"nullity" appears to be a little strange to me, I have never heard the term before (which is possible of course). "null and void" is a more usual legal formulation, IMO.

having nullity / invalidity for consequence

(depending on the rest of the sentence it might have to be added: "in case of non-compliance").

Depending on the target readership of your text, you might want to consider a relatively 'easy-reading' alternative to the rather heavy, legalistic (or even religious, as medabs suggests) tone of "under penalty of nullity", such as:

"A sanction will be invalid unless the employer, or his representative, has given proper notice to the person on whom it is imposed [/employee in question]."

neutral Adam Smith : It depends on what happens after 'die ze oplopen'. I read the sentence as meaning those individuals who incur sanctions face the prospect of losing their job.

What follows is presumably something to the effect of "op de voorgeschreven wijze worden meegedeeld", i.e. no notice = no sanction
