Ich übersetze ein im Kontext eines Scheidungsverfahrens eingeholtes Rechtsgutachten. Es geht dabei um ein in Kanada gelegenes Grundstück und die Frage, ob das darauf gebaute Haus dem einen oder dem anderen Ehegatten zuzusprechen ist und hier speziell darum, welches Recht anwendbar ist, also um eine Frage des Kollisionsrechts.

Ich habe Probleme mit dem Ausdruck "Grundsatzanknüpfung." Herzlichen Dank für Eure Hilfe.


Das anglo-amerikanische Recht nimmt eine **Grundsatzanknüfung** an das 'domicile of origin' vor, das mit der Geburt festgelegt wird und damit funktional weniger dem Wohnsitz nach deutschem Verständnis sondern eher der Staatsangehoerigkeit vergleichbar ist.

To realize that in order to apply many of our choice of law rules we need to be able to determine where a person is "domiciled." Many choice of law rules use domicile as their "connecting factor." In other words the choice of law rules direct us to the law of a person's domicile as the lex causae.

Connecting factors (contacts) - In the conflict of law, connecting factors, or contacts, are facts which tend to connect a transaction or occurrence with a particular law or jurisdiction (e.g. the domicile, residence, nationality or place of incorporation of the parties; the place(s) of conclusion or performance of the contract; the place(s) where the tort or delict was committed or where its harm was felt; the flag or country of registry of the ship; the shipowner's base of operations, etc.). Connecting factors are taken into consideration and weighed by courts and arbitrators, in determining the proper law (infra) to apply to decide the case or dispute. See Tetley, Int'l. C. of L., 1994 at pp. 41, 195-196.
