
14. Yetkili Yargı:
İşbu sözleşme hükümlerinin uygulanmasında doğabilecek her türlü uyuşmazlığın çözüm mercii İstanbul Mahkemeleri ve İstanbul İcra Daireleri’dir.
Sözleşme düzenlendikten sonra taraflarca okunup imzalanmıştır.
XXXXX INTERNATIONAL Ltd. Sti. MÜŞTERİ
Translation - English GENERAL TERMS OF SERVICE CONTRACT:
1. Working Hours:
XXXXX International İthalat İhracat ve Pazarlama Ltd Şti. (hereinafter referred as XXXXX International) shall be responsible for providing services under following conditions and working hours.
a) Service shall be provided by technical staff of XXXXX International from Monday to Friday between 08:30 AM – 6:00 PM. (In the case that any foreign technical personnel is temporally hired from any other country upon request of the customer where XXXXX International technical staff does not find it to be necessary, the customer shall cover all related expenses which shall be invoiced separately from contract price.)
b) Maintenance services provided, except on Sunday, official holidays and hours stated in Article 1a shall be separately invoiced to the Customer without including travel expenses and calculated per normal hourly time fee determined by XXXXX International. However, in case the Customer calls for a malfunction within normal daily working time, if XXXXX technical staff arrives at the site outside the normal daily working time and any maintenance work extends over normal daily working time, no extra fee shall be charged to the Customer. Each month, 30 hours overtime maintenance shall be provided without any charge. This shall not be added to the next month period.
c) Spare parts needed for service may be provided within working hours stated in Article 1a. However, XXXXX International shall not be held responsible for any delay in providing the above mentioned spare parts outside the working hours stated.
d) For the contracts including maintenance, the maintenance date should be notified 3 weeks earlier by the Customer .
2. Obligations of XXXXX International
Service shall not give any guarantee for uninterrupted/trouble free working of machines belonging to the Customer.
XXXXX International shall be obliged to execute the following articles as per the contract hereof:
a) To respond to the service calls and send service personnel to Customer's site as soon as possible.
b) To inform the customer of changes and modifications on the machine which the manufacturer of the machine may deem mandatory and/or recommend and; To implement these changes without any charge in obligatory conditions; by invoicing outside the scope of the Maintenance Contract in case of a request by the Client.
c) To implement technical changes which are consistent with the specifications of the machine and approved by XXXXX International upon Customer's request. These shall be invoiced outside the scope of the Maintenance Contract.
d) For the contracts including maintenance, To carry out annual maintenance of machines listed in Annex 1 on the date which the Customer has been notified at least 3 weeks in advance and approved by XXXXX International.
3. Obligations of the Customer:
The Customer shall commit to execute following conditions and articles in the framework of this contract.
a) The Customer; shall guarantee to use and keep machine/machines under the contract in accordance with the written and oral instructions of XXXXX International and the manufacturer firm and compliant to reasonable standards anyway. According to this, XXXXX International shall be responsible for monthly maintenance of machine/machines, whereas The Customer shall be responsible for daily and weekly maintenance.
b) The Customer may not make any changes which increase or make services difficult without informing XXXXX International/ have it done by any third party . The Customer should not compromise safety by removing, modifying or aborting safety hatches, safety connections or safety devices. In such cases where safety is compromised, the Customer shall be responsible.
c) The Customer may not make any modifications for increasing productivity of machines or facilitating easy use without consulting with XXXXX International and written approval of XXXXX International/have it done by any third party . The Customer shall have possible changes made by XXXXX International technical staff by paying for spare parts and labour cost except the scope of the Maintenance Contract.
d) The Customer shall be responsible for electrical power and similar systems required for proper working of machine/machines at its own expense, including air conditioning and other infrastructures. The Customer shall be responsible for providing environmental and operational conditions (proper temperature, moisture, ground class , electrical current, water etc.) required by the manufacturer firm and XXXXX International at the site where machine/machines are installed for XXXXX International to provide Services. In case of failing to comply with recommended conditions, any fault, malfunction and breakdown caused by such omissions shall be out of Maintenance Contract's scope. These shall be fixed and corrected by XXXXX International with a separate invoice. XXXXX International recommends UPS and regulators connected to machines to avoid electrical outage hazards.
e) The Customer shall inform XXXXX International in writing for any change of maintenance date at least 2 working days before the agreed date the Customer stated and accepted from XXXXX International. Otherwise, travel expenses of XXXXX technical staff and time elapsed during travel shall be charged to the Customer. New maintenance dates shall be determined in accordance with the Article 1.
f) Maintenance Contract - Only authorized XXXXX International technical staff shall carry out any type of maintenance activities on machine/machines listed in Annex 1. However, the Customer may carry out some maintenance activities under supervision of XXXXX International technical staff or in accordance with the instructions given by XXXXX International. Except these, XXXXX International shall not be responsible for spare parts problems and malfunctions caused by the maintenance activities carried out by any third parties or the Customer itself. Trouble shooting of such malfunctions and supply of spare parts needed are out of Maintenance Contract's scope.
g) In the case that the Customer has not had or requested the maintenance activity of machine/machines listed in Annex 1 of Maintenance Contract under the scope of this contract carried out by XXXXX International technical staff, acquired maintenance and maintenances may not be transferred to the next contract term.
4. Spare Parts:
XXXXX International itself shall determine stock amount and type of spare parts in accordance with general requirements of the industrial and machine range; XXXXX International may not have to include all spare parts in its stock; XXXXX International shall not be responsible for any kind of material/non material losses of the Customer due to lack of spare parts in the stock. Guarantee period of spare parts purchased from XXXXX International and replaced by XXXXX International technical staff depends on type of spare parts. Consumables and wear parts and malfunctions caused by external conditions and misuse are not covered by the guarantee. In the event that spare part/parts ordered by the Customer based on their assessments are not the correct spare parts, XXXXX International shall not take this spare part back and reimburse any amount to the Customer. In the event that spare part/parts determined by XXXXX International technical staff are wrong, said spare part shall be unconditionally taken back. However, XXXXX International shall not be held responsible for any material/immaterial losses caused by said part. In the event that there is an extended delivery term of spare parts or wrong spare parts delivered due to reasons not caused by XXXXX International, XXXXX International shall not be held responsible for any material/immaterial losses to the Customer. In the even that tentative spare part/parts which are urgently required for troubleshooting purposes , all costs regarding urgent delivery of such parts shall be charged to the Customer. Replaced damaged parts which are out of guarantee coverage shall be returned to the Customer. The Customer shall have no right for the parts not taken by them .
Spare parts determined during service and required to be changed, shall be replaced by XXXXX International with the improvement of the Customer and separately charged to the Customer.
5. Consumables:
All consumables used in the machine/machines under the contract hereby must be in accordance with the standards determined by the manufacturer firm. The Customer is responsible to supply such consumables during service; The Customer should have written approval from XXXXX International for the compliance of such materials. XXXXX International shall not be held responsible for any extension of time of routine service or maintenance due to lack of consumables. In the event that the Customer fails to supply consumables, such consumables shall be supplied by XXXXX International and these shall be charge separately from the Contract's scope.
6. Payment:
Monthly service charge specified in Maintenance Contract - Annex 1 shall be invoiced to the Customer at the end of each month. Service/spare parts/consumables which are out of the service contract's scope shall be separately invoiced on the date of such services. The Customer shall be obliged to render payment for the services invoiced by XXXXX International within 30 (thirty) days after the date of the invoice. The debt shall be due beginning from expiry of this term (time) without any further notification. In case of postponement of payment, XXXXX International shall reserve the right to charge maximum monthly interest allowed by the law. The Customer declares, accepts and undertakes that the Customer shall not enter any plea and waive all rights of plea, appeal and action related to this in any way.
7. Situations Which are Not Within the Scope of The Contract:
This contract hereby does not cover following situations. The Customer declares, accepts and undertakes that the Customer shall not enter any plea and waive all rights of plea, appeal and action related to the following conditions in any way. According to this, the contract does not cover:
a) Removal from their location, moving, or reinstalling the machine/machines listed in Annex 1'de under this contract and cleaning these before service or maintenance activities;
b) Providing additional training for the machine/machines listed in Annex 1 under this contract.
c) Problems and damages that may arise due to extraordinary conditions such as an act of God including, but not limited to: fires, earthquakes, floods, acts of official authorities, riot, commotion, war, embargo, strikes, lock outs or disorder, acts or threats of terror etc.;
d) For the contracts with maintenance: To carry out any maintenance activity free of charge, not made due to reasons caused by the Customer during the term of the Contract after the termination of the Contract;
e) Troubleshooting malfunctions caused by using the materials apart from consumables recommended XXXXX International;
f) Making technical modifications not developed by the manufacturer firm, which increase productivity and/or easy use of machines;
g) Replacing original parts which are not purchased from XXXXX International and/or not original parts on machines and/or to troubleshoot any malfunctions and damages caused by this type of replacement parts by XXXXX International technical staff.
h) For the malfunctions of machines under this contract due to lack of parts or very old parts; despite the written notification of XXXXX International, if the malfunctions repeat due to fact that Customer failed to purchase/replace new parts, such maintenance shall be considered out of Contract's scope and charged separately to the Customer.
j) Wear due to normal use, accident, abnormal and misuse, use inconstant with User Manual, negligence, usage error, computer viruses, intervention of third parties and all type of action not made by XXXXX International and troubleshooting of malfunctions caused by these are out of guarantee coverage and Contract's scope. Such malfunctions shall be corrected and charged separately to the Customer.
k) It is forbidden for XXXXX International staff to replace electronic parts on machines which have been repaired by third parties. XXXXX International staff may install mechanical parts repaired by third parties. However, XXXXX International shall not be held liable for any damages on machines caused by said parts. In such circumstances, spare parts and service costs required to troubleshoot such malfunctions shall be separately charged from the maintenance contract price.
8. Situations which violate the Maintenance Contract:
This Maintenance Contract shall hereby be void under the following conditions. The Customer declares, accepts and undertakes that the Customer shall not enter any plea and waive all rights of plea, appeal and action related to following conditions in any way.
b) If the Customer sells one or more of the machine/machines listed in Annex 1 under this Contract;
b) If the Customer fails to render the monthly payment on time; (In such situations, clauses in Article 11. regarding termination of the Contract shall be effective.)
c) If Machine/Machines are technically altered without written approval of XXXXX International;
a) If Machine/Machines are not used in accordance with the written and verbal instructions of XXXXX International and manufacturer firm and compliant to reasonable standards anyway.
e) If environmental and operational conditions which are recommended to the Customer by XXXXX International are not adapted and/or the Customer fails to take measures to improve these conditions.
f) If Machine/Machines are moved to another site without written notification to XXXXX International and approval.
g) If Machine/Machines are serviced by third parties other than XXXXX International technical staff and personnel of the Customer under supervision of XXXXX International staff.
9. Force Majeure:
In case of an act of God including, but not limited to, fires, earthquake, floods, heavy snow, acts of official authorities, riot, commotion, war, curfew, embargo, strikes, lock outs or disorder, acts or threats of terror etc., XXXXX International shall not be held responsible for any delay or not providing services. XXXXX International must inform the Customer that XXXXX International shall be late for the Service or not be able to provide the Service under conditions which XXXXX International has no control.
10. Copies:
This contract is hereby issued in 1 (one) original copy. Stamp tax shall be paid by the Customer.
11. Term of the Contract
The Contract shall continue to be enforced on its own unless parties terminate the contract at least 15 (fifteen) days before the expiration date of the contract. The service contract monthly price may be revised in agreement with the Customer.
In the even that the Customer fails to fulfil its payment commitments, XXXXX International may terminate the Contract and charge parts and services furnished that vastly exceed standard prices. After the termination of the Contract, Services and spare parts provided to the Customer shall be charged over XXXXX International's standard Turkish price list.
For Contracts with maintenance, if the Customer terminates the Contract after maintenance, cost of maintenance shall be separately charged to the Customer by calculating over current hourly prices.
12. Transfer of the Contract:
The Customer shall not transfer its contractual rights, power and liabilities to another organization and/or entity without written approval of XXXXX International. On the other hand, XXXXX International may transfer all or part of contractual rights, title or interest over machine or this contract or all or part of debts payable for any reason.
13. Amendment of the Contract
This Contract may hereby not be amended or altered unless it is agreed between the parties with a written document in proper way.
14. Applicable law and jurisdiction:
İstanbul Courts and Enforcement Office shall have exclusive jurisdiction in any dispute regarding performance of this Contract.
Parties read and signed this Contract after issuing it.

It's an ordinary day. Wake up, eat breakfast, brush your teeth and off to kindergarten.
Linus’ slippers are in their proper place in the dressing room. He reaches for them, but another hand is faster. A brown hand. Linus looks up wondering. Happy eyes are beaming at him. It’s Lin! His Lin, whom he met on vacation, in the sand, on the beach. Lin's father is an engineer. He improves and invents new things. He will be inventing new things here in the city. For the factory. That is why Lin moved here, Mum says. A happy coincidence. But Linus knows better. There are coincidences, and there are miracles. One time, Linus felt like eating peas. And what did they have that day in kindergarten? - Peas! THAT was a coincidence. But Lin suddenly showing up here in his kindergarten - that can't be a coincidence. THAT is a miracle.
Mum and Dad are also happy that Lin is here. Linus smiles more often and his eyes sparkle. They invite Lin's family over for tea. On the weekend, they take a trip to the house of stars - the Planetarium.
The Planetarium is a big building with a huge circular roof. You almost feel like you are sitting inside a football, but with millions of stars sparkling on the round roof. Even during the day. Even when it rains. The stars are not real. But they look as real as the deep black night.
There is a man wearing a white suit and a helmet in the hallway. He is an astronaut, a "galactic traveller". Galactic travellers journey to alien planets. Linus feels excitement spread through his chest like thousands of ants. "How do you become a galactic traveller?" he asks, his heart racing.
Lin's dad explains: Astronauts need to speak English well. Like Linus' Mum. They must have studied engineering. Like Lin's dad. They must endure extreme turbulence on an aeroplane and flying upside down, without being sick. Linus can do that. He never gets sick when flying.
But now he feels sick. Because that was not all. Astronauts must be healthy. Fit as fiddles.
Completely. The legs too.
Lin is sitting in a capsule that looks like a real space ship, one that could fly off into the sky. Lin waves cheerfully. But Linus turns and rolls towards the exit. For him, the sky has died.
Lin says something to her mother. In Chinese. Lin's Mum says something to Linus' Mum. In English. Linus' Mum says nothing at all. She only smiles, then pushes Linus outside. She seats him in the car. Papa folds the wheelchair. They drive off. Without saying a single word. Lin and her Mum drive ahead in their own car.
They stop in front of a skyscraper. They take the elevator to the tenth floor. Lin lives here. Lin pushes Linus to her room. There are stars stuck to the ceiling, almost like at the Planetarium. Lin takes a big box out of the closet. It has scissors, glue, twine and paper in all colours in it.
Lin begins working. She cuts and folds and binds and wraps and glues. Linus' wheelchair has turned into an awesome moon rocket!
They stay at Lin's for a long time. They have soup with lemon grass. It is galactically delicious. Lin rolls Linus out onto the balcony. Lin has a telescope. The two gaze through the telescope at the starry sky. They are sparkling so beautifully that Linus can feel it in his heart.
And then it happens: A meteor shoots across the night sky. Linus calls out and raises his arms in the air.
Was that a miracle? A coincidence? Linus is not sure. He knows only one thing: This is what happiness feels like.
Paul, the Astronaut

My friend is a Princess. Her name is Dotty. Her dress is covered in dots. And there are dots dancing all around her nose. Guess what she loves to draw?
My friend Leonardo is a lion. "I will eat you and the whole world!" he often roars, and bites into an apple. Leonardo has a gap he can spit through between his teeth.
My name is Paul. I am an astronaut and fly into space as often as I can. But I do not even have a spaceship. I only need to close my eyes and stretch my arms out.
Three, two, one! I take off and float out into infinite space.
Where should I land? Maybe on the planet I discovered during my last flight into space? That planet is not far away from Earth.
It revolves around a sun we can't see from Earth. Where its rays touch the planet, it is bright. The other side is dark.
"All clear for landing!" I call out.
I set down on the sunny side.
Perfect landing. "You must leave!" I hear a voice suddenly behind me and turn around. There stands Moustache Bert. Bert is a boy who wears a fake moustache. Bert could have said "Hello" or "How nice to see you here." But he did not.
"When I do this," (he forms an X with both index fingers), "it means that you're supposed to leave." "B-but we can both play here," I stutter. But Bert keeps his fingers crossed over each other. So I leave. I go to the other side. There, where it's dark.
Bert pulls up a deck chair and gets comfortable in it. He puts on a pair of sunglasses takes a sip of his lemonade. "I love sitting in the sun", he says with relish. I, however, sit on the shady side looking up at the shimmering stars.
I am alone, completely alone. But not for long. Can it be? A small spaceship is flying towards me. It looks like a tricycle and hisses like a train. The ship lands on my side, the shadowy side of the small planet. Two travellers appear from the ship: Princess Dotty and Lion Leonardo.
What an entrance! Even Moustache Bert on the sunny side sits up to better see our jumps for joy. "Let's play something wild!" Leonardo suggests. "No, let's build a sandcastle!" says Dotty. So that is what we do. Moustache Bert steals guilty glances at us. He would like to play with us, for sure. We had built a beautiful castle and are now playing Moon long jump. "Farther!" roars Lion Leonardo. "Higher!" Princess Dotty laughs. And then it happens.
Her crown tumbles from her head and rolls over to Bert on the sunny side. He picks up the crown, takes a step over to the shadowy side, and returns the crown to the Princess. He turns to go. "When I do this" (I put my hands on my heart), "it means you can play with us if you want to," I say. A smile creeps over Bert's face. "Really?" he asks, his moustache shaking. "Yeah!" the wild lion roars.
"We can also go play on the sunny side", Bert suggests. "Then we can play catch on the whole planet", Princess Dotty cheers and we all run off to hide.

Literacy is a fundamental key to the world and to a self-determined life. Children learn faster the more they are exposed to written texts. Reading aloud has a special significance: Young children that are read aloud to regularly are more successful and socially competent in school (see: www.stiftunglesen.de). Reading creates an atmosphere of active rest, a feeling of security and increases the concentration of the little listeners.
Our picture booklet XXXXX picks up themes that are interesting to children five years and older, and can be integrated in programmes promoting language in kindergarten and primary school. Since each booklet is published in German and an immigrant language strongly represented in Austria and Germany, children with immigrant backgrounds are encouraged to learn their first language, and therefore the acquisition of the German language. Scientific studies have shown that learning new languages is easier, the better the knowledge of the first language.
This booklet is available in: German-Albanian, German-Arabic, German-Bosnian-Croatian-Serbian, German-Polish, German Romanian, German-Chechen and German-Turkish and in German-English for children whose first language is German or a language not majorly represented in Austria and Germany. Ideally, XXXXX will be read aloud at home in the first language first. That way, children are familiarised with the stories and content and can participate more actively when they are read aloud in German or English at kindergarten or school again. This facilitates learning the new language.

Swimmers escaped big danger yesterday
Endurance swimming race organized by İstanbul Fest Committee, started yesterday at 10:45 in Galatasaray club in Bebek.
25 swimmers participated the race. While the racers were in front of Haydarpaşa buoy, as a shark was seen, swimmers were quickly picked up from the sea but 4 swimmers who has already passed this point and finished the race. Among them, İsmail from Beykoz won the first place. Cemal from Ortaköy was the second and Arif from Galatasaray was the third. Committee honoured these three swimmers with gifts.

Korfu, 18, (a.a) --- (Reuter): A bloody disaster has happened in Korfu beach. A giant shark going at sea surface at150 meter away from beach, chopped a young girl named Vanda Perri and also hurt her accompanying boyfriend.
During this incident, though a Greek patrol boat saw the monster but she has not fired on it for not injuring any other swimmer.

Taranto 24 (a.a) ---- Fishmongers fishing in Taranto bay, offshore of Gelibolu harbour, have catched a shark weighting one tone. Despite its dangerous tail strikes, they succeeded to come ashore with it.

Mr. Öztürk who is faculty member of İstanbul University and also a diver, has commented that news headline on newspapers, “Sheeps in lazaret may initiate a shark attack” does not reflect the truth. He explained its impossibilities as follows:
“In case, lazarets are closed or opened, sharks may come around of a ship. But there are sharks in Bosphorus at all seasons. For example, you may see sharks going around İndian Tanker sunk in front of Rumelihisarı. However, these sharks which are know as “Mustakis Vulgaris” or “Acanthias Vulgaris” and called as “camgöz” (glass eyed) are not from shark family which are dangerous to people. Moreover, sharks living in deep sea cannot come to here as the water of Bosphorus is very cold. Besides that, sharks do not eat sustenance which are not fresh and live, i.e unattractive to them and decayed after a while.

Yesterday, freestyle wrestling competition took place in Taksim stadium. Although it was very hot, number of audience was more than five thousand. Among them, Ministry of Justice Şükrü Saraçoğlu was there too. This audience was rather different than football fans regularly attending football matches in Stadium.
Our critics about the disorders in the stadium which we saw last week, have been taken into account with goodwill and corrective actions and necessary arrangements have been made. Ropes of wrestling ring have been correctly tightened and tied up and torn apart fabric on the ropes were removed. A borderline was drawn against intrusion of people into the wrestling ring and there were no one except authorized personnel.
First wrestling match between Kazım and Selim brothers from Bursa was watched with joy and high attention. These prospective stars who are nine and eleven years old respectively, have wrestled before and little Kazım has beated his older brother. This time, Selim won the match at 9. minute with touché.

Two fishermen on the boat have been comatosely rescued after they tried to survive at sea for two hours
Yesterday morning, a terrible accident happened in Bakırköy offshore at the sea of Marmara. Three men, Laz Hüseyin, Ali Osman and Tursun at the boathouse of Hüseyin Agha, went sailing with a fishing boat to fish. When they arrived offshore of Bakırköy, a very big shark which suddenly came up from the sea, attacked the fishboat. Despite the counter attack of fishermen with oars and hooks, the shark crushed the fish boat with its beats. Laz Hüseyin and his friends jumped into the sea with great horror and tried to escape from the location of shark and they succeeded.
It seems that the shark did not find it necessary to follow fishermen after crushing the fishing boat. These three fishermen tried to survive at the sea for two hours. Finally, a boat going there has picked up these men from the sea and brought them to Zeytinburnu.
After first medical attention, these three men who were sick due to cold and horror were sent to their home.

1) Enter chamber and close door. An internal emergency light willautomatically turn on for 5 minutes
2) Switch on main internal lighting. Switch located on front of scrubbing unit
3) Turn on the Positive Pressure Compressed Air Cylinder
DO NOT ADJUST AS FLOW IS PRE-SET
4) Ensure Inverter control switch located on the scrubber is in the ONposition
5) Activate Siren, Green Strobe and Comms. Switches located on front of scrubber.
6) Activate Digital Gas Monitor by holding down the red power button.If manual gas monitoring supplied refer to rear of procedure manual.
7) Switch on Air conditioner, remote located on front of scrubber. (To start theAir conditioner manually, lift the front cover, push and hold the emergencyoperation button.)
ACTIVATE SCRUBBING SYSTEM
1) Remove one (1) MARCISORB CO2 Cartridge from its packaging and place on top right hand side of scrubber unit. REPLACE WHEN CO2 REACHES 1%. Life support table located on chamber wall also shows change out times ifrequired.
2) Remove one (1) MARCISORB CO Cartridge from its package and place on top left hand side of scrubber unit. DO NOT REMOVE ONCE INSTALLED.
3) Commence scrubbing by activating the switch marked SCRUBBER located onthe front of the scrubber unit.
4) Fit oxygen regulator to oxygen cylinder and tighten

The xxx tape, yyy label and zzz tube cassettes can be used in your kkk labelling machine.
IMPORTANT
If the new tape cassette has a cardboard stopper, be sure to remove the stopper before inserting the cassette.
Check that the end of the tape is not bent and that it passes through the tape guide.
If it does not, pass it through the tape guide as shown in the illustration.

Press the cover open button to open the top cover.
Insert the tape cassette into the tape cassette compartment with the end of the tape facing the machine’s tape exit slot, then push down evenly until the tape cassette is installed correctly.
When inserting the tape cassette, make sure that the tape and ink ribbon do not catch on the print head.
Make sure that there is no slack in the tape, and then carefully insert the tape cassette.
If there is slack in the tape, the tape will catch on the protrusion (2) when the cassette is inserted and become bent or wrinkled, causing the tape to jam.
To fix the slack in the tape, refer to the illustration in step 1 and pull the tape outside of the tape guide.
When removing the tape cassette, make sure that the tape does not catch on the protrusion (2).
Close the top cover.

Source text - English It’s now or never to make the world gender equal
Achieving gender equality and eliminating poverty are part of the same battle. As we mark International Women’s Day, let us remember that the 2030 Agenda for Sustainable Development needs all of humanity to succeed, not just half of it.
Gender equality is not only a moral obligation and a matter of human rights. It is also the most effective way to promote peace and security, boost economies and realize the full potential of families and communities across the world.
That premise is at the heart of the Sustainable Development Goals (SDGs), but what will it take to make it a reality? Eastern Europe and the Commonwealth of Independent States, the region covered by the Bureau I head at the U.N. Development Programme, provides valuable insights into both achievements to date and key challenges lying ahead of us.
The region compares favourably with many other parts of the world as measured by UNDP’s Gender Inequality Index. This is primarily due to low maternal mortality rates and relatively high levels of education. But despite progressive legal reforms and other measures undertaken, women across the region are underrepresented at all levels of decision-making and leadership in political, economic and public life.
For example, they hold less than 20 per cent of all seats in parliament. That’s well below the critical mass of 30 percent considered necessary anywhere in the world for women to contribute meaningfully to politics. Further, few women ministers are given responsibility for the economy, infrastructure, foreign or internal affairs, which are considered “men’s issues”.
When it comes to the economy, only about 46 percent of working-age women are employed, compared with 70 percent of men, and they earn 19 percent less for the same work. In addition, there are few women at managerial and executive levels – just 12 percent in Turkey for example.
Instead, women hold precarious jobs and spend much more time doing unpaid care work. In Azerbaijan, for instance, women spend five times as much time working domestically and taking care of children, the sick and the elderly. In Bosnia and Herzegovina, the gender employment gap in families with young children has reached 44 percentage points.
These trends show that gender inequality in Eastern Europe and the Commonwealth of Independent States is rooted in multiple layers of exclusion – including day-to-day discrimination, restrictive laws and the absence of mechanisms for social mobility.
There needs to be a concerted effort to eliminate all forms of exclusion and encourage women to fulfill their aspirations as leaders, entrepreneurs and citizens.
First, women and men should be recognized as equal before the Law. Recent reforms in this area have been encouraging. For instance, ten countries have laws prohibiting lending institutions from denying anyone access to credit based on their gender, while Albania, Belarus, the Former Yugoslav Republic of Macedonia and Georgia have taken bold new steps to criminalize domestic violence.
Second, as more women become political leaders, gender quotas can be an effective measure for increasing the political representation of women in parliament and other public institutions, although their implementation needs to be closely scrutinized. More importantly, increasing women’s political participation requires a complete change of culture.
Third, we must set the bar high to unleash women’s economic potential. This will require moving the female labor force into higher value-added sectors. From the technology start-ups of Poland to fashion outlets in Kazakhstan, women are transforming the way this region does business and their creative energy needs to be nurtured and used as an instrument for growth.
Fourth, investing in social care is an effective approach for both improving women’s labor participation and boosting the economy. In Turkey, bringing public spending on social care up to OECD levels would generate 719,000 social care jobs—more than 2.5 times the number of jobs created if that amount were spent on infrastructure.
On this International Women’s Day, let us renew our commitment to step up and make this a 50-50 planet. If women can participate and benefit equally from the current global development agenda, we may very well live to see the end of poverty.

Cinsiyet eşitliğini sağlamak ve yoksulluğu ortadan kaldırmak aynı savaşın parçalarıdır. Uluslararası Kadınlar Gününü kutlarken şunu unutmayalım; Sürdürülebilir Gelişim 2030 Programının insanlığın tümünün başarmasına ihtiyacı vardır, sadece yarısının değil.
Cinsiyet eşitliği sadece bir ahlaki zorunluluk ve insan hakları sorunu değildir. Aynı zamanda barışı ve güvenliği teşvik etmek, ekonomileri geliştirmek ve dünya çapında ailelerin ve toplulukların tam potansiyelini gerçekleştirmenin de en etkin yoludur.
Bu öncül Sürdürülebilir Gelişim Hedeflerinin (SDGs) merkezinde yer alır, fakat bunu gerçekliğe dönüştürecek şey nedir? Bu eğilimler göstermektedir ki Doğu Avrupa'daki ve Bağımsız Devletler Topluluğu'ndaki cinsiyet eşitsizliğinin kökleri birden fazla ayrımcı katmana dayanmaktadır – günlük yaşamdaki ayrımcılık, kısıtlayıcı yasalar ve sosyal hareketlilik mekanizmalarının olmaması bunlara dahildir.
Tüm ayrımcılık biçimlerinin ortadan kaldırılması ve kadınların lider, girişimci ve vatandaş olma isteklerini başarmaları için teşvik etmek amacıyla çok güçlü ve üzerinde anlaşmaya varılmış bir ortak çabaya gerek vardır.
Öncelikle kadın ve erkek Yasa önünde eşit olarak kabul edilmelidir. Bu alanda son zamanlarda yapılan reformlar ümit vericidir. Örneğin, Arnavutluk, Beyaz Rusya, Eski Yugoslav Makedonya Cumhuriyet ve Gürcistan ev içi şiddete karşı yasal önlemler alarak cesur adımlar atarken on ülke, kredi veren kuruluşların cinsiyetine bağlı olarak herhangi birinin kredi talebini reddetmesini yasaklayan kanunlar çıkartmıştır.
İkinci olarak, daha çok kadın politik lider olurken cinsiyet kotaları, kadınların parlamentoda ve diğer kamu kurumlarında politik temsiliyetlerini artırmak için etkin bir önlem olabilir; yine de bunların gerçekleştirilmesinin yakından takip edilmesi gereklidir. Çok daha önemlisi, kadınların politik katılımının artırılması tam bir kültür değişikliğini gerektirmektedir.
Üçüncü olarak, kadınların ekonomik potansiyelini açığa çıkartmak için çıtayı yükseltmeliyiz. Bu ise kadın iş gücünü daha fazla katma değerli sektörlere yönlendirilmesini gerektirecektir. Polonya'daki teknoloji şirketlerinden Kazakistan'daki moda evlerine kadar kadınlar bu bölgedeki iş yapma şeklini dönüştürmektedir ve yaratıcı enerjilerinin gelişimde bir enstrüman olarak kullanılması ve teşvik edilmesi gereklidir.
Dördüncü olarak, sosyal hizmete yatırım yapmak hem kadınların iş gücüne katılımının artırılması hem de ekonominin güçlendirilmesi için etkin bir yaklaşımdır. Türkiye'de, sosyal hizmete yapılan kamu harcamalarını OECD seviyelerine yükseltmek 719.000 sosyal hizmet işi oluşturabilir – aynı miktarın alt yapıya yapılması durumunda yaratılan iş sayısının 2.5 katı.
