What is “expungement?” It is not uncommon... to encounter the term “expungement,” or find an expungement order issued by the court. What does it mean? Here, Teaching Legal Docs will explore an expungement order, and try to place the document in a larger context of law and culture.

To “expunge” is to “erase or remove completely.” In law, “expungement” is the process by which a record of criminal conviction is destroyed or sealed from state or federal record. An expungement order directs the court to treat the criminal conviction as if it had never occurred, essentially removing it from a defendant’s criminal record as well as, ideally, the public record.

It is important to clarify that expungement is not “forgiveness” for committing a crime—that is a legal pardon. Likewise, pardons are not expungements and do not require removal of a conviction from a criminal record. In the United States, pardons may be granted by public officials. The President, for example, issues pardons annually. State governors may also pardon certain defendants in their states. Expungement proceedings, however, must be ordered by a judge, or court.

Given that this is for entry into the USA, I think the niceties of Russian law are not relevant here. I wouldn't know what "unexpunged" meant, and I don't think an immigration official would know either. So I think simple is better!

I think that's all that's needed. "Not struck out" is very awkward in English and I don't think it adds anything.

nspent convictions are those records that have not yet reached this defined time and will appear on a Basic Criminal Record Check. For exact time periods relating to types of offence please contact Disclosure Scotland or the Disclosure and Barring Service (DBS) directly. Any conviction, caution, reprimand or warning that an individual may receive is held on their Criminal Record, on the Police National Computer. There exist some offences that are classed as ‘non-recordable’ meaning they are not stored on the PNC and are instantly ‘spent’. This is is most commonly ‘on the spot’ fines but for more information contact the DBS directly.

1. Лицо, осужденное за совершение преступления, считается судимым со дня вступления обвинительного приговора суда в законную силу до момента погашения или снятия судимости. Судимость в соответствии с настоящим Кодексом учитывается при рецидиве преступлений, назначении наказания и влечет за собой иные правовые последствия в случаях и в порядке, которые установлены федеральными законами.

2. Лицо, освобожденное от наказания, считается несудимым.

3. Судимость погашается:

а) в отношении лиц, условно осужденных, - по истечении испытательного срока;

б) в отношении лиц, осужденных к более мягким видам наказаний, чем лишение свободы, - по истечении одного года после отбытия или исполнения наказания;

в) в отношении лиц, осужденных к лишению свободы за преступления небольшой или средней тяжести, - по истечении трех лет после отбытия наказания;

г) в отношении лиц, осужденных к лишению свободы за тяжкие преступления, - по истечении восьми лет после отбытия наказания;

д) в отношении лиц, осужденных за особо тяжкие преступления, - по истечении десяти лет после отбытия наказания.

4. Если осужденный в установленном законом порядке был досрочно освобожден от отбывания наказания или неотбытая часть наказания была заменена более мягким видом наказания, то срок погашения судимости исчисляется исходя из фактически отбытого срока наказания с момента освобождения от отбывания основного и дополнительного видов наказаний.

5. Если осужденный после отбытия наказания вел себя безупречно, а также возместил вред, причиненный преступлением, то по его ходатайству суд может снять с него судимость до истечения срока погашения судимости.

6. Погашение или снятие судимости аннулирует все правовые последствия, предусмотренные настоящим Кодексом, связанные с судимостью.

Разница есть: погашение - автоматическое прекращение этого статуса по окончании установленного законом срока; снятие - досрочное прекращение этого статуса судом по ходатайству осужденного, а также в результате амнистии или помилования.
