「外形的違反」「形式的違反（= formal violation）」という意味かなと思いましたが、いかがでしょうか？　他に「外部者による違反」「外部にかかわる違反」などの可能性もあると思います。

次の例は、行動という「外側の目に見える違反」つまり外形的違反だけでは懲罰の対象にはならず、悪意という「内側の目に見えない問題」があった場合にのみ懲罰の対象となるという意味ではないかと思います。
