German term

einen Anspruch ausräumen

German to English Law/Patents Law: Patents, Trademarks, Copyright
Unstreitige Schutzrechte Dritter hat die verursachende Partei auszuräumen.

This is from a legal contract.

I wonder if this jsut means 'to deal with' but there is no entry in any legal dictionary.

Thanks for your suggestions.

Simon

now that you are aksing Yes, and no. Now that I got some beaury rest and my brain is halfway functioning again, I dug out the Dietl I have been lugging around. It offers "protected priviledge" in reference to cartels, so N/A here, but also "industrial property rights" for "gewerblich Schutzrechte" - so it depends on whatever needs to be protected.

@ Simon Johnson Please provide the source text containing the asked phrase. Thanks :-)

Intellectual? Thanks! Are you sure that these are intellectual property right?

... still not enough space. In any case, I need to catch up some ZZZZZs. :-)
Birgit Gläser Jul 2, 2009:
example intellectual property rights English The Contractor will indemnify and hold harmless the Client and the Client’s customers from and, at its own cost defend any action brought against the Client or its customer based upon a claim, legal action or allegation that the System Product(s) and/or Intellectual Property Right created by the Contractor pursuant to this Agreement or the Schedule (whether created using the Client’s Software or created by any other means whatsoever) infringes the Intellectual Property Rights of a third party and will pay the amount of any settlement or the costs and damages awarded including reasonable legal fees (if any) in such action.

intellectual property rights before someone complains about my spelling etc. again, just a discussion entry as my brain is "slightly" sleep-deprived but since no one answered so far I'd like to offer some input before logging off. I cannot see the "einen Anspruch", but if that is the original sentence I read it like this: "The infringing party is (solely) liable for the resolution/settlement of any violation of undisputed third-party intellectual property rights."

We usually have something along the lines that the violating party is solely liable to defend any alleged violation of third-party intellectual property rights. But since in this case the rights are undisputed, its probably more along "settle" --> your call.

I'll post an example in another entry (not enough space here...)

ausräumen is a little stronger than just "to deal with". It's more like eliminate/resolve/overcome/dispel.
