1 Receipt and Registration of Tenders
Deadline for receiving tenders for the WWTP Torba was 08.March 2013 at 14:00 h local time.
Three (3) tenders were delivered timely. The tenders were registered showing the date and time of submission and a receipt was given to the tenderers who submitted the tenders by hand.
2 Tender Opening Session
Before opening of the tenders, the expert of consultant introduced the tender opening procedure to tender evaluation committee formed of 5 staff of BOSKI and the Municipality.
The tender opening was conducted at 14:15 h on the same day 08.March 2012 in the premises of Bodrum Municipality.
Representatives of all three tenderers attended the opening. The tenders were opened in the order of receipt and following issues were checked:
1. The packages submitted were checked for the completeness of the copies and good condition of the submissions;
2. Letter of Tender were checked for proper signature and Tender Price were read loudly and written to the bid opening record;
3. Tender Security for EUR 24,000 or TRY 60,000 were checked and announced loudly;

3 Evaluation of tenders
After the tender opening session, the tender evaluation committee members left the premises and all tender packages were carried to another room where evaluation sessions were carried out.
3.1 Technical Evaluation of Tenders
According to Details of Technical Solution in Section IV: Tender Forms of Part 1, “the technical proposals will be subject to examination and incompliant proposals (proposals which are not found to be adequate for the required works) will be rejected.”
So, the technical evaluation of tenders was carried out by the Wastewater Expert of Consultants and summary of main findings is provided in Annex 2. In technical evaluation, the following issues were identified as “technically incompliant with Employer’s Requirement” and clarifications requested:
Tenderer 1: Artaş Endüstriyel Tesisler Taahhüt ve Tic. A.Ş.
1. Referring to Part 2 Section VI Requirements, 2.2 Plant Description, Sub heading Biological Reactors, p.22, “The sludge stabilization shall take place either in biological reactors or in a separate tank in aerobic conditions”.
In process description report (Technical Proposal) of tenderer; sludge age was given as 4-6 days, which shows that simultaneous sludge stabilization will not take place in biological reactors. Moreover, a separate stabilization tank was not provided in the design. According to German ATV-DWVK-A131 standards, sludge age must be minimum 25 days at 12 C for simultaneous sludge stabilization. When the temperature of reactor content increases, required sludge age will decrease inversely.
For this reason, the tenderer was requested a clarification. In the detailed calculation provided with Clarification No.1, the tenderer showed that the sludge retention time would be 10.12 days at 25 C reactor temperature.
According to 2.1 Scope of Works of Part 2: Section VI Requirements, “the wastewater treatment plant shall be designed for a minimum temperature in the process tanks of 15C. The oxygen demand calculations shall be designed for a maximum temperature of 25C in the activated sludge tanks”. Therefore, the Tenderers were expected to calculate dimensions of treatment units for temperature in the process tanks of 15C. In this regard, the volume of biological reactor of tenderer cannot provide required sludge age for simultaneous sludge stabilization. As a result, the tenderer was asked once again to clarify reasons of designing bioreactor for 25 C instead of 15 C. In clarification letter of tenderer, it was stated that sludge age calculations for winter and summer were done for 15 C and 25 C, respectively.
In addition, the tenderer was asked to clarify reason of using 6500 mg/l mixed liquor suspended solids (MLSS) concentration in calculation of sludge age. Because, this concentration is the attached MLSS concentration, not overall MLSS concentration in the tank.
The tenderer replied that generally sludge age is not expressed in attached growth system and the calculations provided are used to compare attached systems with conventional activated sludge systems and they are provided as supplementary information. This answer cannot justify using of wrong MLSS concentration in the design.
Consequently, the volume of biological reactor is not enough for simultaneous sludge stabilization for minimum temperature of 15 C regardless of season.
2. The tenderer was also requested to give more information about the proposed coarse screen. The explanation of tenderer is satisfactory and the proposed coarse screen is in line with the Requirements.
3. Finally, Employer informed the tenderer like the others that the existing underground inlet structure is leaking due to insufficient construction quality and ageing; therefore the Contractor shall rehabilitate this structure and provide a watertight structure. The tenderer replied that the rehabilitation needs of existing underground structure are included in its offer according to tender documentation and as stated during site meeting. (Please note that the rehabilitation of existing underground structure is not mentioned anywhere in tender documents and the Contractor cannot be obliged to do so, unless he undertakes voluntarily. )
Consequently, the technical proposal of tenderer is not compliant with the tender documents.
Tenderer 2: Arbiogaz Çevre Teknolojileri İnş. San. Ve Tic. A.Ş. - Organica Technologiak Zrt. JV
1. Referring to Part 2 Section VI Requirements, 2.2 Plant Description, Sub heading Fine Screens, p.21, “The capacity of fine screen shall be selected for Stage-2 requirements.” Since the capacity of fine screen proposed by the tenderer was not clear in his tender, the tenderer was asked for clarification. Then, the tenderer confirmed that the capacity of fine screen would be appropriate for Stage-2 requirements.
2. In “Detailed Technology Description”, under sub-heading 5.1.4 Vortex type grit chamber in the tender, it was stated that “grit is removed in these type of grit chambers using a vortex flow pattern”. Whereas in 12.3.3 Equipment List as well as drawings, Integrated Pre-treatment system is given as grit and grease removal unit. The tenderer was requested to clarify this inconsistency and he confirmed that vortex type grit chamber would be provided
3. The tenderer proposed to use micro filtration (disc filter) for the removal of suspended solids (mainly biological flocs) after biological reactors. Since there was no enough information about the proposed equipment, the tenderer was requested to provide the evaluation committee with the details of the equipment. Then, the catalogue was provided by the tenderer.
4. Referring to Part 2 Section VI Requirements, 2.2 Plant Description, Sub heading Odour, p.18, “Odour treatment shall be dry-scrubber type”. However, in tender “biofilter type ” was proposed, which is not in line with the Requirements. Therefore, the tenderer was requested to clarify the reason of this inconsistency and to confirm the full compliance with tender documents. The tenderer confirmed that he proposed dry-scrubber type odour removal unit which is fully compliant with tender documents and biolfilter was mistakenly written in the tender.
5. The tenderer was requested to submit a CD containing “Technical Solution Documents” as per Part 1 Section IV: Tender Forms, Details of Technical Solutions. The soft copies of technical solution was provided by the tenderer.
6. Finally, Employer informed the tenderer like the others that the existing underground inlet structure is leaking due to insufficient construction quality and ageing; therefore the Contractor shall rehabilitate this structure and provide a watertight structure. The tenderer confirmed that his tender includes all necessary rehabilitation and repair works and also provided a method statement for the envisaged works.
Consequently, the technical proposal of tenderer is fully compliant with the tender documents.
Tenderer 3: Ludwig Pfeiffer Hoch undTiefbau GmbH & Co. KG
1. In technical proposal, 3 outlet pumps (of which 1 was spare) each with capacity of 43.2 m3/h were proposed. Considering the max. flowrate in summer (140 m3/h), total capacity of outlet pumps seems insufficient. The tenderer was asked to clarify the reasons behind selection of these pumps. The tenderer informed that an equalization tank with 500 m3 capacity was designed for amortization of hydraulic peaks during the day. Therefore, outlet pumping station could operate with smaller capacity than inlet one, according to Tenderer. The clarification is reasonable and therefore those outlet pumps can be accepted.
2. Referring to Part 2 Section VI Requirements, 2.2 Plant Description, Sub heading Sludge Dewatering, p.24, “All digested sludge shall be dewatered by means of a centrifuge decanter”. However, in his tender, “disc press” instead of centrifuge decanter was proposed. The tenderer, therefore, was requested to confirm that “centrifuge decanter” should be used for sludge dewatering as specified in Requirements. The tenderer confirmed that centrifuge decanter could be applied instead of disc press.
3. Finally, Employer informed the tenderer like the others that the existing underground inlet structure is leaking due to insufficient construction quality and ageing; therefore the Contractor shall rehabilitate this structure and provide a watertight structure.
Consequently, the technical proposal of tenderer is fully compliant with the tender documents.
The summary of technical evaluation and comparison of the technical evaluation of the lowest two bidders are provided as Annex 1 and 2 respectively.
3.2 ReviEW of the COSTS
According to Section 1.3 Pricing of Price Schedules within Part 1 Section IV Tender Forms, the Tenderer shall spread his general expenses, risks, profit and any other costs equally to the unit prices and no front loading is allowed.
The duration of this contract 270 days including days spent for pre-commissioning and commissioning tests and 90 day trial operation period. That means duration of execution of works is maximum 180 days. So the items suitable for “front loading” are limited. The Contractor can potentially exaggerate the price of design studies to finance the mobilization. The percentage of price of design studies (excluding as-built design and O&M manuals) in the total price (Item 11) of Artaş and Arbiogaz-Organica is 0.9% and 3.6%, respectively. General value for design study is around 1-3% of the total cost. The price of design study of Arbiogaz-Organica is a bit higher.
The other potential works items for “front-loading” are excavation works and supply of equipment.
The price of excavation works of Arbiogaz-Organica is 3 times more than that of Artaş. But this does not show us existence of “front loading”. The main difference comes from the cost of pipeworks. It is not possible to finish pipeworks in very beginning before the completion of concrete works. Therefore, we cannot mention about “front loading” in Schedule 3 of Arbiogaz-Organica.
According to Section 1.3 Pricing of Price Schedules within Part 1 Section IV Tender Forms, fifty percent (50%) of the price stated in the corresponding item of Schedule 6 Mechanical Works and Schedule 7 Electrical Works shall be made upon delivery to site. The cost of equipment of biological reactor of Arbiogaz-Organica is TRY 803,187. This price item consists of mainly costs of bacteria carriers and mixers. This equipment/material can be brought to site in short time after the approval of design and material data sheets. Therefore, it can be assessed as potential “front-loading”. But, we cannot be sure of intention of this tenderer.
Consequently, there are no exact evidences of “front loading” in the Price Schedules.
Detailed evaluation of the costs of the lowest two tenderers are provided as Annex 3.
3.3 POST QUALIFICATION
The post-qualification evaluation was based on the evaluation and qualification criteria of Section III of the tender documents. All three bidders have been subjected to post qualification. Details of the post-qualification review are provided in Annex 4. The summary is as follows:
2.1 Eligibility: All of the tenderers fulfil the eligibility criteria.
2.2 Historical Contract Non-Performance: None of the tenderers has a history of historical non-performance and/or litigation awards against the Tenderer.
2.3 Financial Situation: Artaş and Pfeiffer fulfil all requirements. The other tenderer, Arbiogaz-Organica JVcan not demonstrate long term profitability due to insufficient financial capacity of JV partner Organica which has (-) EUR 2,208,000 average profit in last 3 years. Therefore, Employer requested a clarification from Arbiogaz-Organica JV for reason/s and justification of negative profit (loss) in the last three years.
The tenderer replied that Organica Technologies Ltd. Together with its mother company Organica Water Inc. had received approximately EUR 14 million capital from its investors. The expenses related to the global business development activities, which were reported as current expenses , accounted for the negative profit of the Company in the last three years. The tenderer also expressed that the business development expenses in the past three years financed from capital investments, would contribute to the long-term profitability of the Company.
According to Section III Evaluation and Qualification Criteria, the last 3 years’ audited balance sheets of tenderer must demonstrate the soundness of the Tenderer’s financial position, showing long-term profitability. The tender committee requested to further evaluate the working capital and net worth of the Organica to better assess their financial situation. Accordingly:

As it is seen the return on Equity is -187% in 2011 which again shows a critical financial situation for the Organica company. Finally, 2012 balance sheet is requested from the company according to which a 71 Euro profit is declared by the end of 2012. However, detailed analysis of the balance sheet and profit and loss statements showed that this minor profit is due to 2 different grants, which don’t have any impact on the operational conditions and financing from operating activities is negative.
As a result, Arbiogaz – Organica JV financially doesn’t meet the criteria as one of partners cannot show long-term profitability.
2.4 Experience:
General Experience : All of the tenderers fulfil the general experience criteria.
Specific Experience: Specific experience criteria required by the tender documents is “participation as contractor or management contractor in at least one (1) contract of wastewater treatment plant with average flow capacity of at least 1,000 m3/day, of which the treatment process is same as the proposed process in this tender within the last five (5) years ,that has been successfully and substantially completed.
The 1st tenderer Artaş provided a list of 8 references within its tender but copies of the reference letters/job completion certificates were not available. Therefore, the tenderer was requested to submit evidences indicating the tenderer’s specific experience in the proposed treatment process (IFAS-moving bed biological reactor). The tenderer provided notary certified copies of all 8 references and expressed that one reference (namely Industrial Waste Water Treatment Plant of Kayseri Sugar Factory has the same process as the one proposed for Torba WWTP and indicated the name and contact details of authorized person for confirmation. The tenderer was approached again to submit an official letter which confirms the treatment process of reference is same as the proposed process. Finally, the tenderer sent an official letter from the employer (Kayseri Sugar Factory) stating that the process of their WWTP constructed by the tenderer is MBBR which is the same process proposed also for Torba WWTP. The provisional acceptance date of reference is 02.01.2008 which is older than 5 years considering the announcement date of tender notice (i.e. 07.01.2013).
The 2nd tenderer Arbiogaz-Organica JV provided several references of which only one, namely Contract for Work for 1000 m3/d WWTP of Etyek in Hungary was found appropriate as the treatment process of this plant is same as the one proposed for Torba WWTP (i.e. aerobic Submerged Fixed-film Process). The commissioning date is given as 2008 in the reference letter. As the exact date (in the form of day.month.year) of commissioning is not clear in reference letter, the evaluation committee may seek clarification from the tenderer.
The 3rd tenderer Pfeiffer submitted two references for specific experience but none of them has similarity with the proposed process (IFAS-moving bed bioreactor) for Torba WWTP. Therefore, this tenderer cannot fulfil the required criteria for specific experience.
2.5 Personnel: the proposed main personnel for the positions of Project Manager and Process Engineer of all tenderers fulfil the requirements
2.6 Equipment: the proposed equipment for execution of the works of all tenderers fulfil the minimum requirements

Zamanında teslim edilen üç (3) ihale teklifinin kayıtları alındı ve ihale katılımcılarına üzerinde başvurunun yapıldığı tarih ve saatin yazılı olduğu makbuzlar elden teslim edildi.
2 Ihale açılış oturumu
Tekliflerin açılışından önce, ihale açılış prosedürü BOSKİ ve Belediye bünyesindeki İhale Değerlendirme Komitesi'nin 5 personeline uzman danışman tarafından sunuldu.
İhale açılışı 8 Mart 2013 tarihli aynı gün içerisinde Bodrum Belediye tesislerinde 14:15'te yapıldı.
3 ihale temsilcisi de açılışa katılımda bulundu. Teklifler başvuruların yapıldığı tarih sırasına göre açıldı ve aşağıdakiler kontrol edildi:
1. Sunulan tekliflerin kopyalarının eksiksizliği ve iyi durumda teslimi;
2. Teklif mektubundaki imzaların geçerliliğinin kontrolü ve Teklif Fiyatlarının yüksek sesli okunduktan sonra Teklif Açılış Raporu'na yazılması;
3. İhale Açılış Rakamının 24.000 Euro / 60.000 YTL olarak teyidi ve yüksek sesle okunuşu;

3 TEKLİFLERİN DEĞERLENDİRİLMESİ
Oturum açılışının ardından, Teklif Değerlendirme Komitesi üyeleri teklif paketleriyle beraber tesisten ayrılarak değerlendirmelerin yapılacağı odaya geçti.
3.1 TEKLİFLERİN TEKNİK AÇIDAN DEĞERLENDİRİLMESİ
İhale Formları 1. Bölüm, 4. Kısım'da yer alan Teknik Çözüm Detaylar'a istinaden: ''Teklifler teknik açıdan incelemeye tabi tutulacak, gerekli çalışmalar için elverişli olmayan aykırı teklifler reddedilecektir.''
Tekliflerin teknik değerlendirilmesi Atıksu Uzman Danışmanı tarafından yapıldı ve değerlendirmenin özeti Ek 2'de sunuldu. Teknik değerlendirmede, aşağıdaki konular ''işverenin belirlediği koşullara aykırı'' bulundu ve resmi açıklama talep edildi:
Katılımcı 1: Artaş Endüstriyel Tesisler Taahhüt ve Tic. A.Ş.
1. Bölüm 2, Kısım 6 'Koşullar', 2.2 'Tesis Tanımı'nın 22. sayfasında incelenen 'Biyolojik Reaktörler' altbaşlığına istinaden ''Çamur stabilizasyonu, biyolojik reaktörler veya aerobik koşulların sağlandığı havalandırma tankı yardımıyla gerçekleşecektir.'' Teklif sahibinin Süreç Tanımı Raporu'nda (Teknik Teklifi'nde) çamur yaşı 4 ila 6 gün arasında verilmiştir, bu da demektir ki, eşzamanlı çamur stabilizasyonu biyolojik reaktörlerde gerçekleşmeyecektir. Üstelik, tasarıda ayrı bir stabilizasyon tankından bahsedilmemiştir. Almanya'nın ATV-DWVK-A131 standartlarına göre, eşzamanlı çamur stabilizasyonun gerçekleşebilmesi için çamur yaşının en az 25 gün, çamur ısısının ise 12 santigrat derece olması gerekmektedir. Buna göre reaktör işletme ısısı arttıkça, stabilizasyon için gerekli çamur yaşı hızla düşecektir.
Teklif sahibinden resmi bir açıklama talep edildi. Açıklama 1'de detaylı olarak verilen hesaplamalar dahilinde; teklif sahibi, 25 santigrat derece ısıdaki çamurun tutma süresinin 10 ila 12 gün arasında olacağını beyan etti.
Bölüm 2, 2.1 İşlerin Kapsamı: 4. Kısım Koşulları'na göre: ''Atıksu Arıtma Tesisi, tankların en az 15 santigrat derece ısıya sahip olacak şekilde tasarlanacak, oksijen ihtiyacı hesaplamaları ise aktif çamur tanklarının en çok 25 santigrat derece ısıya sahip olacağı şekilde yapılacaktır.'' Bu nedenle, ihale katılımcılarından arıtma ünitelerinin ebatlarını, tankların 15 santigrat derece ısıda olacağı şekilde hesaplamaları beklenmiştir. Bu teklifte, biyolojik reaktör hacminin, eşzamanlı çamur stabilizasyonu için gerekli çamur yaşını sağlaması mümkün değildir. Sonuç olarak, ihale katılımcısından biyoreaktör tasarımında 15 santigrat derece yerine 25 santigrat derece tercih ettiğine dair açıklama istendi. İhale katılımcısının açıklama mektubunda, çamur yaşı hesaplamalarının yaz ve kış ayları için sırasıyla 25 ve 15 santigrat derece olarak belirlendiği görüldü.
Ek olarak, katılımcıdan çamur yaşını hesaplamada neden 6500 mg/l MLSS (Askıda Katılarla Karışmış Sıvı Madde) konsantrasyonu kullandığına dair bir açıklama da talep edildi. Çünkü, katılımcının belirlediği konsantrasyon ölçüsü tankın tamamına yeterli gelecek ölçüde değildir.
Teklif sahibi, açıklamasında askıda büyüyen arıtma sistemlerinde çamur yaşının genelde bahsedilmeyeceğinden, hesaplamaların klasik aktif çamur sistemleri ve askıda büyüme sistemleri arasındaki farkı kıyaslamak için yapıldığından bahsetti. Bu cevap teklif sahibinin tasarımında yanlış MLSS kullanımını haklı çıkarmaz.
Sonuç olarak, eşzamanlı çamur stabilizasyonu için -mevsim farkı gözetmeden- minimum 15 santigrat derece ısı ile tasarlanacak biyolojik reaktör hacmi yeterli değildir.
2. İhale katılımcısından, teklif ettiği kaba ızgaraya dair daha fazla bilgi vermesi istendi. Katılımcının açıklaması tatmin edicidir ve teklif edilen kaba ızgara gerekli koşulları taşımaktadır.
3. Son olarak, ihale katılımcısı yeraltı yapısındaki sızıntının yetersiz inşaat kalitesi ve yaşlanma sebebiyle oluştuğu konusunda bilgilendirildi ve bu sebeple ihale katılımcılarından bu yapıyı düzeltmeleri ve su sızdırmaz bir yapı oluşturmaları beklendiği açıklandı. Katılımcı, mevcut yeraltı yapısına dair ihtiyaçları teklifine dahil ettiğini beyan etti. (Altyapı iyileştirme çalışmaları daha önce hiçbir ihale dökümanında görülmediği için ihaleyi alanın gönüllü olmadığı müddetçe sorumlu tutulamayacağını not alınız.)
Sonuç olarak, ihale katılımcısının teklifi teknik açıdan projeye uyumlu değildir.
Katılımcı 2: Arbiogaz Çevre Teknolojileri İnş. San. Ve Tic. A.Ş. - Organica Technologiak Zrt. JV
1. Bölüm 2, Kısım 6 Gereksinimler, 2.2 Tesis Tanımı'nın alt başlığı olan ve 21.sayfada incelenen İnce Izgaralar'a istinaden: ''İnce ızgara hacimleri, 2. Kademe koşullarına uygun olarak belirlenecektir.'' İhale katılımcısından teklifinde ayrıntılı bilgi vermediği ince ızgara hacmi hakkında bir açıklama talep edildi. Ardından, katılımcı belirlediği ince ızgara hacminin 2. Kademe koşullarına uygunluğunu doğruladı.
2. Detaylandırılmış Teknolojik İnceleme'de bulunan 5.1.4 Girdap Tipli Kum Tutucular alt başlığına istinaden: ''Bu tarz kum tutucularda; kum, girdap akım düzeneği vasıtasıyla temizlenir.'' Diğer yandan 12.3.3'te incelenen Ekipman Listesi'ne göre, Karma Ön Arıtma Sistemi kum ve yağ temizleme ünitesi olarak benimsenmiş ve çizimleriyle verilmiştir. Katılımcıdan bu tutarsızlığı açıklaması beklendi ve katılımcı, projede girdap tipli kum tutucuların kullanılması gerektiğini doğruladı.
3. Katılımcının, askıda katı maddelerin (genelde sıvı maddede asılı katı maddelerin) temizlenmesi için mikro filtre (diskli filtre) kullanımı teklifine rağmen, gerekli ekipman hakkında bir bilgilendirme yoktu. Ekipman detaylarına ilişkin bir açıklamanın talep edilmesinin ardından, katalog katılımcı tarafından Değerlendirme Komitesi'ne sunuldu.
4. Bölüm 2, Kısım 6 Gereksinimleri, 2.2 Tesis Tanımı, Koku altbaşlığının 18 sayfasına istinaden, ''Koku Arıtma, kimyasal yıkama (dry-scrubber) sistemiyle gerçekleşecektir.'' Teklifte ise kurallara uygunluk taşımayan biyolojik filtreden bahsediliyordu. Bu sebepten dolayı, katılımcıdan bu tutarsızlığın giderilmesi ve ihale belgeleriyle tam uyum sağlanması istendi. Katılımcı, ihale belgelerine tam uyumlu kimyasal yıkama (dry-scrubber) sisteminin teklifinde yer aldığını, fakat biyolojik filtrenin yanlışlıkla yazıldığını onayladı.
5. Katılımcı, ''Teknik Çözümler'' içerikli bir CD sunumu yapma talebinde bulundu ve ardından, Bölüm 1 Kısım 4: İhale Belgeleri ve Teknik Çözüm Ayrıntıları başlıkları altında bir sunum gerçekleştirdi. Teknik çözümlere ilişkin CD'nin kopyaları katılımcı tarafından sağlandı.
6. Son olarak, ihale katılımcısı yeraltı yapısındaki sızıntının yetersiz inşaat kalitesi ve yaşlanma sebebiyle oluştuğu konusunda bilgilendirildi ve bu sebeple ihale katılımcılarından bu yapıyı düzeltmeleri ve su sızdırmaz bir yapı oluşturmaları beklendiği açıklandı. Katılımcı teklifinin gerekli tüm onarım ve rehabilitasyon çalışmaları içerdiğini açıkladı ve öngörülen işler için uygulanacak sistemin beyanında bulundu.
Sonuç olarak, ihale katılımcısının teklifi projeye teknik açıdan tam uyumludur.
Katılımcı 3: Ludwig Pfeiffer Hoch undTiefbau GmbH & Co. KG
1. Katılımcının teknik teklifinde, her birinin hacmi 43.2 m3 olmak üzere biri yedek toplam üç çıkış pompası bulunmaktadır. Yaz mevsiminde maksimum akış miktarının 140 m3 olduğu düşünülecek olursa, çıkış pompalarının toplam hacmi (140 m3) yetersiz görülmektedir. Bu sebepten dolayı, katılımcıdan bu pompaları seçiş nedenlerinin açıklaması talep edildi. Katılımcı, 500 m3 kapasiteli dengeleme tankının gün içinde oluşacak hidrolik tepe noktaları dikkate alınarak tasarlandığını belirtti. Bu sebepten dolayı, katılımcıya göre çıkış pompa istasyonu, girişe göre daha küçük bir hacimle çalışabilirdi. Bu nedenle, çıkış pompalarının beyan edildiği teklif açıklaması kabul edilebilir bulundu.
2. Bölüm 2, Kısım 6 Gereksinimleri, 2.2 Tesis Tanımı, Çamur Susuzlaştırma altbaşlığının 18 sayfasına istinaden ''Çamur santrifüj dekantörde susuzlaştırılacaktır.'' Buna rağmen, bu teklifte filtre pres yöntemi tercih edildiğinden; katılımcıdan çamur susuzlaştırma yöntemi için belirlenen kurala uyup uymayacağı soruldu. Katılımcı, çamur susuzlaştırma için santrifüj dekantörün filtre pres yerine kullanılabileceğini onayladı.
3. Son olarak, ihale katılımcısı yeraltı yapısındaki sızıntının yetersiz inşaat kalitesi ve yaşlanma sebebiyle oluştuğu konusunda bilgilendirildi ve bu sebeple ihale katılımcılarından bu yapıyı düzeltmeleri ve su sızdırmaz bir yapı oluşturmaları beklendiği açıklandı.
Sonuç olarak, ihale katılımcısının teklifi projeye teknik açıdan tam uyumludur.
Teknik değerlendirme ve en düşük iki teklif sahiplerinin teknik değerlendirme karşılaştırması sırasıyla Ek 1 ve 2'de sunulmuştur.
3.2 Maliyetlerin incelenmesi
Bölüm 1.3'te incelenen ve Kısım 6 İhale Belgeleri'nin Birinci Bölümü ile de uygunluk gösteren Maliyet Planlaması'na göre, teklif sahibi genel harcalamaları, risk, kar ve tüm diğer masraflarını eşit birim fiyatlara bölerek, ödemeleri dengeli kılacak şekilde dağıtacaktır.
Bu sözleşmenin süresi işe alım, deneme ve 90 günlük operasyon deneme süreci için harcanan gün de dahil olmak üzere toplamda 270 günü kapsar. Bu da iş icra süresinin maksimum 180 günden oluştuğunu gösterir. Bu durum da, ön yüklemeye (front loading) yatkın öğelerin sınırlı olduğunu gösterir. Teklif sahibi tasarım çalışmalarını finanse edebilmek adına fiyat artırımına gidebilir. Artaş ve Arbiogaz-Organica'nın tasarım çalışmalarının fiyat yüzdeleri (nihai tasarım ve olası gözlem&ölçüm değişiklikleri hariç) sırasıyla %0.9 ve %3.6'dır. Tasarım çalışmalarının genel değeri toplam tutarın yaklaşık %1-3'ünü oluşturmaktadır. Bu rakamlar Arbiogaz-Organica'nın tasarım çalışma fiyatının biraz daha yüksek olduğunu gösterir.
Örneğin, kazı çalışmaları ve ekipman temini ön yükleme (front loading) için potansiyel öğelerdir.
Arbiogaz-Organica'nın kazı çalışma masrafları Artaş'ın 3 misli olmasına rağmen, bu fark ön yüklemeyi (front loading) meşru kılmaz. Temel fark boru döşeme işinden gelmektedir, çünkü betonlama işleminin tamamlanmasından önce boruların döşenme işleminin sona ermesi mümkün değildir. Bu sebepten dolayı, ön yatırım (front loading) koşullarının Arbiogaz-Organica için uygulanması düşünülemez.
Bölüm 1.3'te incelenen ve Kısım 6 İhale Belgeleri ile de uygunluk gösteren Maliyet Planlaması'na göre, Mekanik ve Elektrikle İlgili işlere bağlı ürünlerin (Planlama 6 ve 7) ödemesinin %50'si ekipmanın tesise temininin ardından yapılır. Arbiogaz-Organica ekipmanlarından biyolojik reaktörün tutarı 803.187 TL'dir. Bu tutar temel olarak bakteri taşıyıcı ve karıştırıcıları masraflarından oluşur. Bu ekipman/malzeme tesise tasarım ve gerekli belgelerin onayından kısa bir süre sonra getirilebilir. Bu, potansiyel bir ön yükleme (front loading) olarak değerlendirilebilecek olsa da teklif sahibinin bu alandaki planı bağlayıcı kabul edilemez.
Sonuç olarak, Maliyet Planlamaları dahilinde ön yatırıma (front loading) dair kesin bir bulgu yoktur.
En düşük iki teklif maliyetlerinin ayrıntılı değerlendirmesi Ek 3'te sunulmuştur.
3.3 YETERLİLİK DEĞERLENDİRMESI
İhale dökümanlarının 3. Bölümü'nün kriterlerine istinaden değerlendirilen her üç teklif sahibi de yeterli bulunmuştur. Ayrıntılı değerlendirme yorumları Ek 4'te sunulmuştur. Yeterlilik değerlendirmesi aşağıdaki gibi özetlenebilir:
2.1 Uygunluk: Teklif sahipleri kriterlere uygunluk göstermiştir.
2.2 Yasaklı Geçmiş: Hiçbir teklif sahibinin yasaklı bir geçmişi bulunmamaktadır ve/veya haklarında alınan bir hüküm yoktur.
2.3 Mali Değerlendirme: Teklif sahiplerinden ikisi Artaş ve Pfeiffer tüm koşulları mali açıdan yerine getirmiştir. Diğer teklif sahibi Arbiogaz-Organika JV'nin ise uzun süreli kar politikası izlemesi, son 3 yılda (-) 2.208.000 Euro kara sahip olmuş yetersiz mali kapasitesinden ötürü mümkün değildir. Bu sebepten dolayı Bodrum Belediyesi, Arbiogaz-Organica'nın geçtiğimiz 3 yıl içerisinde yaptığı zararın gerekçesine dair açıklama talebinde bulunmuştur.
Katılımcı, şirketi Organica Technologies Ltd Şti ve ana şirketi Organica Water Inc.'ın yatırımcılarından yaklaşık 14 milyon Euro para akışı sağladığını, ancak güncel gider olarak rapor ettiği küresel bazda iş geliştirme faaliyetleri sebebiyle şirketinin son 3 yılda zarar ettiğini beyan etti. Katılımcı ayrıca iş geliştirme faaliyetlerinin şirketin uzun süreli kar etme kapasitesine katkıda bulunacağını da ekledi.
Bölüm 3'te yer alan Değerlendirme ve Yeterlilik kriterlerine göre, teklif sahibi son 3 yıldaki bilançosunun sağlamlığını ispatlamak ve uzun vadede elde edeceği garantisini vermek zorundadır. İhale komisyonu, daha ileri bir değerlendirme için Organica'nın işletme sermayesini ve net değerini talep etti.

Görüldüğü üzere, 2011 yılındaki -%187 olan özkaynak verimliliği Organica Şirketi için kritik bir finansal duruma işaret etmektedir. Son olarak, katılımcıdan 2012 yılının 71 Euroluk karla bitirilmiş ve aynı yıl sonunda deklare edilmiş bilanço dökümü talep edildi. Detaylı bilanço dökümü ve kar-zarar durumları bu küçük karın iki ödenek tarafından karşılandığını gösterse de, bu karın çalışma şartlarına ve operasyon için harcanacak finansmana olumlu herhangi bir etkisini göstermemiştir.
Sonuç olarak, teklif sahiplerinden Arbiogaz – Organica JV'nin mali kriterleri sağlamadığına ve uzun vadeli kar sağlayamayacağına karar verildi.
2.4 Tecrübe:
Genel Tecrübe : Bütün katılımcılar genel tecrübe kriterlerine uygunluk göstermiştir.
Özel Deneyim: İhale belgelerinin gerektirdiği kriterlere göre, ''Müteahhit veya Proje Yönetimi'ne mensup olan katılımcının son beş (5) yıl içinde en az bir (1) defa, minimum 1000 m3/gün ortalama akış kapasitesine ve işbu ihaleyle aynı koşullara sahip, başarıyla tamamlanmış bir atıksu arıtma tesisi projesine dahil olması gerekmektedir.''
Birinci katılımcı Artaş, üzerinde 8 referans bulunan listeyi komisyon huzuruna sundu, fakat referans mektubu ve iş bitirme sertifika kopyaları sunumda mevcut değildi. Bu nedenle katılımcıdan arıtım aşamasına ilişkin özel deneyimlerini kanıtlar nitelikte belgeleri sunması talep edildi. Katılımcı, 8 referansının tümünün noter onaylı örneklerini ve referanslarından birinin (Kayseri Şeker Fabrikası Endüstriyel Atıksu Arıtma Tesisi) TAAT (Torba Atıksu Arıtma Projesi) 'da yürütülecek projenin dengi olduğunu onaylatmak adına yetkili kişinin bilgilerini sundu. Katılımcıdan, geçmişte çalıştığı arıtma tesisinin TAAT ile denk işlemlerden geçtiğinine dair resmi bir belge sunulması istendi. Son olarak katılımcı, Kayseri'deki işverenin gönderdiği ATT'de de işleme konulması öngörülen Hareketli Yatak Biyofilm Reaktörü'nün yapımının katılımcı tarafından gerçekleştirildiğini belirten resmi mektubu komisyon huzuruna sundu. Referans geçici kabul tarihi 2 Ocak 2008 olmakla beraber, 5 yıl olarak öngörülen ihale bildirim ilan tarihinden (7 Ocak 2008) eskidir.
İkinci katılımcı Arbiogaz-Organica JV, AAT için de uygun görülmüş (Aerobic Submerged Fixed-film Process'in kullanıldığı), 1000 m3/gün ortalama akış kapasitesine sahip Macaristan Etyek Atıksu Arıtma Tesisi'ne ait İş Sözleşmesi'ni referans olarak sundu ve referans mektubuna göre ihalenin devreye girme tarihi 2008 olarak verildi. İhalenin devreye girdiği tarih; gün, ay ve yıl cinsinden belirtilmediği için İhale Komisyonu teklif sahibinden açıklama isteyebilir.
Üçüncü katılımcı Pfeiffer'ın sunduğu iki özel deneyim de AAT için önerilen işlem olan Hareketli Yatak Biyofilm Reaktörü'nü kapsamıyordu. Bu nedenle, özel tecrübe kriterleri katılımcı tarafından yerine getirilmemiş sayıldı.
2.5 Personel: Katılımcıların Proses Mühendisliği ve Proje Müdürlüğü pozisyonları için önerdikleri tüm ana personel kriterlere uygunluk sağlamıştır.
2.6 Ekipman: Katılımcıların yapılacak işlerin icrası için sunduğu tüm ekipman kriterlere asgari ölçüde uygunluk göstermiştir.
