Doctrina unanimã admite cã singurele probe absolute ale dreptului de proprietate sunt uzucapiunea, accesiunea si ocupaţiunea. In lipsa unei asemenea probe, o acţiune în revendicare se va rezolva prin compararea titlurilor reclamantului si pârâtului. Daca atât reclamantul, cât si pârâtul au titluri, iar titlurile provin de la autori diferiţi, urmeazã a se da eficienţã titlului ce provine de la autorul al cãrui drept este preferabil.
